ITEM CATEGORY SPONSORED BY Grant Penny Luebs INTRODUCTION AND BACKGROUND The Oakland County Sheriff’s Office entered into an interlocal agreement with the Oakland County Health Network (OCHN) to reimburse a position working with the Medication-Assisted Treatment (MAT) Program to treat eligible in-county Oakland County Jail inmates for opioid disorder for the time period October 1, 2023 through September 30, 2024. An amendment has been issued to extend this agreement for the period October 1, 2024 through September 30, 2025.The OCHN will reimburse the County in the amount not to exceed $67,445.40 for sixty percent (60%) of one (1) full- time eligible (FTE) Inmate Casework Specialist position (#12026) to work on the MAT Program for October 1, 2024 through September 30, 2025. The remaining 40% of position #12026, $44,964, will be funded by the Opioid Settlement Fund and incorporated as part of the MAT expansion agreement with OCHN. POLICY ANALYSIS The original agreement was approved by the Board on September 21, 2023 via resolution #2023- 3314. The continuation of this position is contingent upon continued reimbursement funding. Robert Erlenbeck (09/18/2024) Corporation Counsel: Approved – Mary Ann Jerge (09/19/2024) 2025 MAT PROGRAM INTERLOCAL AGREEMENT AMENDMENT #1 FY2025 INTERLOCAL AGREEMENT FOR THE MAT PROGRAM BETWEEN COUNTY OF OAKLAND AND OAKLAND COMMUNITY HEALTH NETWORK AMENDMENT #1 OCHN #2024-0008-SUD AMENDMENT #1 The Parties, COUNTY OF OAKLAND (“County”) and OAKLAND COUNTY COMMUNITY HEALTH NETWORK (“OCHN”), agree and acknowledge that the purpose of this Amendment is to modify as provided herein and otherwise continue the present relationship between the Parties as described in their current Medication-Assisted Treatment (MAT) Program Agreement (“Agreement”). This Amendment #1 shall take effect on October 1, 2024 and shall extend the terms of the Agreement through September 30, 2025 or is terminated by any of the Parties pursuant to section 12 of this Agreement. In consideration of the mutual promises, representations, assurances, agreements and provisions in the Agreement and this Amendment the adequacy of which is hereby acknowledged by the Parties, the Parties agree to amend the Agreement as follows: 1. The Agreement shall reflect fiscal year “2025” in the title of the Agreement; 2. Section 4 Term and Renewal of the Agreement shall be amended to start on October 1, 2024 and shall remain in effect until September 30, 2025. 3. Section 6.1 Responsibility for Claims of the Agreement shall be amended to the following: County shall be responsible and liable for all claims related to or arising from the acts and omissions of its employees, agents and contracted service providers. County and its contracted jail medical provider shall be responsible for claims arising from or related to administration of medications under the MAT Program. OCHN shall be responsible and liable for all claims related to or arising from the acts and omissions of its employees, agents, and subcontracted service providers except to the extent that the claims arise from or relate to such agents’ and subcontracted service providers’ administration of the medication at the direction or request of County or its contracted jail medical provider, then County shall be responsible and liable. 2025 MAT PROGRAM INTERLOCAL AGREEMENT AMENDMENT #1 4. Exhibit III Section 1 shall be amended to the following: 1. OCHN shall fund the County in a NOT TO EXCEED (NTE) amount for the following: 5.$62,948.40 for sixty percent of the total $104,914 cost of a full-time eligible Inmate Casework Specialist, which includes fringe benefits for the period of October 1, 2023 through September 30, 2024; and $67,445.40 for sixty percent of the total $112,409.00 cost of a full-time eligible Inmate Casework Specialist, which includes fringe benefits for the period of October 1, 2024 through September 30, 2025. 6. Exhibit III Section 4 shall be amended to the following: •The County will be compensated in the amount of $67,445.40 after October 1, 2024. To ensure timely payment, the County shall invoice OCHN for the full amount and direct the invoice to the attention of OCHN’s Chief Financial Officer. Prior to the close of FY25, the County will provide a cost settlement breakdown of the funding to OCHN’s Chief Financial Officer twenty (20) days after the end of the fiscal year. Cost settlement of this agreement will be based upon a comparison of the actual allowable expense for the Inmate Casework Specialist position and the amount paid by OCHN to the County. Any unspent funds will be returned by the County to OCHN within 30 days of the final settlement letter. 7. All other terms of the Agreement remain in full force and effect through the date of September 30, 2025. The Parties, by signing below, enter into this Interlocal Agreement for the MAT Program in the Oakland County Jail.
