ITEM CATEGORY SPONSORED BY Collective Bargaining Agreement Brendan Johnson INTRODUCTION AND BACKGROUND The Human Resources Department and the UAW have negotiated supplemental agreements to address working conditions including uniform & boot allowance, on-call schedules and pay, shift premium, alternative work schedules, work location, and vehicle usage, for represented employees in the following departments: Corporation Counsel, Economic Development, Facilities Management, Health & Human Services, Homeland Security & Emergency Management, Management & Budget, Public Services, Sheriff's Office, and WRC. October 1, 2024 through September 30, 2028 This Supplemental Agreement is supplemental to and becomes a part of the UAW Local 889 Primary Agreement, hereinafter referred to as the “Primary Agreement” for the period commencing the 1st day of October 2024, for bargaining units 72 and 73 as recognized in the Recognition Article of the Primary agreement. Memberships and Dues: • The Employer shall pay dues to the State Bar of Michigan (including one sectional dues amount) and the Oakland County Bar Association for employees covered by this agreement. Michigan Rules of Professional Conduct (MRPC): • The Employer recognizes that employees covered by this agreement must adhere to the MRPC. Employees shall not be required to, or knowingly, provide an opinion, advice, recommendation, or take any action that is contrary to law or the MRPC. Shared Workspace: • The Employer and Union recognize the confidential nature of the work performed by employees covered by this agreement. Therefore, employees may continue to work in individual offices and workstations. Employees shall not be required to “hotel” or share a workspace. County Provided Phones: • Employer shall provide fully functioning smartphones to employees with the following Class Titles: Assistant Corporation Counsel, Assistant Corporation Counsel Senior, and Transactional Attorney Corporation Counsel. Classifications provided with county smartphones agree to be covered by the county electronic communications policy. Use of Outside Contractors: • The basis for reduction in force shall not be for the purpose of increasing the engagement of outside counsel services. • The County agrees to use best efforts to fill a vacant attorney position within 180 days of the position vacancy, but for just cause may request an extension of time for filling the vacancy, which shall not be unreasonably withheld. October 1, 2024 through September 30, 2028 This Supplemental Agreement is supplemental to and becomes a part of the UAW Local 889 Primary Agreement, hereinafter referred to as the “Primary Agreement” for the period commencing the 1st day of October 2024, for bargaining units 90 and 91 as recognized in the Recognition Article of the Primary agreement. Shift Premium: • All employees regularly scheduled or temporarily assigned to work second shift by their supervisor will be paid an additional $0.75 per hour. • All employees regularly scheduled or temporarily assigned to work third shift by their supervisor will be paid an additional $1.00 per hour. • In the event employees represented by the IBEW receive an increase in shift premium above these amounts, a “me too” clause shall apply to employees covered by this agreement. Boot Allowance: • All Employees will be reimbursed up to $275 per calendar year for the purchase of their safety/work boot. • All Employees receiving a boot allowance must have safety boots that meet the ASTM- F2413-18 Standard. • For those Employees who do not require safety boots, they will be reimbursed up to $150 for boots/appropriate footwear for their job (i.e. nonslip shoes). • Employees provided with boot/shoe allowance are required to always wear the footwear during business hours. • In the event employees represented by the IBEW receive an increase in Boot Allowance above this amount, a “me too” clause shall apply to employees covered by this agreement. Uniform Allowance: • Aviation & Transportation – All employees who wish to wear a uniform shall be provided the following every 12 months: Any combination of up to 6 pants or shorts, any combination of up to 6 short/long sleeve logo tee, any combination of up to 3 hooded logo sweatshirts (pullover or zippered front) or 5 non-hooded pullover logo sweatshirts. Not to exceed 5 sweatshirts in any combination and all sweatshirts will be of Carhartt quality or better, 1 logo polo style shirt with the approved logo for the annual airport open house (if shirts are produced for the airport open house), 1 logo baseball style cap, 1 logo wool cap, 1 pair winter gloves (Mechanix-style insulated cold weather gloves acceptable), 2 pair Mechanix-style (non-insulated) work gloves. All