The Charter Township of Orion Board of Trustees held a regular meeting on Monday, February 5, 2018 at the Orion Township Hall, 2525 Joslyn Road, Lake Orion, Michigan. Supervisor Barnett called the meeting to order at 7:00 p.m. BOARD MEMBERS PRESENT: Chris Barnett, Penny Shults, Donni Steele, Brian Birney, Mike Flood, Ron Sliwinski and John Steimel BOARD MEMBERS ABSENT: None OTHERS PRESENT: Dan Dewey Damien Wetzel JoAnn VanTassel Melissa Miller John Miller Corey Steuben Mary MacMaster Jim Tedder A. Lee Smith Kim Urbanowski Gary Roberts Kathleen Sanchez 2. INVOCATION AND PLEDGE Pastor Eric Johnson from King of Kings Lutheran Church gave the Invocation. Members of Cub Scout Pack 233 led the Pledge of Allegiance. 3. RECOGNITION: Citizen of the Month. Supervisor Barnett recognized Oakland County Sherriff’s Department Deputy Mike Miles for his heroism at the scene of an accident. 4. PRESENTATION: Consumers Power Line 600 Update. Damien Wetzel of Consumers Energy gave a presentation on the construction plans for Line 600. 5. APPROVAL OF BILLS. Moved by Treasurer Steele, seconded by Clerk Shults to authorize payment of bills in the amount of $1,048,767.39 and payrolls in the amount of $126,036.21, for a total disbursement of funds in the amount of $1,174,803.60, as amended. AYES: Flood, Sliwinski, Steimel, Barnett, Shults, Steele, Birney ABSENT: None NAYS: None MOTION CARRIED 6. BRIEF PUBLIC COMMENT. Public comment was heard. Moved by Treasurer Steele, seconded by Trustee Flood to receive and file the Memorandum to the Orion Township Board of Trustees and Planning Commission Members from Dave Goodloe, Building Official related to Phil Christie, regarding the property adjacent to his property on Lapeer (M-24) and Clarkston Road, as corrected. 7. APPROVAL OF AGENDA. Supervisor Barnett requested moving Item 9E: Sale of Properties on Pending Business to 9A. Moved by Treasurer Steele, seconded by Clerk Shults to approve the agenda, as amended. CONSENT AGENDA A. Minutes, Regular Meeting, Tuesday, January 16, 2018. Approve, as corrected. B. North Oakland Transportation Authority Intergovernmental Agreement. Approve renewing the existing language and authorize the Supervisor to sign on behalf of the Township. C. Fire Dispatch Contract for 2018-2021. Approve the three year fire dispatch contract and authorize the Supervisor to sign it on behalf of the Township. D. Special Permit Application under Ordinance 76, Alcoholic Beverages Regulation: Lake Orion Lions Club Lion Races. Approve the request for a Special One-Day Permit for the Lake Orion Lions Club under Ordinance 76. Alcoholic Beverages Regulation, pending State approval, and waive the $300 application fee. E. Paint Creek Trailways Commission Board Representative. Accept the resignation of Brian Birney from the PCTC, move Donni Steele from alternate position to voting member, and appoint Chris Barnett as Alternate to PCTC. F. Wholesale Residential Assistance Program Participation Agreement. Authorize the Supervisor to sign the agreement to participate in the WRAP Program. G. Approve Teamsters Local 214 Technical Unit Contract. Approve the new contract for 2018 and 2019 and authorize the Supervisor to sign on behalf of the Township, pending final review from our Labor Attorney and Human Resources. H. Establish Target Shooting Ordinance Ad-Hoc Committee. Appoint the Target Shooting Ordinance Ad-Hoc Committee, as proposed. I. Hire Park Superintendent. Hire David Raftery as Parks Superintendent, a non-union position at $27.00 per hour, full-time, 40 hours per week, full benefits, effective February 6, 2018, and authorized the posting and filling of the now vacant Park Maintenance Worker position. J. Sign Fee Waiver Request: King of Kings Lutheran Church. Waive the sign permit fee, with the understanding that all other provisions of the sign ordinance remain in effect. Moved by Clerk Shults, seconded by Trustee Flood to approve the Consent Agenda, as presented. AYES: Barnett, Shults, Steele, Birney, Flood, Sliwinski, Steimel ABSENT: None NAYS: None MOTION CARRIED 9. PENDING BUSINESS A. Sale of Properties: 313 Brown Road, 200 Casemer Road, and 2586 Holland Street. MOTION AMENDED Moved by Clerk Shults, seconded by Trustee Steimel to approve the offer to purchase 200 Casemer Road for $49,000.00, as presented, contingent upon attorney review, and authorize the Supervisor to sign on behalf of the Township. AYES: Steele, Birney, Flood, Sliwinski, Steimel, Barnett, Shults ABSENT: None NAYS: None MOTION CARRIED Moved by Treasurer Steele to authorize the Building Department to obtain quotes on the cost to repair the property, along with an estimate of the market value of the property at 2586 Holland . MOTION FAILED MOTION AMENDED - Moved by Clerk Shults, seconded by Trustee Birney to authorize the Supervisor and the Realtor to research the value of 2586 Holland, and bring this back to the Board for consideration. MOTION AMENDED – Moved by Clerk Shults, seconded by Trustee Birney to authorize the Supervisor and the Realtor to list the property at 2586 Holland for $100,000.00. MOTION CARRIED Regarding the offer to purchase 313 Brown Road, moved by Supervisor Barnett, seconded by Clerk Shults to counter offer of $500,000.00 for the sale of 313 Brown Road. MOTION CARRIED B. Parks and Recreation Millage Discussion. Moved by Supervisor Barnett, seconded by Clerk Shults to appoint the following people to the Parks and Recreation Millage Ad-Hoc Committee: Trustee Birney, Supervisor Barnett, Jeff Stout, Aaron Whatley, Taylor Reynolds, Michele Arquette-Palermo, Kevin Gorman, Lee Smith, Leo Trayner, George Sinnott and George Hanley, as proposed. MOTION CARRIED C. Award Bid: Parks and Recreation Master Plan Update. Moved by Clerk Shults, seconded by Trustee Birney to award the 2019-2024 Parks and Recreation and Open Space Master Plan contract to Beckett & Raeder Landscape Architecture Planning, Engineering & Environmental Services for a total cost of $22,505.00. AYES: Birney, Flood, Sliwinski, Steimel, Barnett, Shults, Steele ABSENT: None NAYS: None MOTION CARRIED D. PC-2018-03 Waldon Meadows Site Condo Approval. Moved by Clerk Shults, seconded by Trustee Flood to conditionally approve the creation of a 22-unit site condominium and the associated condominium documents, including the Master Deed, By-Laws, and Exhibit B, for PC-2018-03, Waldon Meadows Site Condominium located at 386 Waldon Road (parcel #09-26- 101-001) based on the conditions of the motion by the Planning Commission at their January 17, 2018 meeting and the approve of the Master Deed, By-Laws, and Exhibit B by the Township Engineer and Attorney. Orion Area Chamber of Commerce Office at the Orion Center Discussion. Moved by Clerk Shults, seconded by Trustee Birney to authorize the Supervisor, Attorney & the Director of Parks and Recreation to draft a lease agreement with Orion Area Chamber of Commerce for $750.00 per month, including utilities for two years and further approve the furniture build at a cost of $18,547.00 and make the necessary budget adjustments and authorize the Supervisor to sign the agreement on behalf of Orion Township, conditioned upon the Chamber Board approval. AYES: Sliwinski, Steimel, Barnett, Shults, Steele, Birney, Flood ABSENT: None NAYS: None MOTION CARRIED 10. REPORTS A. Police/Fire Reports. Moved by Trustee Steimel, seconded by Trustee Birney to receive and file the Police & Fire reports, as presented. MOTION CARRIED B. Fire Station 1 Renovation Update. Moved by Clerk Shults, seconded by Trustee Steimel to receive and file the Fire Station 1 Renovation Update, as presented. MOTION CARRIED C. Fire Chief Vacancy Update. Moved by Clerk Shults, seconded by Trustee Birney to receive and file the Fire Chief Vacancy Update, as presented. MOTION CARRIED 10. PUBLIC COMMENT. Public Comment was not heard. 11. BOARD MEMBER COMMENTS. Board member comments were heard. 12. ADJOURNMENT. Moved by Trustee Flood, seconded by Treasurer Steele to adjourn.
