WEDNESDAY, FEBRUARY 8, 2012

President Magee called the meeting to order at 7:00 p.m.

Administrator Miller stated both Mr. Stack and Ms. Champagne had informed the Village
they were out of town and would be unable to attend tonight’s meeting.

tonight’s meeting.

Sienkiewicz stated at the last Council meeting he brought up that two people were again
missing from Council. He was willing to excuse one absence but not again. He is
concerned that Council has a terrible attendance record and already this year we have been
two short for three meetings and three meeting before that, we were one short. He does
not understand because when you take the oath for this position, you know that Council is
the second Wednesday of every month. Vacation and work schedules should be worked
around this. Seven people are supposed to make decisions for this community. Tonight
we have something very important to decide on and all Council members should be here.
Especially in an election year and for something that is so controversial.
Magee stated he is also getting tired of having a less than full Council. Champagne had
some special circumstances, which she notified us of in advance. We agreed to excuse her
and she offered her resignation if we asked for it. He feels there were special
circumstances involved. Sienkiewicz stated if we excuse that many absences, it puts a
hardship on the rest of Council and leaves us short when making important decisions.

Pat Nagy, 2086 Glen Cove, stated he would like to have the opportunity to speak when
Council gets to item 13) H) and L) as he is on the Water Management Board.
Dave Renwick, 685 Amenia, stated at the last meeting he heard septic system maintenance
ordinance, yet there was talk about septic system inspections. If it’s bad it should be
replaced but no one should be coming on his property without his permission to inspect
his septic system. That is too much big government. To have a septic system inspection
ordinance is way beyond a septic system maintenance ordinance. Interestingly it is not
recorded in the minutes. He stated item E) is a noxious weed ordinance and asked if
anyone in the public knows that the Village will now be deciding which weeds are
noxious. There is no description included; just what the Village thinks is noxious. He
asked if this is what is going to happen with the septic ordinance. The Village thinks it’s
failing so it has to be replaced. There is a huge difference between maintenance and
inspection.
An Oak Island resident stated the only way a septic system inspection can occur is with a
search warrant. It is government intrusion; you can have a criminal search warrant or an
administrative search warrant. The homeowner has the complete right to eject any
inspector on their property. He does not think the Village has the power to enact such an
ordinance.

Magee stated this is an item we put on the agenda during election years so if we have
anyone who is going to appear on the ballot in Wolverine Lake they can come and talk to
Council. He stated he did not believe we had any candidates at this time.

Engineer Powell introduced himself. He stated he has put together a study and cost
analysis to present for this first public hearing. At last month’s Council meeting, Council
accepted the petitions from several roads, including Delmonte, Oakview, Oak Island,
Canal, a portion of Tampa, Payne Court, Ethel Drive and Ethel Court. Those petitions
were received by Council and Council made a motion to have a public hearing so that
everyone can air their opinions as to whether or not a Special Assessment District should
be established. What that is, is a boundary line of a project that is established by Council
so that a public improvement might be able to be done in that district and bonds sold so
that the cost can be spread out over 10 years. This act was enacted by the State of
Michigan because in the past when a street wanted to do an improvement such as paving,
sewers, water, lights, etc., the association or street might get together and want to do
something but they could only get 55% or 70% of the people to agree to pay and there was
no vehicle to force those that would also benefit to help assist in paying. Special
Assessment Districts allow the governing body, or Village Council, to establish a SAD
and sell bonds to be able to put those public improvements in those districts and it gives
the leeway that if 51% of the area within that district wants that improvement, Council can
go forward and make that improvement happen. It forces the other 49% to participate.
Anyone that has a benefit in that SAD must participate.
There will be another public hearing after this one, assuming Council moves forward and
establishes the SAD. The next public hearing would be 2 or 3 months from now and
Council would be presented with the exact cost of every single parcel within the SAD.
What happens between this public hearing and the next, is the engineering plans will be
prepared and we will go out for bids so there is no guess work what the final cost will be.
Those costs are then spread out typically over 10 years. He noted a map of the Village
that showed yellow for homes that signed the petition in favor of the SAD and a darker
color for those that did not sign or were not home when the petitioner went around. In
each case except for Oak Island itself, the percentage is substantially over that 51% rule.
If 100% of the people in an SAD want to participate, it’s a very easy decision for Council.
If you only have 51% then it gets a little bit harder. This is how the process works.
Resident at 1675 Delmonte stated the map shows his parcel as yellow and he got a new
septic system in 2008 and there is no way he signed the petition. There has to be an error
there and he needs to find out how his name got on the list. Powell stated this is exactly
what this public hearing is for, so that any errors or concerns can be addressed.
Powell passed around the map for all residents to look at. Administrator Miller clarified
that the map indicates the infrastructure in the street, not hooking up. Powell stated this is
correct. This SAD is for the infrastructure only, and there are only two reasons why you
would have to connect. If you want to add on to your home with an addition of over 100
square feet and there is a sewer line in front of your home, then you would have to hook

