As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed contract with Oakland County and Charter Township of Oxford and the authorizing Board of Commissioners Resolution are enclosed for filing by your office. CHARTER TOWNSHIP OF OXFORD BOARD OF TRUSTEES REGULAR MEETING, WEDNESDAY, NOVEMBER 12, 2014 Page 1 – Charter Township of Oxford Board of Trustees Minutes A Regular Meeting of the Charter Township of Oxford Board of Trustees was held Wednesday, November 12, 2014 at the Oxford Veterans Memorial Building at 28 N. Washington Street, Oxford, Michigan, 48371 (second floor). Members Present: Bellairs, Cryderman, Curtis, Dunn, Durr, Ferrari, Wright Members Absent: None Also Present: Engineer Sharpe, Fire Chief Scholz, Finance Manager Payne, Finance Manager Edmonds, Parks & Recreation Director Davis, Planner Oppmann, Recording Secretary Harrison, 2 cameramen, and approximately 27 citizens Supervisor Dunn called the meeting to order at 7:01pm. APPROVAL OF THE AGENDA Treasurer Ferrari moved, Clerk Wright seconded, to approve the Regular Meeting Agenda of November 12, 2014 as amended – moving item 11.a. to 9.b. Proposed Preliminary PUD – White Pines Estates. Ayes: 7 Nays: 0 Absent: 0 Motion Carried APPROVAL OF CONSENT AGENDA Trustee Cryderman moved, Trustee Curtis seconded, to approve the Consent Agenda as presented. Roll Call: Ayes: Curtis, Durr, Cryderman, Bellairs, Wright, Dunn Nays: Ferrari Absent: None Motion Carried PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA - Rose Bejma, 75 Pearl, commented she was a precinct chairman during the last election and commended Clerk Wright and his staff for the great job they did and that their training was well done. Kallie Meyers, Oxford, commented on the plans to build a dorm on school property for students coming from China – it was her opinion school officials were trying to circumvent going through local control to construct the building on school property, a dorm in which there will be money collected is not considered a school function and therefore is not exempt and it would violate the Land Division Act. She noted several other reasons why the plan doesn’t comply with Township ordinance and asked the Board to take note of these concerns. Roll Call: Ayes: Curtis, Bellairs, Ferrari, Dunn, Wright Durr, Cryderman Nays: None Absent: None Motion Carried PUBLIC HEARING FISCAL YEAR 2015, COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS Treasurer Ferrari moved, Clerk Wright seconded, to open the Public Hearting at 7:16pm. Ayes: 7 Nays: 0 Absent: 0 Motion Carried Treasurer Ferrari moved, Trustee Curtis seconded, that the Charter Township of Oxford Board of Trustees formally agrees to allocate its 2015 Community Development Block Grant (CDBG) Funds in the following manner: $21,390.00 – for the minor home repair program for 5-6 homes in Oxford Township. $9,167.00 – to provide Oxford Township residents with emergency food, utility, rent/mortgage, medical and educational assistance. In the case that CDBG funding comes in less than anticipated, the allocation for the minor home repair program is to be reduced appropriately. The Charter Township of Oxford Board of Trustees also authorizes CDBG Coordinator Joseph G. Ferrari to prepare all the necessary documents and authorizes Supervisor William Dunn to sign the 2015 annual CDBG submittal, 2015 Sub-recipient Agreement and the Conflict of Interest Certification on behalf of the Township. This amount to include Alternate M-1 for the lower level toilet room rough in, and Addendum No. 2 and Addendum No. 3 to expand the lower level area. Roll Call: Ayes: Wright, Ferrari, Bellairs, Curtis, Dunn, Cryderman, Durr Nays: None Absent: None Motion Carried PROPOSED PRELIMINARY PUD – WHITE PINES ESTATES (moved up from 11.a.) Treasurer Ferrari moved, Trustee Cryderman seconded, to deny the Preliminary PUD for White Pines Estates Parcel #04-31-300-002, for the following reason – it does not comply with the Township Master Plan. Treasurer Ferrari amended the motion, Trustee Cryderman re-supported to add: - the proposal does