ITEM CATEGORY SPONSORED BY Resolution Yolanda Smith Charles INTRODUCTION AND BACKGROUND In accordance with Purchasing Division policies and procedures, Facilities Planning and Engineering (FP&E) and the Purchasing Division solicited a proposal for roof restraint safety system at the Public Works Building (95 West) for annual competitively bid and selected contractors. Diversified Fall Protection of Holly Springs, North Carolina, provided the best value bid. The total project cost is $197,476.85, including $134,563.85 for engineering, guardrails and ladders, $30,000 for lightning protection, as well as $32,913.00 for contingency. Funding in the amount of $197,476.85 is available for transfer from the FY2024 Capital Improvement Program/Building Improvement Fund (#40100) to the Project Work Order Fund (#40400) for the Roof Restraint Safety System Project. POLICY ANALYSIS This project will engineer, furnish, and install a Roof Cable Fall Protection System for the Public Works Building. The building roof is often accessed for roof-top equipment maintenance, along with leaf/debris clean up, and general roofing system repairs. Currently a portable system is used. Fall protection is an OSHA requirement, specifically when working within the leading edge of the roof. Facilities Management (FM) has a policy that no worker accesses a roof without the proper training and safety system in place. FM has portable fall protection system(s) for use if a building is not equipped with a dedicated system. However, it is time consuming to setup. Working with Risk Management, the goal is to add fall protection systems on all roofs to ensure OSHA compliance and safety of workers on roofs whether they are working within the leading edge or not. OSHA 1910 and 1926 compliant. Ballasted design meets the ASCE7-10 design wind load. Safety railings are ideal for temporary or permanent rooftop applications. This panel design is easily configurable for most roof layouts. This guardrail system is non-penetrating. This quote includes the following guardrail components: Guardrail Systems includes: • Assorted Sizes of Guardrail Sections - Powder Coated Yellow or Galvanized • Guardrail Bases • Required Hardware • Ladder to Guardrail Connections as required • Self Closing Safety Gate - Powder Coated Yellow • Set of General Arrangement Drawings • Complete Installation by manufacturer trained and certified installation crew. • Includes all equipment required for installation. Option 2 - Total Price: $134,563.85 Proposed Guardrail System Layout Exclusions/Related Work by Others Additional scope items added from discrepancies, adds, changes or modifications shall be additional scope and additional costs shall be incurred unless these items are already explicitly noted within this proposal. All existing structural support structures to be used as primary support are assumed to be in their original integrity unless explicitly noted within this proposal; Diversified Fall Protection assumes no liability for unforeseen deterioration, rust, missing components, etc. Any financial liability due to any change in scope of work due to unknown underground utilities, underground conditions, unknown poor soil conditions or other unknown conditions at existing above ground support structures (such as unidentified additional roof loads, attachment points that were not structurally verified, measured or seen) not explicitly noted within this proposal. Weekend, second or third shift installations, unless explicitly noted within the scope of work. Bonds Permits Limit of Liability Diversified Fall Protection products carry $10,000,000.00 general liability coverage for the applicable warranty period, pending inspection of Fall Protection Anchorage Systems by DFP or its authorized agent at intervals not to exceed 12 months. Warranty Diversified Fall Protection (DFP) manufactured products are warranted in accordance with the published DFP Limited Warranty for a period of up to 10 years for fall protection anchorages and 2 years for guardrails, ladders, and platforms. Limited Warranty is contingent upon successful completion of OSHA/ANSI annual inspections. Payment Terms Net 30 Days. Finance charge of 1.5% per month, per past due balance. As a condition of this contract, you agree to pay all costs of collections, including reasonable attorney’s fees and court costs, if this account becomes delinquent. Any changes or modifications to the Scope of Work shall be mutually agreed upon and documented in writing by DFP and Purchaser/End User in the form of a change order. 2 Proposal is valid for 30 days – Freight Quote (if included) valid for 7 days. 3 Issuance of a purchase order to Diversified Fall Protection (“DFP”), based on the information in this proposal acknowledges acceptance of DFP’s General Terms and Conditions. 4 Purchaser/End User is responsible for securing any licenses, permits or other governmental fees required to commence the job. 5 Shipping and delivery dates (if applicable) are estimates based upon conditions prevailing at the time of quotation. 6 Purchaser/End User shall pay any expenses incurred by DFP due to Purchaser/End User's postponement of delivery, including but not limited to storage, refusal of delivery, inability to accept shipment or price increases by DFP’s suppliers assuming no adequate notice from Purchaser/End User to DFP of a need to delay. 7 Secure and adequate material lay down and tool storage space must be provided near the work site. 8 Uninterrupted access to the job site (if work is to be performed on site) must be provided for the agreed upon dates and times or additional charges may apply. 9 The work area will be clear and free from known or potential hazards for the duration of our time on site. 10 Work will be performed during normal business hours; between 7:00am and 4:30pm excluding weekends and holidays. 11 All work will be completed based on a mutually agreed installation schedule. 12 Both parties shall forward notice, in writing, regarding potential changes to the installation schedule not less than five days in advance of the potential change to avoid additional charges. 13 Work stoppages will require the parties to reassess the installation schedule and may lead to change orders based on impact. 14 DFP will put forth it's best effort in meeting its promised delivery/installation obligations but shall have no liability for delays in performance resulting from causes beyond its reasonable control, including, but not limited to acts or omissions of any government, acts of God, customs delays, acts or omissions of another party (including Purchaser/End User ), strikes, labor or transportation difficulties, or any other cause beyond the reasonable control of DFP. An extension of the time of performance will be equal to the time of the delay. 15 DFP will remove all trash created by DFP from the premises. This does not include removal of excess soil/earth/rubble resulting from system footing installation where applicable. 16 DFP and its employees will follow Purchaser/End User’s Site Safety Program while on the job site, unless the DFP Safety Program is more comprehensive. All work will be performed in a workmanlike manner. 17 Periodic safety meetings will be held as needed and are open to the Purchaser/End User . 18 If, within 5 days after receipt of notice that the work is completed, Purchaser/End User fails to notify DFP of non-acceptance, the work shall be deemed to have been accepted by Purchaser/End User . 19 Standard payment terms are net 30 days on all invoices. Project specific billing requirements will be called out in the quote. 20 DFP shall protect Purchaser/End User against any lien asserted against Purchaser/End User ’s property for equipment or services furnished by others at DFP’s request, provided that Purchaser/End User meets the payment obligations and other terms of this agreement. 21 A certificate of insurance will be furnished upon request. 22 The project and all documents will be governed by laws of the place of the project without giving effect to its conflict of law principles. 23 Any claims, disputes or controversies between the parties arising out of or relating to this project shall be decided by arbitration in accordance with the Construction Industry Arbitration Rules of the AAA then in effect, unless the parties mutually agree otherwise.
