Sheriff’s Office – Oakland County Human Trafficking Task Force Interlocal Agreement with the City of Southfield.
As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed agreement with the County of
Oakland and the City of Southfield, and the authorizing Board of Commissioners Resolution are enclosed for filing by your
office.

INTRODUCTION AND BACKGROUND
The Sheriff’s Office has partnered with the Oakland County Prosecutor’s Office and the Oakland
County Board of Commissioners to create the Oakland County Human Trafficking Task Force. The
mission of the Task Force is to encourage cooperation between law enforcement agencies to
apprehend and convict those involved in human trafficking in Oakland County.
POLICY ANALYSIS
Madison Heights and Southfield are the first agencies that have agreed to join the Human
Trafficking Task Force with the Oakland County Sheriff's Office. It is anticipated that more
municipalities will request to join the Task Force. Once approved, the attached interlocal agreement
will be used for future agencies requesting to join.
Per the attached interlocal agreement, the municipality will be responsible for: (1) The Municipality
may identify one or more of its full-time employees with MCOLES certification and a duty firearm to
participate in the Task Force, subject to OCSO’s approval in OCSO’s sole discretion, (2) The
Municipality will promptly notify OCSO of any personnel action involving a Municipality-employee
Task Force member, including but not limited to, any reprimand, suspension, discharge, resignation,
demotion, complaint, charge, or allegation of misconduct, whether civil or criminal, (3) All
employment-related costs of the Municipality-employee, including, but not limited to, wages, salary,
overtime, benefits, local, state and federal taxes associated with employment, and worker’s
compensation, is the sole responsibility of the Municipality at all times, (4) The Municipality will
provide the Municipality-employee(s) assigned to the task force with standard law enforcement
equipment, including but not limited to, a duty weapon, patrol vehicle, handcuffs, and taser. If the
OCSO provides equipment that would be duplicative with the Municipality-provided equipment, the
Municipality-employee must use the OCSO-provided equipment during Task Force operations.
The Oakland County Sherriff's Office will be responsible for: (1) Specialized task-force related
training, operational control, and oversight of the Task Force, (2) Any specialized equipment and
investigative expenses related to Task Force operations, (3) Deputation of all Task Force members
as set forth in this Agreement, (4) Liability protection for the Task Force members as set forth in this
Agreement, (5) Supplemental OCSO employees and support services (e.g., SWAT, evidence techs,
etc.) to assist with Task Force operations, as determined in OCSO’s sole discretion.

The meeting of the Council convened at 6:00 p.m. in the Council Chambers of the Municipal
Building, 26000 Evergreen Road, Southfield, Michigan, with Council President Michael Ari
Mandelbaum in the Chair.

BE IT RESOLVED: That Council hereby authorizes the Mayor and City Clerk authority to
execute the Agreement for Participation in the Oakland County Human Trafficking Task Force
between Oakland County and the City of Southfield and also the assignment of a Southfield Police
Department Officer to the Oakland County Human Trafficking Task Force subject to review and
approval of the agreement as to form by the City Attorney’s Office.

B. Authorization to Purchase New and Replacement Turnout Gear for the Fire Department

BE IT RESOLVED: That Council does hereby authorize the Fire Department to purchase Lion
V-Force turnout gear through the Sourcewell Cooperative through their respective vendor, namely,
Phoenix Safety Outfitters of Springfield, Ohio with funds to be utilized from the 2024-25 budget
Fire Department Uniform Expendature Accounts (101-339.4005-740.7401 and 101-337.4001-
740.7401) respectively and will be requested in future budgets as Council may approve and
expenditures are not expected to exceed twenty-one (21) sets of turnout gear for the 24/25 fiscal
year or $75,000, or $300,000 for the term of the cooperative contract expiring March 27, 2028,
and this request is being made without competitive bidding in accordance with Chapter 8, Section
1.279(3) of the City’s Code of Ordinances” …by contracting with or through another unit of
government,” namely the Sourcewell Purchasing Cooperative.

C. Purchase and Upfit of Replacement Enclosed Trench Rescue Trailer for Fire
Department

RESOLVED: That Council does hereby authorize the purchase of an enclosed trench rescue
trailer replacement with Payless Trailers of Bay City, Michigan in the amount of $27,615; and
BE IT FURTHER RESOLVED: That Council does hereby authorize Duns Welding of
Southfield to perform custom interior modifications in an amount not to exceed $25,000, per
chapter 8 of the City Ordinance Sec. 1.279. - Exceptions to competitive bidding. Competitive
bidding shall not be required in the following cases: (2) In the employment of professional services.

the amount of $18,160.45 available in the City Attorney’s Magazines, Book, ETC Account No.
101-266.1700-727.7290 with funding for years two & three $19,070.08 and $20,025.28 ,

