On March 8, 2018 the Board of Commissioners for Oakland County entered into an agreement per MR #18065 –
Department of Economic Development and Community Affairs – Approval of 2018 NO HAZ Interlcoal Agreement.
As required by Urban Cooperation Act 7 of 1967 - MCL 124.510(4), a copy of the signed agreement with the County of Oakland and the City of Rochester, and the authorizing Board of Commissioners Resolution are enclosed for filing by your
office.

A regularly scheduled meeting of the City Council for the City of Rochester was called to
order at 7:18 p.m. on Monday, January 22, 2018, by Mayor Rob Ray, at 400 Sixth Street,
Rochester, Michigan.
PRESENT: Mayor Rob Ray, Mayor Pro Tem Kim Russell, Councilmembers Dean
Bevacqua, Stuart Bikson, Ben Giovanelli, Ann Peterson and Nancy Salvia.
ABSENT: None.
Mayor Ray led the Pledge of Allegiance.
Mayor Ray opened the meeting for Public Comment. No one addressed Council.
Mayor Ray recognized the City of Rochester winning the broomball game at the Fire and Ice
Festival with the trophy.
Council considered approval of the Minutes of the Regular Meetings held December 18,
2017 (Revised) and January 8, 2018.
Peterson moved, Russell seconded to approve the Minutes of the Regular Meetings held
December 18, 2017 (Revised) and January 8, 2018. YES: Ray, Russell, Bevacqua, Bikson,
Giovanelli, Peterson and Salvia. NO: None. Motion Carried.
Council considered two items on the Consent Agenda. Both items were approved with one
motion.
Peterson moved, Salvia seconded to approve the North Oakland County Household
Hazardous Waste Interlocal Agreement (NOHAZ) with Oakland County and adopt the
Resolution designating Holly Meyers as the City’s Representative. YES: Ray, Russell,
Bevacqua, Bikson, Giovanelli, Peterson and Salvia. NO: None. Motion Carried.
Peterson moved, Salvia seconded to approve the Special Event Permit for Special Olympics
Michigan to hold the Oakland County Polar Plunge on Saturday, February 10, 2018 on
Fourth Street between Water and East Streets. YES: Ray, Russell, Bevacqua, Bikson,
Giovanelli, Peterson and Salvia. NO: None. Motion Carried.

Mayor Ray announced there were no Old Business/Tables Items scheduled this evening.
Council held a Public Hearing regarding new legislation regulating the use of electric bikes
on trails.
Mayor Ray opened the Public Hearing at 7:24 p.m.
No one addressed Council.
Mayor Ray closed the Public Hearing at 7:25 p.m.
Russell advised that the Paint Creek Trailway Commission had postponed their Public
Hearing on the issue. She noted that the legislation will go into effect January 28, 2018 and
that there are three classes of electric bikes to consider. The Paint Creek Trailway
Commission is concerned with conflict among riders, bikes and pedestrians and they are
developing an educational outreach. The PCTC is recommending nothing be done for now
and wait and see.
Council considered a Resolution declaring April 27, 2018 Arbor Day in Rochester. The City
will celebrate with a tree planting in Mount Avon Cemetery.
Giovanelli moved, Peterson seconded to adopt the Resolution declaring April 27, 2018
Arbor Day in Rochester. YES: Ray, Russell, Bevacqua, Bikson, Giovanelli, Peterson and
Salvia. NO: None. Motion Carried.
Council considered a request from the resident at 754 Elizabeth (East side of street) for a no
parking zone between 722 and 754 Elizabeth Street. Police Chief Schettenhelm met with the
resident and requested that she draft a petition to seek signatures of the residents directly
affected. Of the eight properties affected, five were in favor of the request.
Council discussed with Chief Schettenhelm the parking/no parking on the west side of
Elizabeth Street. Chief Schettenhelm noted some confusion over a single no parking sign
that has been mistaken to mean the entire west side of the street, which it does not.
Julie Morse, 754 Elizabeth, answered questions regarding the request.
Giovanelli moved, Russell seconded to approve the request for a no parking zone between
722 and 754 Elizabeth and authorize the removal of the one no parking sign on the west side
of the street and to have Administration report back in one year. YES: Ray, Russell,
Bevacqua, Bikson, Giovanelli, Peterson and Salvia. NO: None. Motion Carried.
Council considered Mayoral appointments to the Cemetery Advisory Board.
Giovanelli moved, Peterson seconded to confirm the Mayoral appointments to the Cemetery
Advisory Board of Andrew Pixley, Tammy Byers, Jack DiFranco, Didrik Krogh, Tracy
Picmann, for terms expiring May 31, 2019 and Councilmember Bevacqua as Liaison. YES:

