CHARTER TOWNSHIP OF ORION
6The whole number of votes given for and against the
Charter Township of Orion Police Operating Millage
Shall the previously voted increase in the tax limitations imposed under Article IX, Section 6 of the
Michigan Constitution in the Charter Township of Orion, of 3.50 mills ($3.50 per $1,000 of taxable
value), which, at the time of expiration in December 2025, had been reduced to 3.41 mills ($3.41
per $1,000 of taxable value) by the required millage rollbacks, be renewed at 3.41 mills and
increased by 0.34 mills, for a total levy of 3.75 mills ($3.75 per $1,000 of taxable value), and levied
for a period of four (4) years, starting December 2026 and expiring December 2029, inclusive, for
the purpose of providing police services, including all related operating and capital expenditures?
If approved and levied in full, this millage would raise an estimated $9,825,721 in the first year of
levy. By operation of Michigan law, a portion of the millage revenue may be captured and disbursed
to the following local units of government authorized to receive tax increment revenues: the Orion
Township Corridor Improvement Authority and the Oakland County Brownfield Redevelopment
Authority.

STATEMENT OF VOTES
CHARTER TOWNSHIP OF ORION
The whole number of votes given for and against the
Charter Township of Orion
Fire and Emergency Medical Services Operating Millage
Shall the Charter Township of Orion be authorized to levy a new additional millage of up to 3.85
mills on all taxable property within the Township and Village of Lake Orion for a period of four (4)
years, starting December 2026 and expiring December 2029, inclusive, for the purpose of funding
fire protection and emergency medical services (EMS), including Advanced Life Support, and all
related operations, wages, benefits, and capital expenditures?
Approval of this proposal would allow a tax limitation increase and approximate levy of $3.85 per
$1,000 of taxable value on all taxable property within the Township and Village of Lake Orion. For
example, a property with a taxable value of $100,000 would be taxed up to $385.00 annually for the
millage. It is estimated that this proposal would result in the authorization to collect approximately
$10,905,061 in the first year if approved and levied. By operation of Michigan law, a portion of the
millage revenue may be captured and disbursed to the following local units of government
authorized to receive tax increment revenues: the Village of Lake Orion Downtown Development
Authority, the Orion Township Corridor Improvement Authority, and the Oakland County Brownfield
Redevelopment Authority

STIPULATION FOR ENTRY OF CONSENT JUDGMENT
Plaintiff Charter Township of Orion (the "Township") and Defendant Oakland County Board of
Canvassers (the "Board of Canvassers"), by their respective counsel and pursuant to MCR 2.507(G),
stipulate to the entry of the attached Consent Judgment and Final Order and state as follows:
1. The Township commenced this action concerning the geographic scope and authorized
electorate of the Charter Township of Orion Police Operating Millage proposal submitted for the August
4, 2026 election (the "Police Millage Proposal").
2. The parties agree that the Police Millage Proposal applies only to taxable property within the
Township located outside the Village of Lake Orion.
3. The parties agree that the Police Millage Proposal does not authorize the levy, assessment,
spreading, billing, or collection of the Police Operating Millage against taxable property located within
the Village of Lake Orion. The Township shall not levy or collect any tax under the Police Millage
Proposal against taxable property located within the Village.
4. The parties further agree that votes cast by electors registered within the Village of Lake Orion
shall not be counted or included when canvassing, determining, or certifying the result of the Police
Millage Proposal, and that the result shall be determined solely from votes cast by electors registered
within the Township outside of the Village.
5. Because MCL 168.861a requires relief controlling the action of a County Board of Canvassers
to proceed only by mandamus, the parties consent to entry of a writ of mandamus implementing the
agreed upon canvassing and certification procedures set forth in the attached Consent Judgment and
Final Order. Pursuant to MCR 3.305(G), the writ may be contained in the judgment and no separate writ
is required.
6. The attached Consent Judgment and Final Order may be entered immediately, without further
notice, briefing, or hearing, except as the Court may otherwise require.
7. Each party shall bear its own costs and attorney fees. Entry of the attached Consent Judgment
and Final Order resolves all claims in this action and closes the case.
8. Each undersigned attorney represents that the attorney is authorized to execute this Stipulation
on behalf of the attorney's client and to consent to entry of the attached Consent Judgment and Final
Order.

CONSENT JUDGMENT AND FINAL ORDER GRANTING WRIT OF MANDAMUS
At a session of said Court held in the Oakland County Circuit Court,
Pontiac, Michigan, on July 23 , 2026.
PRESENT: HON. Nanci J. Grant
This matter having come before the Court upon the parties' Stipulation for Entry of Consent
Judgment; the Court having reviewed the Complaint, the parties' Stipulation, and the record; the parties
having consented to the relief stated below; and the Court being otherwise fully advised:
IT IS HEREBY ORDERED AND ADJUDGED:
The Court has jurisdiction over this action and the parties. To the extent this Judgment
directs or controls the canvassing and certification duties of the Oakland County Board of Canvassers,
relief is granted through mandamus as required by MCL 168.861a and MCR 3.305. Pursuant to MCR
3.305(G), the writ is contained in this Judgment and no separate writ is required.
2. The Charter Township of Orion Police Operating Millage proposal submitted for the August
4, 2026, election (the "Police Millage Proposal") does not apply to taxable property within the Village
and applies only to taxable property within the Charter Township of Orion ("Orion") located outside the
Village of Lake Orion ("Village")
3. The electorate authorized to determine the Police Millage Proposal consists solely of electors
registered within the Charter Township of Orion who reside outside the Village of Lake Orion. Votes
cast by electors registered within the Village shall not be counted, canvassed nor otherwise used to
determine the outcome of whether the Police Millage Proposal passed or failed.
4. A WRIT OF MANDAMUS IS ISSUED directing the Oakland County Board of Canvassers
and all representatives operating under its supervision, with respect to the Orion Township Police
Millage Proposal submitted for the August 4, 2026, election, to:
a. exclude all votes cast by Village electors from the canvass, determination, and certification
of the result of the Orion Township Police Millage Proposal; and
b. canvass, determine, declare, and certify the result of the Orion Township Police Millage
Proposal solely from votes cast by electors registered within the Charter Township of Orion and
excluding votes cast by electors registered in the Village of Lake Orion.
5. Plaintiff Charter Township of Orion, including its officers, employees, agents, and
representatives, shall not levy, assess, spread, bill, or collect any tax under the Police Millage Proposal
against taxable property located within the Village of Lake Orion.
6. Nothing in this Consent Judgment invalidates, excludes, alters, or otherwise affects any vote
cast by a Village elector for any candidate, office, or ballot question other than the Orion Township
Police Millage Proposal. Nothing in this Consent Judgment authorizes the destruction or alteration of
any ballot or election record.
7. The parties shall bear their own costs and attorney fees.
8. This Consent Judgment and Final Order resolves all claims and is a final order that closes the
case.
