On May 22, 2013, the Board of Commissioners for Oakland County entered into an agreement per MR #13101 – Sheriff's Office – Marine Patrol Services Agreement in the Township of Addison – 2013-2015.
As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed agreement with the County of Oakland and the Township of Addison and the authorizing Board of Commissioners Resolution are
enclosed for filing by your office. Send confirmation of receipt of this agreement to:

RESOLUTION 13- /02../ Oakland County Sheriff Marine Patrol 2013 Contract
Whereas, at the meeting of the Township held on May 20, 2013 located at the Township complex, 1440
Rochester Rd.
Present: Supervisor Pearson, Clerk Bennett, Treasurer Fisher, Trustee Brakefield , Trustee Gierak and Trustee
Boehmer
Absent: Trustee Sutphin
The following resolution was offered by Clerk Bennett
With support offered by Trustee Brakefield
WHEREAS, the Township Supervisor was notified by a group of concerned residents in the Lakeville Lake
Area of their desire to have the contract with the Oakland County Sheriff Marine Patrol (OCSMP) renewed
and funded by private donations; and
WHEREAS, the Township reviewed the need for OCSMP protection and the related operations for the Health,
Safety and Welfare for the Lakeville Lake residents as well as other on the lake. The Township acknowledges,
that adequate funding for the OCSMP contract is not available through the general fund, police fund, or as
previously funded through the State of Michigan DNR; and
WHEREAS, that residents of Lakeville Lake area will hold fund raisers and the privately generated
proceeds/donations will be forwarded to the Township Treasurer to provide payments for the OCSMP; and
WHEREAS, the Township may provide police protection and related police operations for the Township of
Addison and is required by the OCSMP contract to act as authorized agents for the OCSMP contract; and
WHEREAS, the Township Treasurer is in receipt of $3719. dollar balance in the established account and the
Treasurer shall maintain a separate account in the Trust and Agency fund/Marine Patrol for payment of the
OCSMP contract and no Township funds shall be used for the purposes set forth herein including Township
Legal review; and
WHEREAS, the Township authorizes the approval of the 2013 OCSMP contract contingent upon receipt of
funds from the Lakeville Lake area fund raiser for an a minimum amount of $1000.00 by May 24, 2013 in the
Trust and Agency OCSMP account. The Treasurer, by approval of meeting minutes of Lakeville Lake Board, if
additional funding/donations are received, has the authorization to extend the contract hours not to exceed
$4400.00 for the 2013 year and each consecutive agreement year. Funding that exceeds the required amount
shall remain in the account for 2014 or consecutive agreement years thereafter.
NOW, THEREFORE, BE IT RESOLVED THAT should the contract not be renewed for the lack of fund
raising or by the OCSMP in 2013or 2014 any and all remaining funds shall be deposited to the established
SAD for Lakeville Lake Education Fund or Improvement Fund with determination of such fund by way of
meeting minutes of Lakeville Lake Board, and
BE IT FURTHER RESOLVED, the Township is contractually bound by a 30 day written notice to opt out of
the Marine Patrol agreement for 2014 and 2015, the Township requires, per applicable year, a minimum
balance in the account as of March 1 of $1000.00 or that fund raising events to be held prior to March 15 of
each applicable year and funds deposited with the Township Treasurer prior to the March regular scheduled
Board meeting demonstrating the minimum requirement of $1000. If the minimum requirement is not met by
the scheduled Board meeting, the Board shall authorize the Supervisor to write an opt out letter for the
applicable year.
BE IT FURTHER RESOLVED, the Board authorizes the Supervisor and Clerk to sign the 2013-2015
OCSMP contract as previously reviewed and approved by Township Legal Counsel by memo dated April 25,
2013.

resolution was adopted by the Township Board by a roll call vote at a regular meeting of the Board held May 20 ,
2 0 1 3 , at which meeting a quorum was present; and that this resolution was ordered to take immediate effect.