up. The other is if the health department determines your septic system has failed, they do
not allow you to repair your system if there is a sewer in the street. Those are the only
reasons why you would ever have to connect. We are just talking about putting the sewer
infrastructure in the street.
Resident at 242 Oak Island stated the paper work shows an estimate of the initial cost and
asked what the ongoing costs would be. Powell explained the first hand out that shows the
estimated cost per lot is $2,619.47 being spread out over 10 years to be $333.36 per year,
for the infrastructure. He stated the second hand out shows the estimated costs for
actually hooking up and this is substantially more. Powell stated the ongoing costs are
billed quarterly by the Oakland County Drain Commission. Magee stated it is about $105
per quarter. He stated if this SAD proceeds, then Council will open up the opportunity for
a second SAD or hook up district and that is for those who choose to hook up at that time.
Resident at 1675 Delmonte asked about the cost per lot as some homes are on more than
one lot. Powell stated it is a cost per home site. If your home sits on four lots, you are
only charged for one home site. If you had adjacent buildable lots with separate sidwell
numbers then you would be charged more than once.
Resident on Delmonte asked about the different streets and being in one Special
Assessment District. Powell stated it is considered one district and if a contractor is
bidding on all of it at one time, we get a much better rate per lineal foot for installing the
sanitary sewers. There is a fairly major cost savings by grouping everyone together.
Sienkiewicz asked why the cost for putting in the infrastructure has increased so much
from the last SAD we did. Powell stated due to the economy, we lost a lot of contractors
that do this type of work. We are left with fewer contractors that do this work and now
that the economy is coming back slightly, those contractors are bidding out more and more
and have more work. He clarified that this estimate that he has done is his estimate only
and it is critical that he is on the high side. He fully expects that once we bid the project
out it will be less. He stated it very well could end up under $2000.00 per home but he
cannot present it that way. Powell state that he approached it from the worst case
scenario.
Resident on Oak Island stated on the map the home next door to him has no color and
should not be included. He asked if there have been other instances where a SAD has
been as wide spread as this one that is proposed. Powell stated there is no requirement
that projects be adjacent to each other. In the past, they have gone all the way from South
Commerce Road to Ladd on the southern side of the Village. There have been
miscellaneous streets that were done on the eastern district. This is not at all unusual to
have them scattered throughout the Village. The resident asked if any SAD had been
approved with less than 51%. Powell stated in this Village he is unaware of any SAD that
has been approved with less than 51% of the petitions district wide. Magee stated there
are portions of streets that had to be included for engineering purposes that did not clear
51% in that portion. Powell stated it becomes very difficult to do half of a street at a time.

Resident at 242 Oak Island stated his neighbor agreed to the petition for the study but is no
way interested in funding this project. He thinks there are a lot of people interested in the
study but not actually participating in the SAD. Powell stated anyone who has a
difference of opinion from what is being presented needs to contact the Village office to
have their name removed. The resident stated it was sold to people as an interest in a
study to see how much it would cost and that nothing would proceed beyond that point.
Powell stated SAD projects are never approved until the second public hearing. He stated
that is the reason for the public hearings. Magee stated if anyone knows of anyone who
signed the petition and is not in favor of this proceeding, you need to have them contact
the Village office. We want to make sure we have an accurate count. This is why notices
went out to everyone in the district and we have this hearing and a second hearing. The
resident stated the petition was misrepresented.
Sienkiewicz stated he thinks that residents feel this is the final decision. There is still a lot
of time and a lot of options. Some people may opt in and some may opt out. It was not
Council’s idea to say let’s connect sewers to everyone’s house. This is just to have the
line put in the street and we had a lot of people that petitioned Council to do so.
Proceeding to the next public hearing just gives us concrete numbers, this is not a do or
die meeting tonight. He stated he is not going to vote for anything that nobody wants.
Resident at 2566 Tampa stated it sounds like the sewers have been going in over quite
some time and a good percentage of the lake has sewers. He asked what the improvement
is we are trying to make. He’s not sure if it’s the ecoli or the weeds. It is his
understanding that a lot of the ecoli issues are waterfowl related and the weed problem is
from people throwing fertilizer down on their grass. He wants to know what the
improvement is. Powell stated when he says improvement he is using the technical term
and a sewer is considered a public improvement. He stated there is without a doubt
documented evidence that sanitary sewers improve the quality of the lake. Here in the
Village we have another problem that the current standards of the Oakland County Health
Department is you cannot build a home on a lot less than one acre in size and use a septic
field. That is the minimum size that they determined is at least ecologically safe to put a
septic system in. That is a ground water issue more than a lake issue. The other issue is
that the health department now has some standards that if your septic system fails and you
are within 50 feet of the water they now require you to put in a pretreatment plant in and a
raised bed that costs substantially more than the sewer and the connection. The resident
stated he has talked to people with engineered fields and it was less than the total sewer
cost.
Resident on Delmonte asked about the water quality tests that were done and what
percentage came from water fowl as opposed to the septics. She has searched for these
results on the web site and cannot find it. She expected them to be posted somewhere
tonight and they are not. Magee stated the Water Management Board has compiled that
data and he is not sure where it is posted. He suggested contacting the Village office for