Carried.
Council considered the recommendation of the Compensation Commission to change
Council’s pay to $70/Mayor; $65/Mayor Pro Tem and $60/Council for up to 24 meetings
per year.
Russell moved, Salvia seconded to accept the Compensation Commission’s recommendation
to change Council’s pay to $70/Mayor; $65/Mayor Pro Tem and $60/Council for up to 24
meetings per year. YES: Ray, Russell, Bevacqua, Bikson, Giovanelli, Peterson and Salvia.
NO: None. Motion Carried.
City Manager Wing presented Council with a list of items that Council had requested be
considered at Goals and Objectives throughout the year. Russell requested that the bridge
on the Paint Creek Trail be added. As Manager Wing discussed the items, Councilmember
Giovanelli recommended that only items of monetary nature that affect the budget be
considered at Goals and Objectives and noted that many of these items could be considered
at Regular Council meetings. Peterson suggested that the items be considered in the first
quarter of the year.
Peterson gave Council an update on the Downtown Development Authority saying they had
held their Goals and Objectives budget meeting.
Russell gave Council an update on the Principal Shopping District saying they also had held
their Goals and Objectives budget meeting.
Russell gave Council an update on the Paint Creek Trailway Commission saying that the
bridge work would begin in May and the trail would be closed at that point for six weeks.
She said they also discussed encroachments on their easements, grants for the iron bell
signage and bids for a piece of the Clinton River Trail.
Bikson gave Council an update on the Older Persons’ Commission saying they are working
on a study regarding the donated property to the east of the north parking lot.
City Manager Wing reviewed miscellaneous items regarding the Fire and Ice Festival,
pothole patching and two construction projects.
Bikson thanked Lieutenant Paul Matynka for his years of service to the City upon his
retirement.
City Manager Wing reminded all of the Goals and Objectives budget meeting scheduled for
Saturday, February 10 at 8:30 a.m. at the Fire Department. Russell requested a budget
meeting schedule.
Salvia commented on the Sustainability Impact event scheduled for February 28 at 7:00 p.m.
at the Royal Park Hotel, she noted she attended MML training and noted that a review of
the OPC travel program had been reviewed in 2012.

Giovanelli requested an excused absence from the meeting of January 8, 2018.
Peterson moved, Russell seconded to grant Councilmember Giovanelli an excused absence
for January 8, 2018. YES: Ray, Russell, Bevacqua, Bikson, Giovanelli, Peterson and Ray.
NO: None. Motion Carried.
Peterson commented on the Paint Creek Center for the Arts photography exhibit.
Russell commented that the City newsletter was awesome.
Mayor Ray congratulated the Fire and Ice Festival. He also congratulated Lt. Matynka on his
retirement. He announced the Polar Plunge special event for Saturday, February 10.
Giovanelli asked about enforcement of commercial vehicles parking on streets.
Council considered a request to go into Closed Session to discuss Pending Litigation.
Russell moved, Giovanelli seconded to authorize to go into Closed Session to discuss
Pending Litigation without intent to return to open session. YES: Ray, Russell, Bevacqua,
Bikson, Giovanelli, Peterson, Salvia. NO: None. Motion Carried.
Mayor Ray adjourned the meeting at 9:05 p.m.
