ITEM CATEGORY SPONSORED BY Grant Penny Luebs INTRODUCTION AND BACKGROUND Oakland County Emergency Management plans to submit an application request for reimbursement in the amount of $51,653.53 to the state of Michigan Disaster and Emergency Contingency Fund for expenses incurred during the GLWA water main break that was declared a disaster by Governor Whitmer on May 10, 2026. After declaring a state disaster or emergency, the Governor may authorize an expenditure from the DECF to provide state assistance to counties and municipalities when federal assistance is not available. These state disaster assistance grants are often referred to as Section 19 grants, referencing the section of the act creating the grant program. The county or municipality must meet eligibility criteria as outlined in the act to be eligible to apply for state disaster assistance grants under Section 19. Since this is a reimbursement grant, all grantees are required to submit documentation to support all claims of costs incurred before reimbursement is made. Eligible expenditures include, but are not limited to, costs for repairs to damaged facilities such as buildings or road systems, overtime, and related fringe benefits, contracts, shelter supplies, gasoline and fuel for equipment that is used for disasters and supplies. All eligible counties and municipalities wishing to apply for Section 19 grants must submit a completed and signed application form along with all supporting documentation. Applications are due to MSP/EMHSD 20 calendar days from the date of the applicant briefing, which was on July 7, 2026. The due date is July 27, 2026, however, we have been given the additional time to get the resolution approved by the Board of Commissioners on August 13, 2026. Along with the application, it is required there be a board resolution assigning a designated agent. The applicant’s agent is a person who is authorized by the governing body of an applicant to act on behalf of the applicant in applying for disaster assistance under Section 19. The MSP/EMHSD will conduct business with the applicant’s agent and relay any information provided by that person. This resolution will assign Thom Hardesty as that applicant's agent. Other items that must be included are: Oakland County's FY 2025 and FY 2026 operating budgets, the current Emergency Operations Plan signed by MSP/EMHSD, W-9 Form and all backup with proof of payment. POLICY ANALYSIS • No match is required for reimbursement funds. • Funds would come from the State of Michigan's Disaster Contingency Fund (Section 19, Act 390 PA 1976 as amended). These funds are to provide state financial assistance to local governments when a State of Disaster or Emergency is declared, and federal assistance is not available, which requires approval by the Governor. o Per the rules for submitting applications to receive this funding, the application should be accompanied by a grant resolution (which is attached and action under this item would approve). • The County sustained severe losses of major proportions brought on by the 2026 GLWA Water Main Break resulting in the following conditions: (1) extraordinary emergency response activities requiring substantial personnel and operational expenditures, including overtime costs incurred by the Oakland County Sheriff's Office for emergency response, public safety operations, security, and staffing of water distribution sites; (2) overtime costs incurred by Oakland County Emergency Management and the Oakland County Sheriff’s Office for activation and continuous operation of the Oakland County Emergency Operations Center (EOC); (3) overtime costs associated with the establishment, staffing, security, and operation of emergency Points of Distribution (PODs) for potable water by the Oakland County Sheriff's Office, the City of Rochester Hills, Orion Township, Oakland County Facilities Management, and the Oakland County Incident Management Team; (4) together with additional emergency response expenses including fuel for emergency vehicles and equipment, meals provided to emergency response personnel engaged in sustained operations, and (5) other necessary costs directly related to protecting public health and safety and supporting emergency response and recovery efforts arising from the 2026 GLWA Water Main Break. GLWA began work to fix this leak, however, efforts were unsuccessful. Early in the morning of May 10, 2026, the main ruptured, causing a widespread loss of water pressure and the possibility of loss of service for Lake Orion, Orion Township, and a portion of Auburn Hills. Additionally, Rochester Hills was placed under a boil-water advisory. GLWA is now working to repair the main. Officials in Oakland County have fully used local resources to respond to the situation, such as issuing a local emergency declaration, activating the response and recovery aspects of their emergency operations plan, and providing public information. Despite these efforts, local resources have proven insufficient. State assistance and other outside resources are necessary to respond to and recover from the impacts of this emergency, protect public health, safety, and property, and lessen or avert the threat of more severe and lasting harm. While the current balance of the Disaster and Emergency Contingency Fund is inadequate to address this and the other recent disasters that have occurred in this State over the last months, the Legislature can make additional funding available so that communities throughout the state can recover from these emergencies. Section 1 of article 5 of the Michigan Constitution of 1963 vests the executive power of the State of Michigan in the governor. Under the Emergency Management Act, 1976 PA 390, as amended, MCL 30.403(4), “[t]he governor shall, by executive order or proclamation, declare a state of emergency if he or she finds that an emergency has occurred or that the threat of an emergency exists.” Therefore, acting under the Michigan Constitution of 1963 and Michigan law, including the Emergency Management Act, 1976 PA 390, as amended, MCL 30.401 to 30.421, I order the following: 1. A state of emergency is declared for Oakland County. 2 2. The Emergency Management and Homeland Security Division of the Department of State Police must coordinate and maximize state efforts and may call upon all state departments to assist in the designated areas consistent with the Michigan Emergency Management Plan. 3. The state of emergency is terminated when the threats to public health, safety, and property caused by the emergency no longer exist, and appropriate programs have been implemented to recover from the effects of this emergency, but in no case later than June 7, 2026, unless extended as provided by the Emergency Management Act. Date: May 10, 2026 1:53 p.m. STATE DISASTER CONTINGENCY FUND GRANT BE IT RESOLVED BY the Board of Commissioners OF Oakland County, Michigan, WHEREAS, Oakland County, Michigan, is a political subdivision within the State of Michigan with an official Emergency Operations plan in compliance with Section 19 of the Emergency Management Act, Act 390, Public Acts of 1976, as amended. WHEREAS, as a direct result of the disaster, public damage and expenditures were extraordinary and placed an unreasonably great financial burden on Oakland County, Michigan totaling $51,653.53. NOW, THEREFORE BE IT RESOLVED THAT the Board of Commissioners requests the Governor authorize a grant to Oakland County, Michigan from the State Disaster Contingency Fund pursuant to Section 1 9, Act 390, Public Acts of 1976, as amended. FURTHERMORE, Thom Hardesty is authorized to execute for and on behalf of Oakland County, Michigan the application for financial assistance and to provide to the State any information required for that purpose.