E. Authorization to Extend the Lead Service Verification & Replacement Contract

RESOLVED: That Council does hereby authorize the Water & Sewer Division to extend the
contract for Lead Service Verification & Replacement with D’Angelo Brothers of Farmington
Hills, Michigan commencing January 1, 2025, through December 31, 2027, in line with the
Oakland County Water Resources Commission and Southeastern Oakland County Water
Authority contracts with the verifications of 1570 addresses expected to be completed in the next
three (3) years for an annual estimated cost of $340,000 per year with funds provided in the 2024-
25 Water & Sewer Contractual/Professional Account No. 592-536.7502-801.8180 and will be
requested in future budgets as Council approves.

F. Approval of Agreement for Beech Road Pathway from Nine Mile Road to Shiawassee
Road (Job No. 2379SFLD) (MDOT Job No. 219051CON; Contract No. 24-5475)

WHEREAS, the Michigan Department of Transportation (MDOT) has presented contract
documents to the City for construction of the Beech Road Pathway from Nine Mile Road to
Shiawassee Road; and
WHEREAS, the total estimated project cost is $1,228,522, with the Federal cost share being
$734,698 and the City of Southfield’s estimated cost share is $493,824, which includes $160,242
for construction engineering with funding for the City’s share shall be provided through a budget

adjustment utilizing Metro Act funds with an increase in Engineering Land Improvements Account
No. 101-447.4505-971.9740 with a corresponding increase in the Use of Restricted Fund Balance
Account No. 101-272.9500-675.6961.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Southfield
does hereby approve the project and authorizes Mayor Kenson J. Siver and City Clerk Janet
Jackson to sign MDOT Contract No. 24-5475 on behalf of the City after review and approval as
to form by the City Attorney’s Office.

G. Approval for Rutland Avenue Reconstruction and Water Main Improvements between
Northwestern Hwy. and 9 Mile Road (2495SFLD)

WHEREAS, on May 6, 2024 Council awarded a contract to Pamar Enterprises, Inc. for the North
Park Drive Reconstruction and Water Main Improvements project in the amount of $3,288,392.24
with a total authorized project cost of $4,110,490.30; and
WHEREAS, the Rutland Avenue Reconstruction and Water Main Improvements project
budgeted in FY 2025 could proceed with favorable unit pricing from the North Park Drive project.
BE IT RESOLVED: That Council does hereby approve a cost increase in the amount of
$2,991,337.84 to the North Park Drive Reconstruction and Water Main Improvements project to
reconstruct Rutland Avenue between Northwestern Hwy. and 9 Mile Road; and
BE IT FURTHER RESOLVED: That the additional funding is available from the FY 2025
Major Street Land Improvements Account No. 202-451.4515-971.9740 - 62%, or $1,854,196.32
and will be reimbursed from the FY24 Michigan Economic Development Corporation Grant
authorized at the City Council meeting of March 4, 2024 with funds for the water construction
costs provided in the Water and Sewer Bond Land Improvements Account No. 592-536.7512-
971.9740 – 38%, or $1,136,442.90
NOW, THEREFORE, BE IT FINALLY RESOLVED: That the Denso Drive Reconstruction
project costs are revised as follows:

H. Annual Adoption of 2025 Poverty Exemption Guidelines under MCL211.7U
2024.366 Motion by Hicks; Support by Houge
RESOLVED: That the Council of the City of Southfield does hereby adopt the attached City of
Southfield’s 2025 Poverty Exemption Policy as the policy and guidelines for use in granting
poverty exemptions, pursuant to PA 390 of 1994 and further amended by PA 620 of 2002, and
State Tax Commission (STC) Bulletin(s) No. 22 of 2023 and No. 17 of 2024, and all future updates
to the Federal Poverty Income Guidelines as approved by the State Tax Commission.
CITY OF SOUTHFIELD
RESOLUTION 2024-
CITY OF SOUTHFIELD 2025 POVERTY TAX EXEMPTION GUIDELINES FOR
PROPERTY TAX RELIEF OF REAL PROPERTY UNDER SECTION 211.7U
WHEREAS, the adoption of guidelines for exemption of real property owned by persons in
financial hardship to claim Poverty Exemption is required by the Southfield City Council for the
City of Southfield; and
WHEREAS, the principal residence of persons, who the Assessor and Board of Review
determines to be unable to contribute to the public charge by reason of hardship, is eligible for
exemption from taxation under MCL 211.7u; and
WHEREAS, pursuant to PA 390 of 1994, the City of Southfield, Oakland County adopts the
following guidelines for the Board of Review to implement. The guidelines shall include but not
be limited to the specific income and asset levels of claimant and all residing in the household;
Section 211.7u (1) of the Michigan General Property Tax Act defines the hardship, or Poverty
Exemption, as a method to provide relief for those who, in the judgment of the Board of Review,
are unable to fully contribute to the annual property tax burden of their principal residence due to
their financial situation. To qualify for the Poverty Exemption, the claimant must meet all the
following requirements. It may be possible that a claimant meets the income standard for the
Poverty Exemption but does not meet the asset standard or other standards as set forth in these
guidelines. In this instance, the claimant may not qualify for the exemption even though the
income standard was met.
The Board of Review shall follow the policies and guidelines adopted by this Honorable Council,
when granting or denying a Poverty Exemption request. The same standards shall apply to all
persons claiming a Poverty Exemption in the City of Southfield, for the current assessment year.
(Section 211.7u (5)). Applicants are not prohibited from appealing the assessed value for their
principal residence that the hardship claim is being made on before the Board of Review in the
same year, as well.