items above to be laundered will be the responsibility of the employee. All employees who wish, will be issued up to 5 cotton coveralls and 2 shop coats. The provided coveralls and shop coats will be laundered weekly at the County’s expense. All employees who wish to, will be provided with the following every 24 months: 1 Carhartt winter bib overall, 1 Carhartt winter jacket, 1 pair of high-quality rain gear (will only be replaced due to damage and supervisor approval). All items above to be laundered will be the responsibility of the employee. October 1, 2024 through September 30, 2028 This Supplemental Agreement is supplemental to and becomes a part of the UAW Local 889 Primary Agreement, hereinafter referred to as the “Primary Agreement” for the period commencing the 1st day of October 2024, for bargaining units 61 and 62 as recognized in the Recognition Article of the Primary agreement. Shift Premium: • All employees regularly scheduled or temporarily assigned to work second shift by their supervisor will be paid an additional $0.75 per hour. • All employees regularly scheduled or temporarily assigned to work third shift by their supervisor will be paid an additional $1.00 per hour. • In the event employees represented by the IBEW receive an increase in shift premium above these amounts, a “me too” clause shall apply to employees covered by this agreement. Boot Allowance: • All supervisory classifications (excluding Supervisor FM&O Administrative Services) and the following non-supervisory classifications shall receive a boot allowance: Maintenance Planner, Facilities Project Manager Senior, Facilities Project Manager, Facilities Project Coordinator and GIS CAD Technician Senior and GIS CAD Technician. • Employees of the Vehicle Operations Division shall receive a boot allowance. • All Employees will be reimbursed up to $275 per calendar year for the purchase of their safety/work boot. • All Employees receiving a boot allowance must have safety boots that meet the ASTM- F2413-18 Standard. • For those Employees who do not require safety boots, they will be reimbursed up to $150 for boots/appropriate footwear for their job (i.e. nonslip shoes) • In the event employees represented by the IBEW receive an increase in Boot Allowance above this amount, a “me too” clause shall apply to employees covered by this agreement. Uniform Allowance: • FM&O - All supervisory classifications shall receive uniforms consisting of 11 pants and 11 shirts as well as one three-part jacket or one lightweight spring/fall jacket and one winter jacket every 18 months. Weekly laundry of Uniform items will be provided at the County’s expense. All other items to be laundered will be the responsibility of the employee. • FP&E - The following non-supervisory classifications shall receive uniforms under Article 48: Maintenance Planner, Facilities Project Manager Senior, Facilities Project Manager, Facilities Project Coordinator and GIS CAD Technician Senior and GIS CAD Technician. All items to be laundered will be the responsibility of the employee. • Vehicle Operations - Uniforms will consist of 11 pants, 11 shirts, five t-shirts, two lightweight jackets with zip-in liners and any combination of three long shop coats or coveralls every 18 months. The employer will provide a Carhartt winter jacket in place of one lightweight jacket for those employees who request one. Weekly laundry of Uniform items will be provided at the County’s expense. • Mail Room and Record Retention – Uniforms will consist of 5 pants, 5 shirts, one lightweight jacket with zip-in liner and one Carhartt winter jacket every 18 months. All items to be laundered will be the responsibility of the employee. All employees who wish to, will be provided with the following every 24 months: 1 Carhartt winter bib overall, 1 Carhartt winter jacket, 1 pair of high-quality rain gear (will only be replaced due to damage and supervisor approval). All items above to be laundered will be the responsibility of the employee. Tool Allowance (Vehicle Operations Only): • All employees in the following classifications; Automobile Mechanic I, Automobile Mechanic II, Automobile Mechanic Senior, shall receive an annual tool allowance of $600. • All employees in the following classifications; Communication Installer I and Communication Installer II, Garage Attendant shall receive an annual tool allowance of $400. • The County shall continue to supply the present tools and supplies. In addition, the County shall provide all rechargeable tools and batteries of the Snap-On brand or alternative brand as mutually agreed upon by both employees and Oakland County. • New hires will receive their allowance after completing probation and will be pro-rated. On-call