ITEM CATEGORY SPONSORED BY Collective Bargaining Agreement Brendan Johnson INTRODUCTION AND BACKGROUND On October 24, 2024, the Oakland County Board of Commissioners adopted M.R. 24079, a Collective Bargaining Agreement with the United Auto Workers (UAW), Local 889, for Fiscal Years 2025, 2026, 2027, and 2028. The County of Oakland and the United Auto Workers, Local 889 (UAW) have negotiated a new Supplemental Agreement for the following: • Thirteen (13) classifications within the Prosecuting Attorney’s Office, impacting approximately sixty (60) employees. • This agreement addresses the following items as well: o Personal Leave o Work Schedules o On-Call Pay o Shift Differential o Overtime o Benefits & Retirement Clarification POLICY ANALYSIS This request is to approve a supplemental agreement to the original UAW agreement approved on October 24, 2024. This supplement adds 13 classifications within the Prosecuting Attorney’s Office, impacting approximately sixty (60) employees. Upon adoption of this resolution and execution of this agreement, these employees would receive the following: • Personal Leave - additional eight (8) hours of Personal Leave • Hybrid and Remote Work - within 30 days of the adoption of this resolution by the Board of Commissioners, employees who enter into a non-hybrid work schedule shall receive an additional five (5) Floating Holidays within 60 days of approval by the Board of Commissioners • Shift Differential - employees assigned to work a Saturday or Sunday by their supervisor would be paid an additional $1.25 per hour. If employees represented by the International Brotherhood of Electrical Workers (IBEW) Local 58 receive an increase in shift premium above this amount, a "me too" clause would be applied to employees covered by this agreement • Alternative Shift Start Time - Non-exempt employees may request an alternate start time subject to approval by the Department Head or Deputy Chief Prosecutor or Chief of Administration • Warrants Division Overtime Canvass and Rotation - Overtime schedules in the Warrants Division shall be filled on a quarterly basis with a quarterly rotation schedule as noted in the agreement • Benefits and Retirement Clarification - Insurance benefits remain unchanged through December 1, 2026. Employees shall select insurance benefits during the 2027 open enrollment. Retirement benefits covered by the Primary Agreement shall be retroactive to May 5, 2026. Supplemental Agreement is supplemental to and becomes a part of the UAW Local 889 Primary Agreement, hereinafter referred to as the “Primary Agreement” for the period commencing the _____ 2026 for the classifications recognized below. Recognition: • All supervisory and non-supervisory employees listed in the Wage and Wage Increment Schedule below. Hybrid and Remote Work • Employees shall make a hybrid work decision, following Section 74.3 of the Primary Agreement, within 30 days of approval by the Board of Commissioners. Employees who enter a non-hybrid schedule shall receive an additional five (5) Floating Holidays within 60 days of approval by the Board of Commissioners. Shift Differential • All employees regularly scheduled or temporarily assigned to work a Saturday or a Sunday by their supervisor will be paid an additional $1.25 per hour. In the event employees represented by the International Brotherhood of Electrical Workers (IBEW) Local 58 receive an increase in shift premium above this amount, a “me too” clause shall apply to employees covered by this agreement. Alternative Shift Start Time • Non-Exempt Employee may request to begin their shift at 7:30 a.m., 8 a.m. or 8:30 a.m. subject to approval by the Department Head or Deputy Chief Prosecutor or Chief of Administration. Requests will be approved or denied based on operational and service requirements in each Division. A special conference shall be held between the Employer (including the Department Head or Deputy Chief Prosecutor) and the Union (including a Unit Chair or Unit Vice-Chair), within six (6) months of approval by the Board of Commissioners, to discuss implementation of this section. Warrants Division Overtime Canvass and Rotation • Article 30 of the Primary Agreement shall be clarified to acknowledge that overtime schedules in the Warrants Division shall be filled on a quarterly basis and the rotation shall change quarterly so that the person at the top of the rotation who selected first during the previous rotation moves to the bottom of the rotation and the person who selected second in the previous rotation selects first in the rotation. Benefits • Insurance benefits (healthcare, dental, optical) shall be unchanged through December 31st, 2026. Employees shall select insurance benefits pursuant to the Primary Agreement during 2027 open enrollment, effective January 1st, 2027. • Retirement benefits covered by the Primary Agreement shall be retroactive to May 5th, 2026. • The Merit Maximum Incentive shall be retroactive to May 5th, 2026. • The Wellness Incentive shall be retroactive to May 5th, 2026. • Shift differential shall be retroactive to May 5th, 2026. • Any and all retroactive benefits contemplated in this Supplemental Agreement are awarded without any precedential effect on any current or future employees.