1. Poverty Exemptions shall apply only to the Applicant’s qualified primary residence,
with the applicant receiving a Principal Residence exemption of 1% or greater, and the
property must be classified 401 – Residential-Improved for property tax purposes.
Under no circumstances shall a Poverty Exemption be granted or apply to the property
of a business, partnership, or a corporation.
2. The amount of relief that may be granted due to hardship by the Board of Review shall
not deviate from the amount as determined by the policies and guidelines adopted by
City of Southfield hardship exemption income level calculation report.
To be eligible for the hardship exemption, a person must complete in its entirety a “CITY OF
SOUTHFIELD POVERTY EXEMPTION APPLICATION” (MCL 211.7u). All claims, including
all required information listed below, must be filed with the City Assessor for review of
completeness and eligibility compliance. Applications are to be filed any day after January 1st
and before the day prior to the last day of March, July, or December Board of Review meetings
for the assessment year requested. Incomplete applications and/or applications of taxpayers not
meeting the eligibility requirements will be denied by the Board of Review.
The application includes the guidelines, policies a checklist of documents, and a form 5737,
Application for MCL 211.7u Poverty Exemption, or if they qualify to do so, a form 5739,
Affirmation of Ownership and Occupancy to Remain Exempt by Reason of Poverty. The
application must be submitted, and the following provided on an annual basis:
1. The applicant must own and occupy the property as their principal residence. Principal
residence is defined in MCL 211.7dd(c) as, “the one place where a person has his or her true,
fixed, and permanent home, to which, whenever absent he or she intends to return.”
2. The applicant must provide the federal and state income tax returns for the current and
immediately preceding year, including any property tax credit forms (MI1040-CR) for all
persons residing in the principal residence. Any person(s) residing in the principal residence
that were not required to file a federal or state income tax return, for the current or immediately
preceding year, must instead submit a form 4988, Poverty Exemption Affidavit, swearing and
affirming this to be true.
3. Produce a valid driver’s license or other form of identification.
4. Produce a deed, land contract, or other evidence of ownership for the property.
5. Meet the federal poverty guidelines published in the prior calendar year by the United States
Department of Health and Human Services, or alternative guidelines adopted by the local
assessing unit. The City of Southfield has adopted income guidelines increased by 20% over
the federal poverty guidelines with the ability to add medical expenses. This allows the Board
to better assist those on the threshold to receive much needed assistance. The following chart
outlines the federal and City income guidelines used for granting poverty exemptions on 2025
assessments, as approved by the State Tax Commission and Council:

The Michigan Homestead Property Tax Credit cannot be considered as income for purposes of the
Poverty Exemption. (Ferrero v Walton Twp, Court of Appeals No. 302221)
The applicants must provide copies of the following forms, including all supporting documents
and schedules, for all persons residing in the household, filed in the current or immediately
preceding year:
a. Federal Income Tax Returns (current & prior year) or form 4988, Poverty Exemption
Affidavit. The applicant, and everyone that resides in the principal residence, must
provide this tax return unless they are not required to file a Federal Income Tax Return.
If they do not file a federal return, they must file a form 4988, swearing and affirming
that they are not required to do so.
b. Michigan Tax Returns & MI1040-CR Michigan Homestead Property Tax Credit Claim
or form 4988, Poverty Exemption Affidavit. The applicant, and everyone that resides
in the principal residence, must provide this return unless they are not required to file
a Michigan Income Tax Return. If they do not file a state return, they must file a form
4988, swearing and affirming that they are not required to do so.
c. Social Security Benefit Statement (Form SSA 1099) for all person(s) residing in the
household receiving this benefit.
d. Form 5737, Application for MCL 211.7u Poverty Exemption Application
e. Form 5739, Affirmation of Ownership and Occupancy to Remain Exempt by Reason of
Poverty
f. A valid Michigan driver’s license or other legal form of photo identification. The
identification must indicate the principal residence for the property that hardship is
being claimed on.
g. Deed, land contract, or other evidence of property ownership, if applicable.
h. Mortgage Statement showing balance remaining on the loan.
i. Medical receipts, premium statements, or any other proof of expenses, if applicable.
j. A copy of the most recent bank statement for every bank that the applicant, and
everyone residing in the principal residence, has an account. The preceding six months
of statements can be requested if needed for determination of qualification for
exemption.

