Reports: Holly Township Board of Trustees – Minutes of June 15, 2011 Page 2 of 9 Trustee Janet Leslie reported the Holly area will host the 2011 Michigan Patriot Week Festival that will run September 11th through September 17th, including the 18th, which is a Sunday. Most activities will take place in downtown Holly. There will be a memorial event on September 11th at the Great Lakes National Cemetery. Because there are so many historic graves at the township cemetery, an event there would be a good thing to add in. Ideas are welcome. September 17th there is an MIA/POW event at the Great Lakes National Cemetery. Clerk Karin Winchester – No report. Treasurer Mark Freeman reported the 2010 tax year files are being wrapped up and the township is ramping up for the year 2011. 2010 tax bills will be printed next week. Supervisor Jesse Lambert reported he attended the groundbreaking for the new Holly Academy renovation/construction project. An auxiliary gymnasium will be added, a library, offices and a few classrooms. Today was also the Academy’s last day of school. There was a large ceremony. The Academy received an accreditation as a school of excellence from Central Michigan University. The board packets include the revenue sharing consensus report that came out May 30th, although the state hasn’t approved it yet. Public Comment: Mr. John Weber, 13222 Fagan Road, commented he is concerned about the motocross track that has developed in Scott Farms off from Nelson Scott Road. It is about 300 feet from their deck and they like to enjoy their backyard. It has gotten out of hand noise-wise, a lot of dust, multiple motocross bikes. They have used a dozer and made it a professional setup. Today he has not heard them but since Friday they ran every day. Last night they ran until about 8:00 p.m. Sunday they ran from about noon. It’s basically a club. Mr. Rob Hof, 13445 Millie Court, commented he is in the Nelson Scott Farms development. This appears to not just be your recreational motorcycle user; this is like a club with high- powered machines that are very loud. As you can see by the pictures he has provided, there is no soil or silt fence constructed. A couple guys with a bulldozer and a dump truck started carving up the lot. There have been riders out there ever since. They spoke with the owner of the property who indicated what they were doing was okay. Clerk Winchester indicated she sent the owner a letter informing them they are in violation of the zoning ordinance when they were just beginning to construct the track. She let them know they didn’t pull a soil erosion permit, as well. It has been turned over to code enforcement. Mr. Hof stated it has been dry the last few days and yesterday there were large dust clouds drifting over to the outer lots that were for sale. He notified the owner of the lots and has been asked to report back. Trustee Leslie questioned when construction of the track began. Holly Township Board of Trustees – Minutes of June 15, 2011 Page 3 of 9 Clerk Winchester stated she believes the original letter was dated in April. Trustee Leslie questioned whether there was a residence on the property. Treasurer Freeman stated the property is vacant. Ms. Sandra Kennaday, 13246 Fagan Road, commented she can hear the noise and see the dust clouds. She’s concerned about the dust pollution due to her asthma. She is hoping the township has ordinances that will not allow this kind of business to move into residential neighborhoods. This will also lower property values. Mr. Hof stated he has small children. With this club, you don’t know what kind of people are there. Treasurer Freeman indicated the owners have posted the property with no trespassing signs but people riding by on motorcycles have seen the track and use it. There is no way of knowing whether the property owner is there or not to supervise. A question of liability arises. Mr. Larry Lilly, 110 Clarence Street, commented it’s always enjoyable to come to a township meeting. The township is still serving and working for the 12,000 residents. He received a letter from the Holly Village attorney, who he’s seen a few times and asked him questions face to face. Mr. Lilly received a letter from the attorney and his wife, who is very loving and caring, opened the letter. We always work for the whole Holly community; spiritually and physically. You do a lot of praying for the whole community. The letter was a shock. Now when he goes to Holly Village Council meetings he has to take an attorney with him and his attorney has to speak for him. He’s never hired an attorney. The township does a fabulous job. You had public comment tonight, let people speak and you’ll follow up and that’s the way it should be. Mr. Roger Welsh spoke at the Village Council meeting last night. Mr. Welsh brought them all the facts, statements Mr. Lilly has been making for 12 years. Mr. Welsh wanted an investigation to find out where the $18 million water and sewer debt went. Keep up the good work and serve the 12,000 residents. It’s a relief to come here. The verbatim minutes are unbelievable. Old Business: 1. Shared Services Supervisor Lambert indicated some e-mails have been making their rounds about the Northwest Oakland County Collaborative Task Force. A few members will not be able to make the meeting next Thursday but it will be at Groveland Township. There have been no new developments. Ever since Mr. Walker has taken over as manager, everyone has been communicating outside of the meetings, as well. That has been a benefit. 