this information. The resident stated there should be a direct link on the web site to access
this information. He stated he would have administration look into this.
Resident at 1340 Delmonte asked when the last time the Village went out for bid. Powell
stated the last bids were done a year ago. The resident stated he works with a lot of
contractors and thinks the bids will be less than the estimate. He suggested Powell go to
MITA (Michigan Infrastructure Transportation Association) and they might be able to
help drive this total cost to the homeowners down. Powell stated to keep in mind this is
just an estimate and when the project actually goes out for bids the cost probably will go
down. He made sure he made the estimate on the high end.
Resident at 260 Oak Island asked if Oak Island was considered a separate district. Magee
stated there are a couple of streets on Oak Island, there is Canal Street and Oak Island
Drive. He stated once we make it a SAD it all becomes one district. We certainly have a
couple of areas we need to look at as a whole. One of them is Oak Island as a whole and
because of the way the roads on Oak Island lay, it is difficult to disentangle parts of Oak
Island Drive. The resident asked about the different percentages on the streets of Oak
Island or if the island as a whole would be looked at as a percentage. Magee stated legally
the SAD is looked at as a whole, when we look at it and choose to put pieces in and when
we get feedback from everyone, we can look at some of these individual lots and decide
whether or not that sewer gets extended all of the way down Oak Island, part of the way
down Oak Island or just up Canal. The resident stated he is concerned that the residents
on the Island who want it will not be able to access it if the sewer doesn’t go all the way
through. Powell agreed, if it does not extend all the way around Oak Island and if there
are resident’s who want it they may not have access. He stated it was his recommendation
at the last meeting to consider Oak Island as part of the SAD. The sewage developed on
Oak Island has nowhere to go but outward to the lake. No matter what happens tonight
for sanitary sewers, he needs to make sure there is a way to serve Oak Island because it is
surrounded by other streets. If Oak Island is not part of this SAD process, his educated
guess is it will never be because the island alone would not be able to afford it. The
resident stated he has an engineered septic system but he would like to have the option of
the sewer and would at least like to have the infrastructure there.
Resident representing his mother at 294 Oak Island Drive stated the island is below 51%.
He stated the petition circulated was represented just as a study. He has talked to residents
who had no idea they had signed a legal binding document. His point is, Oak Island is a
separate unit of identity from the plots on Canal. They are private lots and not a
subdivision. He stated they are below 51% now and there are at least four people that will
drop when they get the clear facts. At this time they have the right under the statute to
request that Oak Island be removed from the SAD. He stated it has been the Village
policy for at least 12 meetings in the past that you have been going by street and if each
street does not have 51% you were not forcing. This sets precedence. He stated it could
be changed but they want to be treated equally with the other streets.

Craig Minoletti 1641 Delmonte asked when they would get more detail of the
administrative costs, which is about 26% of the cost of the project. Powell stated once the
actual costs of the construction are completed, the bonding attorney and the planner who
sells the bonds will be able to narrow those prices down. Minoletti asked if there would
be more detail to the line items, such as the Engineering, Surveying, Construction
Management. Powell stated not typically but for clarification his costs are for surveying
all the properties, the road ways, the topographic survey, the easements, the engineering
then designs the sanitary sewers, scheduling the contractors, etc. He stated the 15%
contingencies is pretty straight forward, it is in case they hit something out of their control.
There is the Bond Attorney and Easement Acquisition, which is a new description because
Oak Island legally is a property line nightmare. That is an item in there in case we have to
obtain some easements in order to get sanitary sewers around that island. The
Administration/Bond Sales is the Village costs and the bond sales costs. Minoletti asked
if Powell would be billing the Village for work done. Powell stated yes. Minoletti stated
so there is a financial incentive for the engineer to allow this to go through. Powell stated
he would certainly have a lot of work to do for the Village to put in a sanitary sewer.
Dave Renwick 685 Amenia stated that it was stated that people with an attached buildable
lot would be charged twice. Powell stated if a parcel has one sidwell number, it is
considered one. If there is an attached lot with a separate sidwell number, is considered a
buildable lot with separate taxes, it would count as separate. Renwick asked if the people
who own a house with a buildable lot attached got two votes for or against the SAD or did
they only get one. Powell stated if they signed the petition it is positive vote, if they didn’t
their area is then considered a negative vote. It is not a one two count; it is a gross area
within that SAD. Renwick stated the residents on Amenia years ago were put in an SAD
against their wishes. They had to petition to get out of it. The street was more than 50%
against it and they had to fight to get out of it. He suggested to the residents of Oak Island
that if they get put in this, to petition to get out of it. He stated it is a shame that they had
to do this because Council was ready to force it on them. He asked for the record,
regarding the Health Department and health code if anyone can be forced to hook up
within 18 months of the sewer becoming active. He stated under Michigan Law it says
when a sewer system becomes active; you can be forced to hook up within 18 months. He
asked if Council would state for the record that this absolutely will not happen. Powell
stated from his experience, he has been designing sanitary sewers for 30 years in the state
of Michigan and never once has he ever known of a time when someone was forced to
connect into a sanitary sewer by the State or the County short of their septic field failing.
Renwick asked if he knew this was a State law. Powell stated he knows that every
attorney in every community he has worked in has made that claim. Magee stated it is his
understanding that this is a piece of Michigan law that sits back on the books that has
never been enforced in Michigan history and that it would be very difficult for the State of
Michigan to enforce. Attorney Elowsky stated she agrees.
Resident at 2567 Tampa asked when his sewers would be going in. Powell stated best
case scenario would be mid-summer.

