ITEM CATEGORY SPONSORED BY Grant Penny Luebs INTRODUCTION AND BACKGROUND The Federal Bureau of Investigation (FBI) may reimburse state and local law enforcement agencies (LEA) for overtime expenses incurred as a result of task force-related activities. The FBI sends a Notice of Limits each fiscal year, which outlines the maximum limits for reimbursement under the Cost Reimbursement Agreement (CRA) between the Oakland County Sheriff’s Office (OCSO) Violent Crime Safe Streets Task Force (SSTF) and the FBI. The Oakland County Corporation Counsel reviewed and approved the Cost Reimbursement Agreement (CRA) between the FBI and OCSO and the Memorandum of Understanding for the Safe Streets Task Force (MR 18243). The Sheriff’s Office will receive up to $43,481 in SSTF reimbursement funding from the FBI for the period of October 1, 2024 through September 30, 2025 ($21,740.50 per Detective). This funding will be used for the reimbursement of overtime for two OCSO Detectives assigned to the SSTF for the expenses necessary to identify and target for prosecution of criminal enterprise groups responsible for drug trafficking, money laundering, alien smuggling, crimes of violence such as murder and aggravated assault, robbery, and violent street gangs, as well as to intensely focus on the apprehension of dangerous fugitives where there is or may be a federal investigative interest. POLICY ANALYSIS No county match is required. Acceptance of this grant does not obligate the County to any future commitment and continuation of this program is contingent upon continued future levels of grant funding. No County insurance requirements. – Robert Erlenbeck (09/12/2024) Corporation Counsel: Approved. – Heather Lewis (09/17/2024) NOTICE OF LIMITS FOR FY 2025 STATE AND LOCAL OVERTIME REIMBURSEMENTS Subject to the availability of funding and legislative authorization, the FBI may reimburse state and local law enforcement agencies (LEA) for the cost of overtime incurred by officers assigned full-time to FBI-managed task forces provided the overtime expenses were incurred as a result of task force-related activities. Consistent with regulation and policy, a separate Cost Reimbursement Agreement (CRA) must be executed between the FBI and the LEA, and an underlying Memorandum of Understanding (MOU) must exist in support of the task force relationship. For fiscal year 2025, the maximum limits for reimbursements under these CRAs are $1,811.70 per month and $21,740.50 per year for each officer assigned full-time to the task force. These limits are effective for overtime worked on or after October 1, 2024. These reimbursements are limited to eligible officers’ direct overtime salary expenses and shall not include any costs associated with the LEA’s indirect expenses or officers’ benefits such as retirement, social security, and similar related expenses. FBI field offices and state and local law enforcement agencies may process overtime reimbursement requests under formally executed CRAs in accordance with the authority of this notice. This notice is issued unilaterally by the FBI’s Budget Officer and does not require formal acceptance and signature by FBI field offices and state and local law enforcement agencies. This notice does not represent an authorization to obligate or expend funds. The actual amount of overtime expenses that can and should be approved for each task force officer is also dependent upon the availability of funding and operational necessity.
