ITEM CATEGORY SPONSORED BY Grant Brendan Johnson INTRODUCTION AND BACKGROUND The current State of Michigan budget awarded funds to the Electronic Recording Commission (ERC) to make grants up to $12,000 available to counties to facilitate or upgrade their real property e-recording capabilities. The Oakland County Register of Deeds is prepared to apply for an ERC grant for $12,000 to defray costs associated with expanding e-recording services in Oakland County. Seventy-five percent of the documents filed with the Register of Deeds is done via e-recording, primarily by title companies and higher-volume customers. While anyone may establish an e- recording account with one of the national companies that provide the service, it requires an annual license or subscription and other screening procedures, which can be time-consuming. Clerk/Register Brown has been working with the e-recording industry since 2021 to find a way to expand this service to those customers who don't e-record enough to justify getting an account. Through partnership with the e-recording company Simplifile, the Register of Deeds Office has developed MiPropDocs, an application for individuals to e-record certain types of documents without the need for an e-recording license or subscription. Document types acceptable for recording using MiPropDocs include Affidavits, Association Liens and Discharges/Releases, Claims of Lien, Certificates of Trust, Discharges, Lis Pendens, Notices of Commencement, Releases, and Satisfactions of Mortgage. Deeds and other documents that transfer ownership are not eligible for submission through MiPropDocs. Consistent with current e-recording standards, UCC documents and documents related to mortgage foreclosure are also not acceptable through MiPropDocs. The grant will provide reimbursement for expenses incurred by the Register of Deeds’ Automation Fund in the development of MiPropDocs. No additional personnel or local match is required for this grant. The grant agreement has completed the Grant Review Process.