2. Appointment of ZBA Member – Term 01-01-11 to 12-31-13 Holly Township Board of Trustees – Minutes of June 15, 2011 Page 4 of 9 Supervisor Lambert stated the last remaining ZBA seat remains open. If anyone in the township is interested in serving the local government, call the supervisor’s office. 3. Groveland MSP Post Supervisor Lambert indicated the board packets contain an initial letter from Supervisor DePalma and a memo from Supervisor Lambert, as well as a proposed agreement between governments to support Groveland in the utility costs for the Michigan State Police Post on Dixie Highway. The post serves Rose, Holly and Groveland Townships. Rose Township has an agreement with Groveland Township already. Clerk Winchester indicated the title read Inter-Local Agreement and should read Inter- Governmental Agreement. Treasurer Freeman noted there should be a clause that says this contract terminates if the space is no longer occupied by the Michigan State Police. It could read, “and be continued monthly until January of 2016 or in the event the Michigan State Police vacate the premises prior to January 2016.”  Trustee Janet Leslie moved to approve the agreement regarding the Groveland MSP Post, as amended. Village Fireworks  Clerk Karin Winchester moved to approve donating $500.00 to the Village of Holly for the Independence Day Celebration for 2011. Trustee Janet Leslie supported the motion. Lambert: Yes; Freeman: Yes; Leslie: Yes; Winchester: Yes. The motion carried with a 4/0 vote. 5. 2011-2012 N.O.C.F.A. Budget – Proposed Resolution 2011-15 Supervisor Lambert indicated two different budgets were released last month and the board needed clarification whether they had the most updated version. The most updated version is in the board packet. A member from the fire department attended last month’s meeting and took questions from the board so there is not a member from the fire department here tonight. There are two members of the N.O.C.F.A. Board on the township board if other board members have questions this evening. Board was aware of the increase in the cost of health care for full-time employees. Trustee Leslie indicated the increase in health care occurred when the chief got married.  Clerk Karin Winchester moved to approve Resolution 2011-15, 2011-2012 N.O.C.F.A. Budget. Treasurer Mark Freeman supported the motion. A roll call vote was taken. Winchester: Yes; Lambert: Yes; Leslie: Yes; Freeman: Yes. The motion carried with a 4/0 vote. 6. 2011-2012 Budget – Proposed Resolution 2011-17 Supervisor Lambert noted the public hearing regarding the Township’s budget occurred in May.  Supervisor Jesse Lambert moved to approve Resolution 2011-17, Holly Township 2011-2012 General Appropriations Act and Budget. Treasurer Mark Freeman supported the motion. A roll call vote was taken. Leslie: Yes; Freeman: Yes; Lambert: Yes; Winchester: Yes. The motion carried with a 4/0 vote. New Business: 1. Noxious Weeds Services Proposals Clerk Winchester indicated that Ace Outdoor Services performed the services last year and they did a very good job and in a very prompt manner. Supervisor Lambert agreed and stated Roger Welsh, the code enforcer, also vouched for Ace. There is also a bid from Windsong Meadows Construction out of Keego Harbor. Some items are bid higher than Ace and only one item was $5.00 lower.  Clerk Karin Winchester moved to approve the service agreement with Ace Outdoor Services. Trustee Janet Leslie supported the motion. A voice vote was taken; all those present voted yes; the motion carried with a 4/0 vote. 2. 2011-2013 IT Services Contract Clerk Winchester indicated this is a contract renewal done every few years, as well as the other contract approvals on the agenda tonight. The motion carried with a 4/0 vote. 3. 2011-2013 Building Inspector Contract  Treasurer Mark Freeman moved to approve 2011-2013 Building Inspector Contract. Clerk Karin Winchester supported the motion. A voice vote was taken; all those present voted yes; the motion carried with a 4/0 vote. 4. 2011-2013 Electrical Inspector Contract  Supervisor Jesse Lambert moved to approve 2011-2013 Electrical Inspector Contract. Treasurer Mark Freeman supported the motion. A voice vote was taken; all those presented voted yes; the motion carried with a 4/0 vote. 5. 2011-2013 Mechanical Inspector Contract  Treasurer Mark Freeman moved to approve 2011-2013 Mechanical Inspector Contract. Clerk Karin Winchester supported the motion. A voice vote was taken; all those presented voted yes; the motion carried with a 4/0 vote. 6. 2011-2013 Plumbing Inspector Contract  Clerk Karin Winchester moved to approve 2011-2013 Plumbing Inspector Contract. A voice vote was taken; all those presented voted yes; the motion carried with a 4/0 vote. 7. 2011-2013 Construction Zoning Compliance Contract  Treasurer Mark Freeman moved to approve 2011-2013 Construction Zoning Compliance Contract. A voice vote was taken; all those presented voted yes; the motion carried with a 4/0 vote. 8. 