ITEM CATEGORY SPONSORED BY Interlocal Agreement Penny Luebs INTRODUCTION AND BACKGROUND The Sheriff’s Office has partnered with the Oakland County Prosecutor’s Office and the Oakland County Board of Commissioners to create the Oakland County Human Trafficking Task Force. The mission of the Task Force is to encourage cooperation between law enforcement agencies to apprehend and convict those involved in human trafficking in Oakland County. POLICY ANALYSIS Madison Heights and Southfield are the first agencies that have agreed to join the Human Trafficking Task Force with the Oakland County Sheriff's Office. It is anticipated that more municipalities will request to join the Task Force. Once approved, the attached interlocal agreement will be used for future agencies requesting to join. Per the attached interlocal agreement, the municipality will be responsible for: (1) The Municipality may identify one or more of its full-time employees with MCOLES certification and a duty firearm to participate in the Task Force, subject to OCSO’s approval in OCSO’s sole discretion, (2) The Municipality will promptly notify OCSO of any personnel action involving a Municipality-employee Task Force member, including but not limited to, any reprimand, suspension, discharge, resignation, demotion, complaint, charge, or allegation of misconduct, whether civil or criminal, (3) All employment-related costs of the Municipality-employee, including, but not limited to, wages, salary, overtime, benefits, local, state and federal taxes associated with employment, and worker’s compensation, is the sole responsibility of the Municipality at all times, (4) The Municipality will provide the Municipality-employee(s) assigned to the task force with standard law enforcement equipment, including but not limited to, a duty weapon, patrol vehicle, handcuffs, and taser. If the OCSO provides equipment that would be duplicative with the Municipality-provided equipment, the Municipality-employee must use the OCSO-provided equipment during Task Force operations. The Oakland County Sherriff's Office will be responsible for: (1) Specialized task-force related training, operational control, and oversight of the Task Force, (2) Any specialized equipment and investigative expenses related to Task Force operations, (3) Deputation of all Task Force members as set forth in this Agreement, (4) Liability protection for the Task Force members as set forth in this Agreement, (5) Supplemental OCSO employees and support services (e.g., SWAT, evidence techs, etc.) to assist with Task Force operations, as determined in OCSO’s sole discretion. Approval of Agreement for Beech Road Pathway from Nine Mile Road to Shiawassee Road (Job No. 2379SFLD) (MDOT Job No. 219051CON; Contract No. 24-5475) 2024.364 Motion by Hicks; Support by Houge WHEREAS, the Michigan Department of Transportation (MDOT) has presented contract documents to the City for construction of the Beech Road Pathway from Nine Mile Road to Shiawassee Road; and WHEREAS, the total estimated project cost is $1,228,522, with the Federal cost share being $734,698 and the City of Southfield’s estimated cost share is $493,824, which includes $160,242 for construction engineering with funding for the City’s share shall be provided through a budget REGULAR MEETING 4 DECEMBER 16, 2024 adjustment utilizing Metro Act funds with an increase in Engineering Land Improvements Account No. 101-447.4505-971.9740 with a corresponding increase in the Use of Restricted Fund Balance Account No. 101-272.9500-675.6961. Annual Adoption of 2025 Poverty Exemption Guidelines under MCL211.7U 2024.366 Motion by Hicks; Support by Houge RESOLVED: That the Council of the City of Southfield does hereby adopt the attached City of Southfield’s 2025 Poverty Exemption Policy as the policy and guidelines for use in granting poverty exemptions, pursuant to PA 390 of 1994 and further amended by PA 620 of 2002, and State Tax Commission (STC) Bulletin(s) No. 22 of 2023 and No. 17 of 2024, and all future updates to the Federal Poverty Income Guidelines as approved by the State Tax Commission. CITY OF SOUTHFIELD RESOLUTION 2024- CITY OF SOUTHFIELD 2025 POVERTY TAX EXEMPTION GUIDELINES FOR PROPERTY TAX RELIEF OF REAL PROPERTY UNDER SECTION 211.7U WHEREAS, the adoption of guidelines for exemption of real property owned by persons in financial hardship to claim Poverty Exemption is required by the Southfield City Council for the City of Southfield; and WHEREAS, the principal residence of persons, who the Assessor and Board of Review determines to be unable to contribute to the public charge by reason of hardship, is eligible for exemption from taxation under MCL 211.7u; and WHEREAS, pursuant to PA 390 of 1994, the City of Southfield, Oakland County adopts the following guidelines for the Board of Review to implement. The guidelines shall include but not be limited to the specific income and asset levels of claimant and all residing in the household; Section 211.7u (1) of the Michigan General Property Tax Act defines the hardship, or Poverty Exemption, as a method to provide relief for those who, in the judgment of the Board of Review, are unable to fully contribute to the annual property tax burden of their principal residence due to their financial situation. To qualify for the Poverty Exemption, the claimant must meet all the following requirements. It may be possible that a claimant meets the income standard for the Poverty Exemption but does not meet the asset standard or other standards as set forth in these guidelines. In this instance, the claimant may not qualify for the exemption even though the income standard was met. The Board of Review shall follow the policies and guidelines adopted by this Honorable Council, when granting or denying a Poverty Exemption request. The same standards shall apply to all persons claiming a Poverty Exemption in the City of Southfield, for the current assessment year. (Section 211.7u (5)). Applicants are not prohibited from appealing the assessed value for their principal residence that the hardship claim is being made on before the Board of Review in the same year, as well. REGULAR MEETING 6 DECEMBER 16, 2024 1. Poverty Exemptions shall apply only to the Applicant’s qualified primary residence, with the applicant receiving a Principal Residence exemption of 1% or greater, and the property must be classified 401 – Residential-Improved for property tax purposes. Under no circumstances shall a Poverty Exemption be granted or apply to the property of a business, partnership, or a corporation. 