Call Meeting to Order Chair David T. Woodward called the meeting of the Board of Commissioners to order at 09:46 AM in the Commissioners' Auditorium 1200 N. Telegraph Road, 12 E, Pontiac, MI 48341. 2. Board of Commissioners - Presentation - Oakland Community Health Network Update Board Action #2024-3731 _ Megan Phillips, Director of Substance Use Disorder Abuse, Oakland Community Health Network addressed the Board to give a presentation entitield: Substance Abuse Disorder Services, followed by a short Q & A session. c. Board of Commissioners - Presentation - Oakland County Historical Commission Board Action #2024-3758 _ Dave Decker, Chair, Oakland County Historical Commission addressed the Board to give a presentation entitled: Oakland County Historical Commission, followed by a short Q & A session. d. Board of Commissioners - Proclamation - National Social Work Month Board Action #2024-3984 _ The Board introduced the following Proclamation honoring National Social Work Month. Social Workers focus on those who are vulnerable, oppressed or facing hardships by fighting social injustice and respecting the dignity and value of all people. These people are found in schools, hospitals, corporations, military and veteran affairs, mental health centers, social service agencies and all levels of government. The 2024 Social Work Month theme "Empowering Social Workers" asks communities to increase support for social workers and how they can positively impact social issues. 8. Communications a. Board of Commissioners - Letter of Resignation - Gretchen Adler, Art Institute Authority Board Action #2024-3968 _ Lisa Brown, Oakland County Clerk/Register of Deeds addressed the Board to read a communication from Gretchen Adler requesting the Board's acceptance of her resignation from the Oakland County Art Institute Authority. Moved by Penny Luebs to receive and file the communications. Seconded by Christine Long Motion Passed. A sufficient majority having voted in favor, the communications were received and filed. 9. Economic Development and Infrastructure Committee - Yolanda Smith Charles a. Board of Commissioners - Fiscal Year 2024 Appropriation with the Township of Highland for Tri-Party Road Improvement Program – Project No. 57742 Board Action #2024-3931 _ Approve Project No. 57742 submitted by the Township of Highland and authorize the transfer of Tri-Party Road Improvement Program funds in the amount of $37,370 from Non-Departmental Transfers appropriation (9090101); further, that the FY 2024 budget shall be amended as described in the attached Schedule A – Budget Amendment; further, that the Oakland County Clerk is requested to forward copies of this resolution to the Road Commission for Oakland County, Oakland County Fiscal Services, and the Community. Economic Development - Oakland County Transit Division - 2024 Amendment No. 2 to North Oakland Transportation Authority (NOTA) Interlocal Agreement for a Six-month Pilot Program Board Action #2024-3892 _ 24-12 Interlocal Agreement 2024 Amendment No. 2 to North Oakland Transportation Authority (NOTA) Interlocal Agreement for a Six-month Pilot Program Sponsored By: Brendan Johnson WHEREAS the North Oakland Transportation Authority (NOTA) and Oakland County have agreed to the 2024 Amendment-2 to the Public Transportation Agreement set forth in Exhibit A – Scope of Transportation Services and Exhibit B – Budget, to reflect increases in services and associated revenues and costs which new and amended exhibits are necessary to deliver public transportation services consistent with the Millage. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approves the 2024 Amendment-2 to the Public Transportation Agreement between Oakland County and NOTA with the attached 2024 amended Exhibit A – Scope of Transportation Services and Exhibit B – Budget. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners acknowledges the likelihood of a yet to be determined future appropriation from the Oakland County Public Transportation Millage to address increased costs for the newly expanded services. BE IT FURTHER RESOLVED that a budget amendment for the aforementioned increased costs shall be included in a subsequent quarterly forecast report and/or separate resolution. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners authorizes the Manager Transit, at his sole discretion, to grant changes in allocations within the line item budget, being Exhibit B attached, at the request of NOTA provided that such request shall be presented by NOTA to the Manager Transit in writing, specifying the change requested, the reason(s) for the requested change and verifying that such change will not result in an increase in the total budgeted amount under Exhibit B (i.e., a “no cost” amendment). BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners authorizes the Chair of the Board to execute the Amendment of Agreement on behalf of Oakland County. Attachments: 1. Economic Development - Business Development - Amendment No. 1 to Brownfield Redevelopment Subrecipient Agreement with Micah 6 Community for the Webster Community Center Project Board Action #2024-3942 _ 24-13 Contract Amendment No. 1 to Brownfield Redevelopment Subrecipient Agreement with Micah 6 Community for the Webster Community Center Project Sponsored By: Yolanda Smith Charles WHEREAS the Michigan Department of Energy, Great Lakes and Energy (EGLE) has awarded a $575,000 grant amendment to Oakland County for cleanup of contamination for the Webster Community Center in the City of Pontiac; and WHEREAS the Oakland County Board of Commissioners approved the grant amendment at their February 7, 2024, meeting (M.R. #2024-3794); and WHEREAS the developer of the Webster Community Center, Micah 6 Community will enter into an amendment to the Subrecipient Agreement (the “Amendment”) with Oakland County pertaining to this grant; and WHEREAS the Amendment will include an amended work plan once the work plan is approved by EGLE; and WHEREAS the County’s Corporation Counsel has reviewed and approved the Amendment between the County and the Micah 6 Community; and WHEREAS the Micah 6 Community has approved the Amendment. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby approves the attached Amendment No. 1 to the Subrecipient Agreement between Oakland County and Micah 6 Community. The final work plan approved by EGLE shall be reviewed and approved by the County’s Corporation Counsel and Economic Development before being incorporated in the Amendment. BE IT FURTHER RESOLVED that upon receipt of the executed Amendment to the Subrecipient Agreement from the Micah 6 Community designated agent that the Oakland County Board of Commissioners authorize its Chair to execute and enter into this Amendment to the Subrecipient on behalf of the County of Oakland. Human Resources - Amendment to the Oakland County Employees Retirement System Board Action #2024-3908 _ 24-14 Resolution Amendment to the Oakland County Employees Retirement System Sponsored By: Brendan Johnson WHEREAS the Oakland County Employees’ Retirement System (“Retirement System”) was established on January 1, 1946, under the authority of Section 12a of Act No. 156, Public Acts of 1851, as amended (MCL 46.12a); and WHEREAS as of January 1, 1994, the Retirement System was amended to include a 401(a) defined contribution retirement plan (the “401(a) Plan” or “DC Plan”) that provides benefits to eligible employees of the County of Oakland (“County”); and WHEREAS the DC Plan has subsequently been amended and restated, most recently pursuant to a restated resolution adopted by the County as of April 2018; and WHEREAS pursuant to Section 12.2 of the 401(a) Plan, the County has the authority to amend the DC Plan from time to time; and WHEREAS the County now desires to amend the 401(a) Plan to address the possibility of terminated employees being reinstated pursuant to a collectively bargained grievance process. NOW THEREFORE BE IT RESOLVED the 401(a) Plan is hereby amended effective as of January 1, 2024, as follows: 1. Section 5.10 – Voluntary Withdrawals is revised and restated in its entirety as follows: a. A Participant who (a) has met the age and service requirements for Normal Retirement as provided in Section 5.1, and (b) ceases to be a Member in accordance with Section 2.4(a), may take an in-service withdrawal of all or a portion of his or her Vested Account. Any such withdrawal shall be made in accordance with procedures established by the Retirement Board. b. In-service withdrawals shall also be permitted in situations where a Participant who (a) has not met the age and service requirements for Normal Retirement as provided in Section 5.1, and who (b) ceases to be a Member in accordance with Section 2.4(a), is subsequently retroactively reinstated to employment under the provisions of a collectively bargained grievance process. BE IT FURTHER RESOLVED that, except as herein