The Supervisor opened the meeting at 7:40 pm with an invocation by Trustee, Ed Brakefield followed by the Pledge of Allegiance. ROLL CALL: MEMBERS PRESENT: Supervisor, Robert Koski; Clerk, Pauline Bennett; Treasurer, Daniel Alberty; Trustees: John Sutphin, Edward Brakefield, Claudia VonDrak and Christine Sypitkowski MEMBERS ABSENT: None ALSO PRESENT: Robert Davis, Legal Counsel ANNOUNCEMENTS: None PETITIONS: None DEPARTMENT REPORTS: Department reports are available at the Township offices. AGENDA: Clerk Bennett would like to add item 5d - sell Fire Department vehicle. MOTION by Clerk Bennett; supported by Trustee Sypitkowski to approve the agenda as amended. Ayes 7 Nays 0 Motion Carried. ORDER OF BUSINESS: 1. CONSENT AGENDA a. Minutes: Regular and Special - September 15,2008 b. Bills as paid for September, 2008. c. Fire Department hours of work / Employee Manual amendment MOTION by Trustee Brakefield; supported by Clerk Bennett to approve the Consent Agenda with minutes as amended. Board of Trustees Ayes October 20,2008 2 7 Nays v 0 rl Motion carried. 2. AUTHORIZE REPAIR 1 BID TOWNSHIP COMPLEX PARKING LOT Supervisor Koski received three bids for the repair of two man holes in the parking lot. K M International - $2,800.00 Anson Rowley - $3,200.00 each Alumna - $3,600.00 MOTION by Trustee Brakefield; supported by Supervisor Koski to approve bid from K M for $2,800, to be completed by October 21", weather permitting. On a roll call vote: Ayes 7 Nays 0 Motion carried. 3. AMERISCAN: PROJECT ADJUSTMENT EXPENDITURE OF $2,534.80 - ACCOUNT 10 1-1 03- 959-000 Clerk Bennett said the original estimate is $255.70 short. MOTION by Trustee Sypitkowski; supported by Trustee Brakefield to approve $2.534.80 from same account as before. On a roll call vote: Ayes 7 Nays 0 Motion Carried. 4. BIDS: LIBRARY DOORS WITH CDBG FUNDING Supervisor Koski said only one bid was received, we have authorized $9,886.00 in CDBG funds for the Library. Bid from Detroit Door for Door 0 Matic is $9,200.00 or for Horton $7,100.00. MOTION by Trustee Brakefield; supported by Supervisor Koski to approve bid not to exceed $10,400.00 for purchase and allow Administration to determine best door for price from Community Projects. On a roll call vote: Ayes 7 Nays 0 Motion Carried. 5. FIRE DEPARTMENT BIDS: ACCOUNT 204-304-974-000 Board of Trustees October 20,2008 Clerk Bennett said the Fire Board has approved the purchases. 5i a. LDH Equipment Package Supervisor Koski asked if it was in the budget - Chief Spencer said yes. MOTION by Clerk Bennett; supported by Trustee Brakefield to a approve bid (from Time Emergency Equipment) for $6,462.00 from Capital account 204-304-974-000. On a roll call vote: Ayes 7 Nays 0 Motion Carried. b. Saw Packages Chief Spencer said this is for rescue saws - ventilation saws and cut off saws. Apollo only bidder for specs of "Cutters Edge" currently carried on engines. MOTION by Clerk Bennett; supported by Trustee Sutphin to approve bid of $1,970 (ventilations saw) and $1,502 (cut of saw) from Apollo. On a roll call vote: Ayes 7 Motion Carried. Nays 0 c. Pagers Chief Spencer this is included in budget to replace 12 - 20 year old pagers. MOTION by Trustee Brakefield; supported by Clerk Bennett to approve purchase of 20 pages for $43 1 .OO each from Advanced Wireless, account 204-304-974-000, with understanding Chief verify shipping charges. On a roll call vote: Ayes 7 Nays 0 Motion Carried. d. Vehicle 93 1 / Old Rescue 1 Chief Spencer is requesting the Boards permission to bid out to sell - advertise up to one dozen companies, the official paper and state publication. MOTION by Clerk Bennett; supported by Supervisor Koski to allow Chief to advertise for up to 8 weeks. On a roll call vote: Ayes 7 Nays 0 Board of Trustees Motion Carried. October 20,2008 6. PARK COMMITTEE: REQUEST TO AMEND BY-LAWS Supervisor Koski said they want to limit the number of Rangers to 14 and include Ranger Criteria. MOTION by Trustee Brakefield; supported by Clerk Bennett to approve amendment to Park By-Laws to reflect not to exceed 14 (Rangers) in number. Ayes 7 Nays 0 Motion Carried. 