Resident at 1205 Delmonte asked what would happen if Oak Island drops out and the rest
of the residents in the SAD still want to do the sewers. Powell stated it still can be done.
Magee stated it is much easier to remove areas from an SAD than to add them.
Resident at 2561 Tampa asked if the infrastructure comes through this summer and
someone decided to sell their house, would they be obligated to pay that off before the sale
of the home or to hook into the sewer. Powell stated the connection is totally optional and
does not have to be done on the sale of a home. The SAD costs, there is no local or state
law that it has to be paid off, however, most mortgage companies or title policies request
that it be paid off at the time of the sale, so it would be out of the proceeds of the sale it
would be paid off.
Pat Nagy 2086 Glen Cove stated he is on the Water Management Board and they plan on
taking additional water samples this summer to see if there is any improvement in the
water quality with the sewers that are being put in along the lake. He hopes to get them
posted on the web site. They are being proactive and taking samples every two weeks
starting in May. Powell noted that putting in the sewer line does not mean that residents
have actually hooked up. When a sewer goes down a street typically only 30% of the
residents actually tie in that year and then it usually is 5 or so every year thereafter.
Resident at 2566 Tampa stated this was his point before. Other lakes have already done
this and they still have problems with ecoli and weeds. It is the fertilizer, run off,
waterfowl, etc. There have been enough studies done. Most lakes have already done this
and we really do not need more studies. Powell stated it is easy to say there are still
problems, but if you go back and compare the problems in those lakes pre sewer and post
sewer, you will find a tremendous difference. He stated he was the engineer for the City
of Novi when they first put the sewers around Walled Lake. He stated that lake was really
in declining condition before the sewers were in. After five years there was a marked
improvement. He stated certainly the studies are out there.
Resident at 318 Oak Island Drive stated his main objection to this is this is the third time
around. This whole system disenfranchises people. He decided to not sign the petition, he
didn’t and now he has no rights. It is the people who signed who have rights and he has
none. Oak Island has less than 50% which Council said they would not pursue and now
it’s a whole district and he has no rights again. He has talked to several residents in areas
where sewers were put in and sure enough, within a few years their septics are condemned
and they are ordered to hook up. He stated it is black mail as far as he is concerned
because if you put this all into a bond, he is forced to do it. Everything he has ever heard
about this lake is the ecoli comes from birds and dogs. He stated he is a businessman and
he is given information and then he makes a decision. In this case he is forced into it
regardless of his decision.