Pay • The Maintenance Supervisor (Electrical) shall not be in the on-call rotation with the other Maintenance Supervisors and thus not entitled to “On Call Pay” on a rotation basis. • The Maintenance Supervisor (Electrical) shall receive 11.5 hours “On Call Pay”, as equivalent compensation to the other supervisors who are on call, every five (5) weeks throughout the year. • The Maintenance Supervisor (Electrical) shall still take calls 24/7/365 to address electrical emergencies and provide support to the team over the phone. • The On-call Pay Article of the Primary Agreement shall be followed for the remaining on- call pay provisions. October 1, 2024 through September 30, 2028 This Supplemental Agreement is supplemental to and becomes a part of the UAW Local 889 Primary Agreement, hereinafter referred to as the “Primary Agreement” for the period commencing the 1st day of October 2024, for bargaining units 86 and 87 as recognized in the Recognition Article of the Primary Agreement. Lunch/Break Periods: • Lunch and break periods shall follow the merit rules as referenced in Article 25, except that an Employee directed by a supervisor to work during their lunch period or any Employee who is knowingly permitted to work during their lunch period by their supervisor shall be entitled to overtime or compensatory time for their lunch period. • The Employee, if requested by their supervisor to work during their lunch period, shall maintain the right to take their lunch break if they do not wish to work through it. • Employees assigned to an outdoor health event during winter months, shall be entitled to one paid 15-minute break for every 2 hours outside. The Employee may utilize a warming shelter or their vehicle during this time to keep warm. Uniform Allowance: • Employees in the following classifications: Public Health Sanitarian, Public Health Sanitarian Senior, Public Health Sanitarian Supervisor, Public Health Sanitarian Technician, Neighborhood & Housing Development Field Technician, Neighborhood & Housing Development Field Technician Senior, Supervisor Neighborhood & Housing Development shall be issued the following gear with an Oakland County logo: 1 pair of insulated winter pants, 1 hooded sweatshirt (pullover or zippered front) or non-hooded pullover sweatshirt, 1 wool cap, 1 pair of insulated winter gloves, 1 Carhartt or equivalent quality winter jacket and 1 high quality raincoat. All items above to be laundered will be the responsibility of the employee and will only be replaced due to damage and supervisor approval. Attire shall be issued once in 2024 or 2025. If gear is provided to the Employee, it is expected to worn when in the field. • Employees in the following classifications: Public Health Sanitarian, Public Health Sanitarian Senior, Public Health Sanitarian Supervisor, Public Health Sanitarian Technician, Neighborhood & Housing Development Field Technician, Neighborhood & Housing Development Field Technician Senior, Supervisor Neighborhood & Housing Development will be reimbursed up to $275 per calendar year for the purchase of their safety/work boot. All employees receiving a boot allowance must have safety boots that meet the ASTM-F2413-18 Standard. For those who do not require safety boots, they will be reimbursed up to $150 for boots/appropriate footwear for their job (i.e. nonslip shoes). Employees provided with the boot/appropriate footwear allowance are required to wear this footwear when working in the field. • Employees in classifications not listed above and mandated to perform work related duties outdoors during winter months shall be provided the following gear which includes an Oakland County logo: 1 Carhartt or equivalent quality winter jacket or high- quality raincoat, insulated snow pants, wool cap, and insulated winter gloves. Jackets, raincoats and snow pants may be shared with other employees and will be laundered between each use. • All Employees assigned to field work at any point in a calendar year shall receive three (3) county-issued short-sleeve shirts, two (2) county-issued long sleeve shirts, and one (1) jacket with an Oakland County logo at the Employer’s expense. Shirts shall be issued once in 2024 or 2025 and once in 2027 to all covered Employees. Classifications already listed in this section will receive (3) county-issued short-sleeve shirts, two (2) county- issued long sleeve shirts. • Employees required to perform laboratory functions or are involved in direct patient care shall be provided with four lab coats every 24 months. Lab coats will be laundered at county expense. • All Medical Technologists, Auxiliary Health Workers assigned to WIC, Nutrition Technicians, and Dental Hygienists shall received scrubs with an Oakland