7. LAW ENFORCEMENT SERVICES AGREEMENT Supervisor Koski said it's a 3% increase - most in transportation cost and some in hospitalization. Proposal is for one year. MOTION by Clerk Bennett; supported by Trustee Brakefield to approve Law Agreement as presented. On a roll call vote: Ayes 7 Nays 0 Motion Carried. SUPERVISOR'S REPORT Supervisor Koski said the Road Commission gravel program is $21,000. Plans are to resurface from Predmore to Lakeville and Lakeville to Mack. Plans call for removing oak trees by riding stable - getting a petition to save the trees. Don Green from Milford will take over his seat on the Task Force Committee and look out for the Township. Lake George Grant - should hear by January 6' if we get grant. No response on proposal to PAT. CRWC - $500 for dues and $1,000 for educational programs - feels we should pay the $500 to remain in program. TRUSTEE REPORTS Treasurer Alberty attended a Semcog meeting on taxable values and SEV's. Dues run $1350 a year from date you join. This is their 4oth anniversary and they are offering a discount. Trustee Brakefield has purchased two wind turbines. He invited anyone who would like to come see them to come - towers go up around November 1 1". Supervisor Koski has talked to Robert Bunting about changing ordinance to accommodate wind towers. Board of Trustees October 20,2008 5 Trustee Brakefield said the State has an ordinance that he had to follow and the Building and Electrical A inspectors a~;e very knowledgeable. LEGAL COUNSEL REPORT None COMMUNICATIONS None PUBLIC FORUM: Chief Spencer invited everyone to the Halloween Party on October 3 1" at 7:00 in old station. Recording Secretary L2'& Pauline B Clerk ADDISON TOWNSHIP BOARD OF TRUSTEES Special Meeting October 20,2008 The special meeting of the Addison Township Board of Trustees was held on Monday, October 20,2008 at 6:30 pm in the Township Complex. The Supervisor opened the meeting at 6:35 pm. He said the purpose of the meeting was to consider entering closed session for considering potential litigation, pending and active litigation, and to review legal strategy, attorney client privilege or work product or written attorney opinion letter regarding the following: a. Township of Addison vs. Jerry Klein Barnhart - Case No. 06-008457-A2 Court of Appeals No. 272942 b. Hidden Lakes Consent Compliance c. Murray vs. Township of Addison 03-050732-CH Consent Judgment Dr. Murray said no one tells him what the Board wants because it happens in closed session. Trustee VonDrak asked if he met with someone from Township. Clerk Bennett said she doesn't disclose what happens at meetings but he did meet with Robert Davis. Robert Davis said he will present what was discussed at meeting tonight - advised Board of that meeting. Clerk Bennett said he wanted to know if he could divide in five acres and that's a Board decision. Robert Davis said he could only get 15 under land division, presenting Dr. Murray's plan tonight. Dr. Murray on the draft from Township -he doesn't know how Township came up with 65 acres. Trying to retain natural aspects - really hard to communicate. Trustee Sypitkowski said we have a Consent Judgment. Dr. Murray said he's allowed 1 1 divisions and other 10 lots as one and 10 years before allowed more divisions. Area to north conservation easement with restrictions used before - can't remove trees - same objective as Piny Hill. Right now, no sales in Addison Township. Thinks there's a need for Board of Trustees October 20,2008 Special 2 people that want to grow own crops with small energy efficient homes. Inexpensive land divisions rZi along Lake George. MOTION by Treasurer Alberty; supported by Trustee Sypitkowski to consider entering closed session for considering potential litigation, pending and active litigation, and to review legal strategy, attorney client privilege or work product or written attorney opinion letter regarding the following: a. Closed Session Open Session MOTION by Clerk Bennett; supported by Trustee Brakefield to authorize the attorney to amend Consent Judgment to adopt plan dated October 10,2008 with all other terms of the Consent Judgment remaining in place. Subject to: Suburban Farms zoning review and road approval with all fees paid by applicant. On a roll call vote: Ayes 7 Motion carried.
