ITEM CATEGORY SPONSORED BY Staffing Modification Penny Luebs INTRODUCTION AND BACKGROUND The Oakland County Prosecutor's Office (OCPO) is requesting to reclassify one full-time Principal Attorney to Chief Prosecuting Attorney, a position that will serve as a Prosecutor’s Office team member, who identifies, pursues, and follows cases where behavioral health interventions should be pursued in addition to, or instead of criminal charges, and ensures that defendants are accountable to follow through with recommended treatment. This Chief will work with our community partners to ensure coordination of efforts, as well as a cohesive and consistent handling of cases. To reclassify one (1) GF/GP FTE Principal Attorney position (#4010201-06916) to Chief Prosecuting Attorney. PROPOSED FUNDING: General Fund. OVERVIEW: Across the country, jurisdictions are working to improve responses to people with behavioral health needs who encounter the criminal justice system. The Oakland County Prosecutor is the highest law enforcement official in Oakland County. Her Office is tasked with determining when criminal charges are appropriate based on information provided by police agencies. Public safety is always the top priority of the Prosecutor. When citizens with mental health issues, substance abuse issues, or both, come into the criminal justice system, public safety is best served by addressing those underlying issues. Those interventions may be in addition to, or instead of criminal charges. The Prosecutor has worked to identify and engage with community partners including Oak land Community Health Network (OCHN), community treatment courts, pretrial services, and Community Corrections to assess citizen needs, and explore options such as Assisted Outpatient Treatment (AOT) orders and the like. Currently the review, coordination, and oversight of individual cases engaged with our community partners is done piecemeal with no central oversight within the Oakland County Prosecutor’s Office (OCPO), and additionally, embedded clinicians can help agencies develop new approaches and provide direct intervention when needed. OCHN using the Sequential Intercept Model, collaborates with partners to embed clinicians throughout the justice system to help identify, refer, and provide support to people with behavioral health needs. Treatment alternatives to incarceration for defendants with mental health and substance use concerns may reduce the likelihood of recidivism and enhance public safety. Since July of 2022, OCPO and OCHN have offered this opportunity to 334 individuals: 84 adults and 250 juveniles. The OCPO, the Oakland County Sheriff’s Office, and OCHN frequently identify cases where criminal defendants with mental health issues remain incarcerated for extended periods waiting for evaluation and treatment. The extended periods of incarceration of individuals in need of treatment does not advance public safety, and comes at great cost to those defendants, their families, and taxpayers. The OCPO requests to reclassify one (1) GF/GP FTE Principal Attorney to Chief Prosecuting Attorney position that will serve as a Prosecutor’s Office team member, who identifies, pursues, and follows cases where behavioral health interventions should be pursued in addition to, or instead of criminal charges, and ensures that defendants are accountable to follow through with recommended treatment.