2. The amount of relief that may be granted due to hardship by the Board of Review shall not deviate from the amount as determined by the policies and guidelines adopted by City of Southfield hardship exemption income level calculation report. To be eligible for the hardship exemption, a person must complete in its entirety a “CITY OF SOUTHFIELD POVERTY EXEMPTION APPLICATION” (MCL 211.7u). All claims, including all required information listed below, must be filed with the City Assessor for review of completeness and eligibility compliance. Applications are to be filed any day after January 1st and before the day prior to the last day of March, July, or December Board of Review meetings for the assessment year requested. Incomplete applications and/or applications of taxpayers not meeting the eligibility requirements will be denied by the Board of Review. The application includes the guidelines, policies a checklist of documents, and a form 5737, Application for MCL 211.7u Poverty Exemption, or if they qualify to do so, a form 5739, Affirmation of Ownership and Occupancy to Remain Exempt by Reason of Poverty. The application must be submitted, and the following provided on an annual basis: 1. The applicant must own and occupy the property as their principal residence. Principal residence is defined in MCL 211.7dd(c) as, “the one place where a person has his or her true, fixed, and permanent home, to which, whenever absent he or she intends to return.” 2. The applicant must provide the federal and state income tax returns for the current and immediately preceding year, including any property tax credit forms (MI1040-CR) for all persons residing in the principal residence. Any person(s) residing in the principal residence that were not required to file a federal or state income tax return, for the current or immediately preceding year, must instead submit a form 4988, Poverty Exemption Affidavit, swearing and affirming this to be true. 3. Produce a valid driver’s license or other form of identification. 4. Produce a deed, land contract, or other evidence of ownership for the property. 5. Meet the federal poverty guidelines published in the prior calendar year by the United States Department of Health and Human Services, or alternative guidelines adopted by the local assessing unit. The City of Southfield has adopted income guidelines increased by 20% over the federal poverty guidelines with the ability to add medical expenses. This allows the Board to better assist those on the threshold to receive much needed assistance. The Michigan Homestead Property Tax Credit cannot be considered as income for purposes of the Poverty Exemption. (Ferrero v Walton Twp, Court of Appeals No. 302221) The applicants must provide copies of the following forms, including all supporting documents and schedules, for all persons residing in the household, filed in the current or immediately preceding year: a. Federal Income Tax Returns (current & prior year) or form 4988, Poverty Exemption Affidavit. The applicant, and everyone that resides in the principal residence, must provide this tax return unless they are not required to file a Federal Income Tax Return. If they do not file a federal return, they must file a form 4988, swearing and affirming that they are not required to do so. b. Michigan Tax Returns & MI1040-CR Michigan Homestead Property Tax Credit Claim or form 4988, Poverty Exemption Affidavit. The applicant, and everyone that resides in the principal residence, must provide this return unless they are not required to file a Michigan Income Tax Return. If they do not file a state return, they must file a form 4988, swearing and affirming that they are not required to do so. c. In addition to meeting the income level requirements as noted above, Applicants must also meet requirements based on asset level, or otherwise stated requirements, such as savings accounts, checking accounts, certificates of deposit, investments (including collectable items purchased for their investment value), stocks, bonds, inheritances, life insurance policies, interest earnings/dividends, retirement funds, and ownership in other real estate property. 1. The total value of any recreational vehicles or equipment shall not exceed the amount of the current annual property tax obligation. Recreational vehicles include snowmobiles, boats, jet skis, camping trailers, travel trailers, motorcycles and motor homes, off-road vehicles, or anything else which may be considered a recreational vehicle. 2. The calculation of the yearly property tax penalty for a taxpayer who qualifies for poverty exemption shall be 100% exemption from tax burden. If a taxpayer and applicant does not qualify based on the asset level test, they will be denied poverty exemption. A denial of poverty exemption claim must be done to the Michigan Tax Tribunal, within 35 days from the date of the denial notice. 3. Since the current law as signed by the Governor established the opportunity for this body to approve the extension for those individuals on fixed income or disabled for up to the next three (3) years (2024 – 2026), an applicant that qualifies would be able to have a 3 years extension, provided each applicant annually files a form 5739, Affirmation of Ownership and Occupancy to Remain Exempt by Reason of Poverty, attesting to the fact that no changes have occurred in their financial situation during the past year. For all other applicants, the filing of an application annually shall continue.