2011-2013 Equalization Division Assessing Services Treasurer Freeman noted this could be done cheaper in-house. It has been discussed earlier and the majority of the board felt it would be in the Township’s best interest to contract with Oakland County. Trustee Janet Leslie supported the motion. A voice vote was taken; all those present voted yes; the motion carried with a 4/0 vote. 9. 2011-2012 Confirm Special Assessment Roll for Fire and Emergency Services – Proposed Resolution 2011-18 Clerk Winchester noted every year the Township has to do a resolution after the budget hearing confirming the assessment roll so it can go on the tax roll.  Clerk Karin Winchester moved to approve Resolution 2011-18. Trustee Janet Leslie supported the motion. A roll call vote was taken. Freeman: Yes; Leslie: Yes; Lambert: Yes; Winchester: Yes. The motion carried with a 4/0 vote. 10. 2011-2013 Parks Budget Amendments Proposed Resolution 2011-19  Supervisor Jesse Lambert moved to approve Resolution 2011-19, as amended. Clerk Karin Winchester supported the motion. A roll call vote was taken. Winchester: Yes; Leslie: Yes; Freeman: Yes; Lambert: Yes. The motion carried with a 4/0 vote. 11. Street Lighting Agreement – Golfview at Woodfield Condominium Association – Proposed Resolution 2011-20 Clerk Winchester stated Riviera Shores and Woodland Meadows have street lighting agreements with Holly Township. Consumers will only do street lights for those areas if it’s directly contracted through the municipality. The road at Dixie and McClelland is extremely dark and the home owners felt there was a safety issue. In order for them to get the light, agreements needed to be done with Consumers and also the home owners associations. The home owners associations pay into an escrow account with the Township, who pays Consumers out of the escrow account for the street light.  Clerk Karin Winchester moved to approve Resolution 2011-20 and the agreement for Consumers. Trustee Janet Leslie supported the motion. A voice vote was taken; all those present voted yes; the motion carried with a 4/0 vote. 12. 2012-2014 CDBG Cooperative Agreement – Proposed Resolution 2011-21 Holly Township Board of Trustees – Minutes of June 15, 2011 Page 8 of 9 Supervisor Lambert indicated he received a letter from Oakland County regarding the Township’s participation in CDBG. Every three years Oakland County redoes it and this is the third year. Oakland County would like to make sure the Township is not going to opt out of it.  Clerk Karin Winchester moved to approve Resolution 2011-21, as amended. Trustee Janet Leslie supported the motion. A roll call vote was taken. Winchester: Yes; Freeman: Yes; Leslie: Yes; Lambert: Yes. The motion carried with a 4/0 vote. 13. OCRC – Road Signage – No action taken. 14. Township Hall Roof Clerk Winchester indicated the board needs to approve the color of the roof. Thunderstorm Gray has been discussed. Grandville Construction has suggested the Township also repair the chimney. Just the top part of the chimney is deteriorating due to antennas being hooked up and the wind moving them.  Clerk Karin Winchester moved to approve the proposed work order for the masonry work on the chimney for $580.00 and to approve the color of the shingle as Thunderstorm Gray. Supervisor Jesse Lambert supported the motion. A roll call vote was taken. Leslie: Yes; Lambert: Yes; Freeman: Yes; Winchester: Yes. The motion carried with a 4/0 vote. 15. TIA Membership – No action taken. 16. Township Website Supervisor Lambert stated Clerk Winchester has updated the Township’s website. She did a great job. Residents have commented it looks good and functions well. Public Comment: Ms. Kennaday questioned whether the Township will have something for hazardous waste on Township Clean-up Day. Supervisor Lambert stated there is a charge for tires because those have to be melted down or shredded. Small amounts of paint are taken in, which are set out that day to try. Car batteries, solvents, oil based paints and things like that are not taken during clean-up day. Mr. Jason Hughes noted boats are taken also. Holly Township Board of Trustees – Minutes of June 15, 2011 Page 9 of 9 Mr. Lilly indicated he was bragging about the Township and trustees last night. They do a great job, they serve and work for the 12,000 residents. The 6,000 residents in the village want that. The Village has a seven-member council that has absolute control over the 6,000 residents. Their attorney has been there 22 years and supports their charter. The Township’s attorney, Greg Need, should take the job as the Village attorney. We could unite the whole Holly community and go into the 21st Century 100 percent together and working together. Going into a general law village doesn’t change the utilities, only the general law. The 6,000 residents would have control and work together with the 12,000 residents of the township. The $18 million in water and sewer debt affects us all. Grants could be gotten to pay some of the money if we work together. Governor Snyder is giving incentives for cooperation. We could be the number one community in the state of Michigan if we accomplished this. The township does such a fantastic job. Keep it up.