not meet present zoning, there were no building elevations shown on the drawings per the Attorney Review Letter dated October 1, 2014 and as required by Article 14.4B of the Township Zoning Ordinance, no traffic study was provided as noted in the Township Attorney Review Letter dated October 1, 2014, there was not a consistent 100 foot buffer between property line to building lots as required in Article 14.6, and a proposed safety path from the east property line to the west property line was not provided on the drawing. UNFINISHED BUSINESS MDEQ GRANT EXTENSION REQUEST FOR ELKVIEW SUBDIVISION Treasurer Ferrari moved, Trustee Cryderman seconded, that the Oxford Township Board of Trustees authorizes Treasurer Joseph G. Ferrari to sign the grant amendment between the Michigan Department of Environment Quality (MDEQ) and Oxford Township as presented with a new grant contract deadline of December 31, 2015. Roll Call: Ayes: Wright, Cryderman, Dunn Nays: Curtis, Bellairs, Ferrari, Durr Absent: None Motion Failed NEW BUSINESS AWARDING OF 2014 CDBG EMERGENCY SERVICES CONTRACT Treasurer Ferrari moved, Trustee Bellairs seconded, that the Oxford Township Board of Trustees awards the Emergency Services Bid for 2014 Community Development Block Grant Funds (CDBG) in the amount of $14,181.00 ($9,181.00-Oxford Township and $5,000.00-Oxford Village) to Oxford/Orion FISH and authorizes CDBG Coordinator Joseph G. Ferrari to sign the applicable documents and proposal ratification. Roll Call: Ayes: Curtis, Bellairs, Cryderman, Wright, Dunn, Durr, Ferrari Nays: None Absent: None Motion Carried RECOMMENDATION FOR THE SALE OF THE VETERANS HALL AND DUNLAP ROAD VACANT PARCEL Clerk Wright moved, Trustee Curtis seconded, to retain the services of Coldwell Banker Shooltz Realty for the marketing and sale of the following properties: Parcel 04-22-460-002 (28 North Washington Street) Parcel 04-16-426-002 ( Dunlap Road Vacant Parcel) Parcel 04-22-460-047 (Parking Lot behind the Vets Hall) Any fees and expenses associated with these properties will be deducted from the sale proceeds. Clerk Curtis W. Wright and Treasurer Joseph G. Ferrari are to meet with Coldwell Banker Shooltz Realty agents to determine a fair market value asking price for each property and bring that back to the Township Board for approval. Ayes: 7 Nays: 0 Absent: 0 Motion Carried ITEMS REMOVED FROM CONSENT AGENDA FOR ACTION OR DISCUSSION None PUBLIC COMMENT Helen Barwig commented that Board members who voted yes on the Law Enforcement staffing motion deceived the residents of Oxford. BOARD OF TRUSTEE COMMENTS Trustee Cryderman wished everyone a happy Thanksgiving. CHARTER TOWNSHIP OF OXFORD BOARD OF TRUSTEES REGULAR MEETING, WEDNESDAY, NOVEMBER 12, 2014 Page 7 – Charter Township of Oxford Board of Trustees Minutes Clerk Wright commented on the recent election, the process is a result of more than just the Clerk’s office, he also wanted to commend all election workers; asked that if there are still election signs out, to call his office and he will get them removed; and suggested, if possible, that the Planning Commission designate specific PUD areas in the Township and to incorporate those into the next Master Plan review. Supervisor Dunn wished everyone a happy Thanksgiving; also commended the Clerk, his staff and all election workers on the success of the election - has heard nothing but good reports. Treasurer Ferrari wished everyone a happy Thanksgiving. Trustee Bellairs – happy Thanksgiving Trustee Curtis agreed with the other comments regarding the election; offered to work with Treasurer Ferrari on the attorney bill for the solicitation ordinance; it has been requested not to install parking bumpers at the Township Hall, it makes snow removal difficult; he trusts that the Sheriff’s Department will run their operation to the best of their ability, much has changed since 2006; and when the Master Plan was reviewed the last time, funds were limited and only 3 areas of the Township were looked at - when a Master Plan is reviewed, all areas need to be included.