Ron Cumbo 2450 Oakview stated he is in favor of the SAD going through. He thinks you
have to look at the quality of the lake. His overall feeling is that over time as people
connect the lake will improve and consequently the values will improve and the general
quality of life in this Village will improve. He encouraged Council to not let Oak Island
opt out of the overall SAD because if they do, not only would it never happen and the
overall goal of improving the lake quality will never be reached because of the island
sitting right in the middle of it. He supports the SAD as a complete package. He
encourages the Oak Island people to not be too short sighted. The number $18,000-
$20,000 keeps coming up and what we are talking about right now is a figure closer to
$2,000 over 10 years. It is imperative that everyone look at the quality of the lake and the
overall long term standard of living and life style within our Village.
Magee read a letter from Councilman Stack – I am out of town on business and will be
unable to attend the February Council meeting. There is an issue on the agenda I would
like to comment on, the Lakes Area Special Assessment District. During our last Council
meeting Mr. Powell showed a map of the streets currently covered with the sewer
infrastructure and the proposed additions. Since then it has become very clear to me that
we need to include all of Oak Island in the proposed SAD. I cannot see breaking the
island into two segments. The island should be considered as a whole. A few reasons Oak
Island should be included in the Lakes Area SAD – a) the only area completely
surrounded by water, b) limited space and accessibility to meet Oakland County’s
requirements for septic systems on lake front lots, c) if a portion of the island is left out of
the current SAD, the entire cost will have to be absorbed by the remaining residents in one
lump sum without the benefit of a bond to spread the costs over a 10 year period. Even if
the remaining residents were able to secure a bond to install the infrastructure at a later
date, the attorney fees, bond fees and engineering fees would add a substantial financial
burden to the participants in the costs of the project. In summary I feel for the benefit of
the community and the lake that all of Oak Island should be added to the Lakes Area SAD.
When the first SAD was established it was with the goal of protecting the entire lake front
with sewers, let’s fulfill that goal and protect the Village’s number one asset, the lake.
Resident on Oak Island stated since Councilman Stack does not live on the island, he does
not agree with any of that. He stated he is troubled by some of the verbiage Council is
using such as when we establish the SAD or when SAD was established as if it is going to
happen. It is clear to everyone in the room what Council’s goal is regarding this matter.
He stated in regard to lake quality, there is nothing wrong with our lake quality. The lake
is murky and is murky because it was formed out of seven swamps. That is why it is
weedy, it is shallow. He stated septic tanks are not designed to bleed into a lake or bleed
anywhere. They provide absorption of septic waste in the soil. If there is a problem with
a septic system, it is because it has failed and is running down the storm drain into the
lake. He stated there has been a lot of conversation from residents on Oak Island and he
would encourage Council to separate Oak Island, as has been done in the past, so residents
there can choose and not be swept up in this movement toward sewers.

Resident representing his mother at 294 Oak Island Drive asked about 20 year exemptions
from being forced to tie in could be given as was done in Milford. Magee stated he has
never heard of this before and would have to find out more about it.
Craig Minoletti 1641 Delmonte stated he did not talk to the petitioner who did Delmonte
but hearing from the residents from Oak Island, questions if the information given was
factually correct. A resident on his street has stated he has a new septic and did not sign
but his lot shows as a yes vote. He asked if we were sure that all of the petitions are
accurate. Magee stated each petition is on a standard form and needs to be attested to by
the petition circulator that it is correct. Minoletti asked who that is. Magee stated it is a
resident on the street. He stated this is why we set up the public hearing process so people
get notifications they are potentially in an SAD and they can come down and notify the
Village if they were listed as a yes and are a no or if they change their mind. Minoletti
asked if Council was concerned that all they are hearing from is a small fraction of
representation from what is shown on the map Magee stated notices are mailed and it is
advertised twice in the Spinal Column. He stated this is the legal process that is
established in the State of Michigan and the process that they are following.
Resident at 2548 Oakview stated it is $250 a year for 10 years to improve our lake; we pay
more than that for garbage removal. He stated we have homes in Oakland County on a
beautiful lake and we are talking about $250 a year to improve it.
Resident at 260 Oak Island stated looking at the map he can visualize the entire Village
and lake having sewer hookup opportunities and then an island that won’t have it. He
stated it is an improvement and it makes no sense to him for such a small investment not
to do it just to have that insurance. He stated potentially Oak Island could be the last area
in Oakland County to at least not have the ability to hook up to sewers. He does not want
to be the brown spot in all of Oakland County.
Resident on Oak Island stated the reality for him is he has a double lot that he never
intends to subdivide. He has a septic field that is more than 50 feet from the water and he
can dig it up and replace the entire thing for probably $12,000.00 and it will last another
30 or 40 years. So he will never ever hook into it unless he is forced. He appreciates all
the comments about how he should suck it up and throw $2,600 down the toilet but this is
not something that he will never need or use. He stated you are forcing people who don’t
need it to pay for it so you can have it as insurance.
Resident on Oak Island Drive stated she is for the sewers. She does not have a very wide
lot so if her septic goes she is sunk. She stated she just wants the infrastructure to come
through so they can hook up if they need to. She does not want to be the only area around
without the ability to hook up.
A resident stated if we are going to be forced to have sewers, we have no reason to be
separate from Commerce Township.

