INTRODUCTION AND BACKGROUND
The School District of the City of Pontiac is the owner of an 18.96-acre parcel located adjacent to
Pontiac Oaks County Park. This property is the site of the former Hawthorne Elementary School and
is easily accessible by the public at the entrance of the park. In discussions with the leadership of
the School Board it was apparent they were reluctant to sell the property but were open to a long-
term partnership agreement. The Commission approved a proposed 20-year term renewable
agreement that would empower Oakland County Parks to operate and manage the property for
public recreational use as part of Pontiac Oaks County Park at the last meeting. Pontiac Schools
requested several amendments to the terms detailed in this version which were successfully
negotiated with the assistance of Corporation Counsel. The Pontiac School Board unanimously
approved the agreement at their meeting on December 16th.
The agreement remains substantially similar to the terms detailed in our agreement with the City of
Pontiac for the operation of Pontiac Oaks with the exception of the termination clause. This
agreement allows the school district to terminate the agreement during the 20-year period if they
determine the property is needed to meet district’s strategic needs. If this were to occur, OCPR
would be reimbursed for capital investments made at their depreciated value.
On January 8, 2025, the Parks Commission approved the Interlocal Partnership Agreement
between the County Of Oakland and the School District of the City of Pontiac and authorized the
Chairperson to execute the agreement on behalf of the Parks Commission.
POLICY ANALYSIS
The request is to approve an interlocal agreement between the County of Oakland and the School
District of the City of Pontiac. The School District owns 18.96 acres of property northeast of and
adjacent to Hawthorne Park/Pontiac Oaks. The School District and the Oakland County Parks and
Recreation Commission (OCPRC) wish to make this property as an extension of Hawthorne
Park/Pontiac Oaks and have the OCPRC operate, manage, plan for and maintain the property. This
agreement will be effective upon execution and end 20 years from the effective date. The District
may terminate this agreement any time with a 180-day notification to the OCPRC in writing provided
the purposes fall within the scope of the agreement.