provided, all other provisions of the 401(a) Plan shall remain unchanged and in full force and effect. b. Parks & Recreation - Grant Application TF24-0047 to the Michigan Natural Resources Trust Fund for the Acquisition of 71.17 Acres of Property in Troy Board Action #2024-3924 _ 24-15 Grant Grant Application TF24-0047 to the Michigan Natural Resources Trust Fund for the Acquisition of 71.17 Acres of Property in Troy Sponsored By: Brendan Johnson WHEREAS Oakland County Parks and Recreation Commission requests to apply for a grant in the amount of $2,175,000 from the Michigan Natural Resources Trust Fund (grant application TF24-0047) for the acquisition of 71.17 acres in Troy (“Turtle Woods”); and WHEREAS the 71.17 acres includes 69.5 acres of undeveloped land commonly referred to as “Turtle Woods” as well as an adjacent 1.67 acre residential parcel to be used for access and parking; and WHEREAS Oakland County is hereby making a financial commitment to the project in the amount of $425,000 in cash matching funds; and WHEREAS the sale of the property is being discounted by 50% or a match donated value of $1,875,000 by Troy School District in their purchase agreement with Six Rivers Land Conservancy, which will be assigned to Oakland County if/when a grant is awarded. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners supports and approves the grant application to the Michigan Natural Resources Trust Fund for $2,175,000 to purchase 71.17 acres of land in Troy for the creation of a nature preserve. BE IT FURTHER RESOLVED that staff is authorized to submit the electronic application on behalf of the Oakland County Board of Commissioners. Attachments: 1. WHEREAS from 2019 to 2021, there was a 68% increase in all drug overdose deaths in Oakland County; and WHEREAS during 2021, Oakland County had 180 drug overdose deaths involving synthetic opioids, which was a 119.5% increase in synthetic opioid involved deaths compared to 2020; and WHEREAS a $26 billion nationwide settlement was reached to resolve all opioid litigation brought by states and local political subdivisions against the three largest pharmaceutical distributors, McKesson, Cardinal Health and AmerisourceBergen (“Distributors”), and manufacturer Janssen Pharmaceuticals, Inc. and its parent company Johnson & Johnson (collectively, “J&J”); and WHEREAS Oakland County participated and signed on in national litigation against manufacturers, distributors, and pharmacies for their role in the opioid and overdose crisis; and WHEREAS Oakland County is projected to receive $38 million in opioid settlement funds over a total of eighteen (18) years, beginning in January 2023, as a result of litigation and subsequent settlement; and WHEREAS to date, Oakland County has received $5,241,000 in opioid settlement funds; and WHEREAS the use of opioid settlement funds must meet certain requirements as outlined in the settlement agreement and by the definition of opioid remediation as outlined in the settlement agreements; and WHEREAS the Michigan Association of Counties (MAC) developed a toolkit to provide a roadmap for local governments to plan for and use opioid settlement funds; and WHEREAS as recommended in the MAC toolkit, the County may establish an advisory Opioid Solutions Steering Committee to make recommendations on strategies and the use of Opioid Settlement funds for the Executive Office; and WHEREAS the Steering Committee could consist of up to 15 individuals who are representatives of the community from sectors including prevention practitioners, individuals with lived experience, family and friends of those with lived experience and agencies and community support groups that support people with lived experience (harm reduction providers, recovery support providers, schools and universities, behavioral health providers, treatment providers, medical examiner/coroner); and WHEREAS the Health and Human Services Department identified a need for supporting the development, implementation, and coordination of the steering committee and opioid activities and strategies. THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby authorizes the acceptance of Opioid Settlement Funds in the amount of $5,241,000. BE IT FURTHER RESOLVED that the county administration shall provide recommendations on strategies and use of Opioid Settlement Funds and require a separate resolution for appropriation brought forward for consideration to the Board of Commissioners.