Ron Cumbo 2454 Oakview, stated saying because we have sewers we are just like
Commerce is ludicrous. People live here because of the quality of life and the lake. In the
long term the security of that investment is tied directly to the quality of this lake. Oak
Island will be the big brown spot that will be clearer year by year. It is very important that
Council pass the SAD and not break up the SAD.
Resident at 2623 Canal Drive stated he is on Oak Island but the other end. He stated the
map looks like the majority on Canal signed the petition in favor of the SAD. He is
hearing a lot of negativity on the Oak Island side. He asked if Oak Island Drive does not
want to participate and Canal does, can it be split up or is the island the island. Magee
stated he has not heard any desire to drop Canal Drive out of the petition.
Resident at 1675 Delmonte asked what the percentage for the entire district is in favor of
the SAD. Magee stated it is 63% for the district as a whole dropping the resident from
Delmonte who stated he was not a yes. He stated this comes to 114 lots out of 180 and he
does not know if this includes any areas that have more than one lot with separate sidwell
numbers.
Dave Renwick 685 Amenia stated the condition of this lake is not bad. As far as Oak
Island being the big brown spot in this lake, the only big brown spot he has seen on this
lake in 27 years here was caused by the sewers down at Penny Lake less than a year ago.
The only big brown spot in this lake came from sewers, not septic.
John Scott 250 Oak Island Drive stated he was the petioner on Oak Island and has done it
three times in the past. He feels it is part of his civic duty to stand where he believes and
he believes that even though there isn’t any real proof that sewers will improve the quality
of the water in the lake, he likes to believe that having sewers rather than septic drainage
will protect his and his neighbors wells. The critical area is that one acre of land is what
Oakland County considers to be a safe margin of land to live on when you have a septic
field and drawing water from a well. He wants to thank the people involved beyond Oak
Island to allow us to come in because we are a unique area with unique cost requirements.
He stated this is an opportunity for the people on the island to think clearly about what the
history of the country is in a sense. Here we sit in Oakland County possibly with one
opportunity to straighten up an issue that has been going on for decades. If we would
have done this forty years ago we wouldn’t have this argument, if the people before us
would have taken the responsibility to improve the quality of the of the area we stand on
everyday and raise our family on. Scott stated that he does not really need it right now but
someday someone else might want to move into their house and do something with it. He
feels it is his responsibility to at least provide the infrastructure. He stated for around
$2000 or $200 a year he will know that he fed an infrastructure improvement in his
community.

Dave Renwick 685 Amenia stated he has heard Oakland County requires one acre for a
septic field and a well. He stated Oakland County allowed all of us to put in our septics
and wells. He questions the change when Oakland County now has a vested interest in
sewers. He stated Council is pushing sewers whether the residents want it or not. He
wonders if Oakland County lied to us when they allowed us to put our septic in and if
Council is lying to us now.
Resident on Oak Island stated the residents need to look at this as a community issue
versus a personal issue and the effects on all of the residents. As far as Council pushing
for something the residents don’t want, if the total percentage is 63% there are more
residents who want sewers than don’t.
Resident at 1204 Thurston wondered if there are discrepancies in the petition, if an audit
of them could be done. Magee stated he certainly will ask administration to go over and
confirm the petitions for Oak Island. The resident asked if we could go even further than
that. Magee stated we will before we get to the next public hearing.

13. A. RC 2/8/2011 17984 2012 LAKES AREA #2 SANITARY SEWER
INFRASTRUCTURE PROJECT SPECIAL ASSESSMENT DISTRICT (SAD)
Magee asked Powell if the engineering bidding could include the entire district as a whole
and the option of just the south side of Oak Island. Powell stated yes, he would suggest
doing this.
Sienkiewicz stated right now as we stand with the petitions that we have for this entire
SAD, what is the percentage as that will affect how he votes. Magee stated the SAD as a
whole is 63.3% in favor as of tonight.
Kaznecki asked if we were going to verify some of those numbers. She stated if that
number were to change dramatically, it may affect how she would vote as well. Magee
stated we have the resolution in front of us which would set the second public hearing for
our April meeting. At that point we would have final engineering costs bid out and we
would be able to go back and verify the signatures on Oak Island. Malek asked about the
questions on Delmonte and making sure that all the signatures on all the streets have been
verified. Administrator Miller stated everyone has received a letter and everyone will
receive a second letter if they are included in the SAD. They will go through again and
verify that those people who signed the petition are actually in the SAD. She noted they
have advertised it twice and will advertise it twice again.
Malek also asked what would happen to Oak Island if they are left out of the SAD and
several years down the road Oakland County mandates they must put in the infrastructure

because they certainly would not be able to do it for $2,600. It was indicated they would
be on their own cost wise.
Sienkiewicz stated he has lived on the lake for 38 years and when he first moved here you
couldn’t get a row boat off shore because of the weeds. One year they pulled out 400-500
stumps so the lake could be used. These are the kinds of improvements they have made.
He thinks it is safe to say that having sewers go around the lake is going to help the lake,
how much is very hard to tell. He stated back when he was Council president he pushed
to have the roads paved and Oak Island fought it and after it was paved, half the residents
said how much they liked it. If you spend this $200 a year and something should happen
down the road or you want to sell your house, having the infrastructure there has got to be
a selling point. However, wherever the majority is will be how he votes. If it is under
50% at the April meeting, he would vote against it. He thanked everyone for attending the
public hearing and encouraged residents to attend Council meetings every month to hear
what is going on in their community. He also stated that he is not a liar and does not
appreciate being called one.
Sienkiewicz asked with the existing sewers that we have in the community, has anybody
in the Village been forced to hook up? Powell stated no, the only ones he is aware of have
been the opposite in concern, residents who have been just at the outer reaches to access
the sanitary sewer have requested us to make provisions for them to tie in when they were
not part of the SAD.