County logo purchased by the Employer worth up to $200 per calendar year. All Health employees will be issued their own reflective vest to wear over their uniform. Laundering of the vest will be the responsibility of the employee. The employer shall maintain a supply of extra vests if needed by an employee. Overtime Canvass and Rotation: • The Overtime Canvass and Rotation Article of the Primary Agreement shall be clarified to acknowledge that Environmental Health Unit Employees with assigned geographical areas shall have first right of refusal for overtime in their assigned areas related to their assigned jobs. Preferred Work Location: • Employees in classifications with positions at both North Oakland Health Center and South Oakland Health Center shall be eligible to transfer office locations when an opening occurs. If more than one Employee in the classification expresses an interest in transferring locations, Employees with the greatest seniority shall be transferred first unless they are subject to an active disciplinary matter. • Field staff shall be permitted to conduct their office work at the North Oakland Health Center or at the South Oakland Health Center, if workspace is available, notwithstanding any remote work policies or agreements. Vaccination, Immunization and Employee Safety: • Employer will make vaccines that are required for employment available to employees at no cost. Influenza vaccines will be offered to all members annually at a Health Division facility. When applicable, allowed and available Health and Human Services Department employees and members of their households will be prioritized to receive COVID-19 vaccinations and other available vaccinations when required to work health events involving testing, vaccination or treatment. The vaccine series shall be provided to the employee and their household members prior to their start of working the health event. When administering vaccines to employees and members of their households, the CDC Immunization Schedule shall be followed. • When permitted, leftover unused doses shall be prioritized to Health and Human Services family members. • Employees will be offered and provided, at no cost, Personal Protective Equipment (PPE) rated at the MIOSHA or CDC recommended standard to perform their job functions. When not available, the next highest rated PPE will be used. Uniform Allowance: • Employees required to wear a uniform will be provided with the following: o Eleven (11) sets of a uniform including 11 shirts, 11 pants, or 11 coveralls, or a combination of 11 shirts and pants and coveralls not to exceed 11 total uniform sets. o Shirts may be short sleeve, long sleeve, or a crewneck sweatshirt, but not to exceed 11 total shirts. § Supervisor shirts are polo or button-up style. § Field staff shirts are t-shirt or button-up style. o These 11 sets of uniforms will be provided and laundered on a weekly basis by a commercial uniform company via contract, the selection of which is subject to determination by management. • Each Employee who performs field work will also receive the following: o One wool cap o One Carhartt (or comparable quality brand) winter bib overalls o One pair of winter gloves o Coat(s): § High-visibility winter coat; and § Carhartt (or comparable quality brand) coat; and § Three-season jacket OR a full zip-up hooded sweatshirt § High-quality raincoat (upon request) • All items, except for boots, can be replaced due to damage, with supervisor approval. Any of these items that are lost will be replaced at the expense of the Employee. Any damage due to wear and tear or sanitary concerns to the item can be replaced by the department with supervisor approval. Orders, excluding uniforms, are placed twice per year and timeliness of receipt of orders is subject to availability. On-call Pay: • The Construction Inspector classification covered by this agreement in the Miss Dig unit may be placed on mandatory on call. The Construction Inspector classification in other units may considered for on call on a voluntary basis. The On-call Pay Article of the Primary Agreement shall be followed for the remaining on-call pay provisions. Alternative Work Schedules: • Employees covered by this agreement on each construction inspection team (Construction Projects, Miss Dig, Soil Erosion, Cross Connection) shall have their own vote for a 4/10 summer schedule, subject to final approval by the Water Resources Commissioner. Vehicle Use: • Employees who are scheduled to be on-call shall have the option of utilizing their county vehicle for travel to/from work each day during the scheduled on-call time frame. The vehicle may not be used for personal (non-county related use) by the employee during this time period.