k. A copy of the most recent retirement fund, annuity, brokerage account, cash value
insurance policy statement or any other statement of financial assets that may apply to
the applicant, and all other person(s) residing in the principal residence.
l. Any other document that helps determine the applicant’s ability to pay property taxes.
This includes providing proof of all sources of income not included on the other
documents submitted.
The City of Southfield requires all applicants to provide copies of their original tax returns filed
and will not accept summary information reports or reproduced tax returns. Federal and State tax
returns must be signed unless “e-filed” documents are included. The City retains the right and is
authorized to obtain copies of any household occupant’s federal income tax returns from the
Internal Revenue Service or Michigan Income Tax Returns from the Department of Treasury
pursuant to MCL 205.28, and all vehicle or titled asset registration information from the Secretary
of State. Applicants may present all other information deemed necessary to support their claim of
hardship status.
An applicant, and all person(s) residing in the principal residence, must meet the City of
Southfield’s income guidelines as adopted by the City of Southfield, provided they are not less
than the federal guidelines. The City of Southfield’s guidelines add an additional 20% to the
Federal Poverty Guidelines. The Board of Review shall consider income from all sources and
from all occupants of the principal residence to determine whether an applicant qualifies for
Poverty Exemption. The City of Southfield adheres to the United States Census Bureau’s
definition of “income”. According to the United States Census Bureau “income” includes, but is
not limited to:
• Money, wages, salaries before deductions, regular contributions from persons not living in
the residence.
• Net receipts from non-farm or farm self-employment (receipts from a person’s own
business, professional enterprise, or partnership, after business expense deductions).
• Regular payments from social security, railroad retirement, unemployment, worker’s
compensation, veteran’s payments, public assistance, supplemental security income (SSI).
• Alimony, child support, military family allotments.
• Private and governmental retirement and disability pensions, regular insurance, annuity
payments.
• College or university scholarships, grants, fellowships, assistantships.
• Dividends, interest, and net income from rentals, royalties, estates, trusts, gambling or
lottery winnings.
In addition to meeting the income level requirements as noted above, Applicants must also meet
requirements based on asset level, or otherwise stated requirements, such as savings accounts,
checking accounts, certificates of deposit, investments (including collectable items purchased for
their investment value), stocks, bonds, inheritances, life insurance policies, interest
earnings/dividends, retirement funds, and ownership in other real estate property.
1. To be eligible for an exemption based on the asset level, or other standards, the following
requirement must be met:

a. Applicant shall report the total value of savings accounts, checking accounts, and
certificates of deposit, all investments, stocks, bonds, inheritances, life insurance
policies, interest earning/dividends, and retirement funds from all household
members.
b. Applicants shall not own interest in any real estate or leasing other than their
principal residence.
c. The total value of any recreational vehicles or equipment shall not exceed the
amount of the current annual property tax obligation. Recreational vehicles include
snowmobiles, boats, jet skis, camping trailers, travel trailers, motorcycles and
motor homes, off-road vehicles, or anything else which may be considered a
recreational vehicle.
2. The calculation of the yearly property tax penalty for a taxpayer who qualifies for poverty
exemption shall be 100% exemption from tax burden. If a taxpayer and applicant does not
qualify based on the asset level test, they will be denied poverty exemption. A denial of poverty
exemption claim must be done to the Michigan Tax Tribunal, within 35 days from the date of
the denial notice.
3. Since the current law as signed by the Governor established the opportunity for this body to
approve the extension for those individuals on fixed income or disabled for up to the next three
(3) years (2024 – 2026), an applicant that qualifies would be able to have a 3 years extension,
provided each applicant annually files a form 5739, Affirmation of Ownership and Occupancy
to Remain Exempt by Reason of Poverty, attesting to the fact that no changes have occurred in
their financial situation during the past year. For all other applicants, the filing of an application
annually shall continue.
NOW, THEREFORE, BE IT RESOLVED by the Southfield City Council of the City of
Southfield, that the Assessor and the Board of Review shall exclusively follow the above stated
policies, included in the City of Southfield’s 2025 Poverty Exemption Income Eligibility and
Guidelines, when granting or denying a poverty exemption.