Area #2 Sanitary Sewer Infrastructure Project Special Assessment District (SAD) as
presented, with the addition of confirmation of signatures and to get a final engineering

are just going to do it. He stated that smells like a lie to him and if he says lie he means it.
He stated Council has a sewer by any means mentality and it is ridiculous and he hopes
the residents are smart enough to go out and counter petition or sue.
13. G. RC 2/8/2012 17990 2012-2015 POLICE DISPATCH SERVICE AGREEMENT
BETWEEN THE COUNTY OF OAKLAND AND THE VILLAGE OF
WOLVERINE LAKE.
Administrator Miller stated this is the dispatch agreement with Oakland County and it is a
renewal for the next three years. The increase is 2.25% or 2% for the next three years.
Everything else is the same and we have been very happy with our dispatch. She stated
Administration recommends Council approve this. Sienkiewicz asked if this increase was
across the board for everyone that uses Oakland County. Administrator Miller stated yes,
it is across the board.
MOTION by Malek, seconded by Kaznecki, to approve the 2012-2015 Police Dispatch
Services agreement between the County of Oakland and the Village of Wolverine Lake at
the new rate of $2,203.33 a month with a 2.25% increase in 2012, 2% increase in 2013

13. H. RC 2/8/2012 17991 OPERATING AGREEMENT BETWEEN THE STATE
OF MICHIGAN AND THE VILLAGE OF WOLVERINE LAKE REGARDING A
WATERCRAFT DISINFECTION STATION AT THE PUBLIC ACCESS SITE.
Administrator Miller stated this is an agreement with the State of Michigan for the DNR
access site; we have been working on an agreement for at least 6 months. The disinfectant
station is for the VHS virus that is in fresh and salt water fish. It is in the Great Lakes and

a lot of the inland lakes. It is a virus that attacks the fish and they hemorrhage and die.
The disinfectant station is a chemical that would be sprayed on the boats before they enter
the lake and when they leave the lake so that they don’t spread to different waters. Once it
is in the lake, you cannot get rid of it. It would be voluntary spraying of the boat. The
Water Management Board has done a lot of work on this and has copies in the packet of
the station itself. There is a 10 to 20 gallon tank that holds the chemical and then there is a
one gallon spray container that is attached to that. The Water Management Board would
be doing some education and there would be a sign. Regarding the agreement itself, there
is no charge to the Village, but we are responsible for the station. It will probably cost
about $1000 - $1500 to build the station, after that it would be $500-$800 per year for the
chemical. The attorney has looked over the agreement. This agreement is for five years.
Sienkiewicz asked if this would be entirely volunteer and not use any Village employees.
Administrator Miller stated it would not be manned and the maintenance or upkeep would
be by volunteers from the Water Management Board. Sienkiewicz asked where it would
be placed. Administrator Miller stated it would be in the tie down area. Sienkiewicz
asked about the chemical being used and would it be harmful to the lake in anyway. Nagy
stated it would be 150 feet from the lake and it is safe. Sienkiewicz asked if we have
tested the lake to see if we have this virus. Administrator Miller stated the only way to
test is to test the fish. Magee stated it is his understanding that if we had it we would
know quickly. Administrator Miller stated along with the station is a lot of education
about the transfer of things from lake to lake. She thinks it is a minimal expense to keep
something harmful out of the lake.
Nedrow asked how many of these treatment centers are in the State. It was stated that if
the DNR could they would mandate it for every public launch that they have, but they are
relying on volunteers.
Magee stated it is his understanding that this chemical is targeted toward the VHS virus
but asked if it would help with other things.

Magee stated they have talked about the possibility of using Skype. This would
accommodate council people that might be out of state but also to be able to put meetings
on line so residents could access the meeting and watch. This is pretty inexpensive
technology. Certainly a council person could not participate in a full meeting, vote, speak,
etc. The other part of the recommendation is they would like to allow participation in sub
committees as they are smaller gatherings.
Sienkiewicz stated he was under the impression we were going to investigate costs and
what would be involved, not make a decision at this meeting. He is not ready to approve
something that would allow people to not be at meetings. He also wants to make sure that
no matter what we are discussing, you can watch but not comment. Magee stated this is
correct. Sienkiewicz stated reading the Spinal Column article it sounded like it was a
done deal and he is not ready to vote on this. He thinks it opens the door wider to
absences and he thinks it is a mistake.
Malek stated he is on several boards and has concerns as well. Magee stated it is really
just letting people see what is going on and would be unobtrusive to the meeting. He
noted they did not make a recommendation for other boards at this time, they felt they
would see how it worked out. However, they did want to allow Skype at committee
meetings and allow the person to speak.

Administrative Committee regarding electronic communication until we have a full
Council.

Magee stated the Administrative Committee looked at and reviewed what we currently do
as far as Community Social Assistance. They decided that we are doing an effective job
now. It is difficult to reprogram for specific things and they recommend that we continue
to support but make no changes to our current program.
13. J. RC 2/8/2012 17993 REPORT FROM THE FIREWORKS COMMITTEE.
Magee stated our Fireworks Committee member is absent from tonight meeting. He
stated they are investigating getting an 85 foot long boat on the lake for a week during the
4th of July in the summer to be able to do some fund raisers, community tours, etc. He
stated he does not believe they have any financial numbers right now, just something they
are looking at. Malek stated he has some concerns about this. As far as where it would be
stored, would neighbors have issues with it sitting there for a week. He worries residents
may not be thrilled about festivities going on for a full week over the Fourth of July.

13. K. RC 2/8/2012 17994 FISCAL FORECASTING
Treasurer Kondek stated five years ago they did a projection study and they thought this
would be the last year for dropping property values. Now the feeling is that it may have
already bottomed out. It is possible that we may maintain or see an increase and this is a
good path for the future. He stated that the steps that Council has taken as far as the
budget has paid off and it looks like, unless there is some severe downturn, our general
fund should maintain or increase.

13. L. RC 2/8/2012 17995 WEED HARVESTER COMMITTEE.
Administrator Miller stated we have had the weed harvester since 1986 and the DPW has
been working on it since December. The barge is in really rough shape. Hopefully they
will be able to patch some holes in it and drain it as it has taken on a lot of water. Her
suggestion is to set up a weed harvester committee to look at possibly finding a new
harvester for the Village. Her recommendation is to include herself, one member of
Council, one member of the Water Management Board and the treasurer to the committee.
Sienkiewicz stated he would be willing to volunteer. Magee stated he would as well.
Malek asked if the parts could be replaced. Administrator Miller stated no, the metal has
gotten thin and involves the entire frame. She stated there are some problems with the
hydraulics as well.
Sienkiewicz suggested looking into putting Styrofoam in the pontoons just to hold it
together for the time being. Administrator Miller stated this is one of the options they are
looking into.

SESSION.
Magee stated the February Work Session is the one we discuss Medical Marihuana. It
was noted there were several people who would not be able to attend the regular scheduled
work session. After discussion it was agreed to change the date of the February Work
Session to Tuesday March 6, 2012.
MOTION by Malek, seconded by Nedrow, to move the February Work Session to
Tuesday March 6, 2012.
All in favor.

14. RC 2/8/2012 17998 PENDING BUSINESS
Park & Recreation Funding – No discussion.
Septic System Maintenance Ordinance – Magee suggested since there was some objection
changing this to Septic System Maintenance and Inspection Ordinance. He stated this is

something to be discussed at a Work Session and has no idea at this time what that
ordinance would entail.
Road Endings – No discussion.
Community Social Assistance – Magee suggested removing this item from Pending
Business since there was a recommendation from the Administrative Committee.
Electronic Meeting Communications – Magee stated we should leave this item as it has
been postponed.
Leaf Pick-up Tink Claw – No discussion.
15. RC 2/8/2012 17999 UPDATE FROM CAPTAIN ELLSWORTH
Sgt. Cunningham gave the update and Captain Ellsworth was absent. He stated they had
47 incidents in January. Larcenies have gone down. There was a pedestrian accident at
South Commerce. The Fire Department had 11 runs including the pedestrian accident.
He stated it has been a fairly quiet month.
16. RC 2/8/2012 18000 UPDATE FROM TREASURER KONDEK
Treasurer Kondek stated he had nothing to report.
17. RC 2/8/2011 18001 ADMINISTRATOR’S REPORT
Administrator Miller stated she researching a Zoning Board of Appeal Training. At this
time no one on the board has had any formal training and she is looking into options.
18. RC 2/8/2012 18002 COUNCIL COMMENTS
Sienkiewicz wished everyone a Happy Valentine’s Day.
Malek stated he is happy about the ZBA training as he is on that board. He felt that there
were several times that a recommendation was made when perhaps it should have been
looked into further. He stated there have been instances where the Building Inspector did
not agree with them and felt that the training would be beneficial to all members of the
Zoning Board.
Magee reminded everyone to be careful on the ice.
