Misc. 5094 By Mr, Perinoff IN RE: PUBLIC HEALTH LEGISLATION To the Oakland County Bcard of Supervisors MR. CHAIRMAN, LADIES CENTLFMEN: WHEREAS, tha :.oslative Committee has received the report of Dr. Bernard Berman, Director of the Oakland County Health Department, relative to legislation of interest to the County, and WHEREAS, the Committee having studied such proposed legislation, recommends that the Oakland County Board of Supervisors support: House Bill 2146 which increases state grants to public health services to 35 per person; Senate Bill 162 which provides for immunization by public health nurses without supervision of a doctor; House Bill 2718 amendments to the Medical Examiner Act, which requires Boards of Supervisors to abolish the office of Coroner in all counties and contains provisions which would make it permissive rather than mandatory for the medical examiner to appear at the scene relative to handling of bodies, and further provides that inquests be held before the District or Municipal Court; House Bill 2850 which requires the teaching, in the sixth grade, of the effect of narcotics and other drugs; and WHEREAS, your Committee further recommends that the Board of Supervisors oppose: Senate Bill 560 which would impose civil liability on public health officers for gross negligence only; NOW THEREFORE BE IT RESOLVED that this Board accept the above recommendations relative to the support and opposition of certain public health legislation of interest to the County. June 5, 1969 of cost and period of usefulness thereof, prepared by Johnson G Anderson, Inc., registered professional engineers, all of which have been approved by the Board of Public Works; NOW, THEREFORE, BE IT RESOLVED that the Chairman and Secretary of the Board of Public Works be and they are hereby authorized and directed to execute and deliver on behalf of said County of Oakland, the Contract to be dated April 1, 1969, between the County of Oakland and the Charter Township of Waterford which reads as follows: CONTRACT CLINT6N-OAKLAND SEWAGE DISPOSAL SYSTEM - WATERFORD EXTENSIONS THIS CONTRACT made this 1st day of April, 1969 by and between the COUNTY OF OAKLAND, a Michigan county corporation (hereinafter called the "county"), by and through its Board of Public Works (herein- after referred to as the "board"), party of the first part, and the TOWNSHIP OF WATERFORD, a Charter township corporation in the County of Oakland (hereinafter called the "municipality"), party of the second part: W1TNESSET H: WHEREAS the Oakland County Board of Supervisors by Resolution, Misc. No. 4342, adopted on June 22, 1964 did approve of establishment of the Clinton-Oakland Sewage Disposal System to serve the Clinton- Oakland Sewage Disposal District, within which district lies all of the Township of Waterford; and WHEREAS Act No. 185 of the Michigan Public Acts of 1957, as amended, grants to the board of public works in any county having a department of public works, the power to acquire sewage disposal systems as defined in said Act and to improve, enlarge and extend any system acquired pursuant thereto, and WHEREAS the County of Oakland, through its Board of Public Works, is acquiring and constructing the said Clinton-Oakland Sewage Disposal System pursuant to the Amended Clinton-Oakland Sewage Disposal System Contract, dated January 11, 1968, between the County of Oakland and the Charter Township of Waterford, the Township of Avon, the Township of West Bloomfield, the Township of Independence, the Township of Orion, and the Township of Pontiac, (said contract hereinafter referred to as the "Base Contract"); and WHEREAS by the terms of said Act No. 185 the county and the municipality are authorized to enter into a contract for the acquisition, improvement, enlargement or extension of a sewage disposal system and for the payment of the cost thereof by the municipality with interest, over a period not exceeding forty (40) years, and the county is then authorized, pursuant to appropriate action of its Board of Supervisors, to issue its bonds to provide the funds therefor, secured by the full faith and credit contractual obligation of the municipality, and upon affirmative vote of three-fifths (3/5) of the members elect of the Board of Supervisors, by the full faith and credit pledge of the county; and WHEREAS it is now necessary for the public health and welfare of the present and future residents of the municipality to extend, improve and enlarge the said Clinton-Oakland Sewage Disposal System in the Charter Township of Waterford by the acquisition and construction of the so-called Waterford Extensions under the provisions of said Act No. 185 and to issue one or more series of county bonds to finance said Waterford Extensions in anticipation of the collection by the county of amounts to become due from the municipality under this contract between the county and the municipality; and WHEREAS no other municipality in the Clinton-Oakland Sewage Disposal District will be affected by the construction of said Waterford Extensions; and WHEREAS in order to issue such bonds, it is necessary that the county and the municipality enter into this contract; and WHEREAS the Oakland County Department of Public Works (hereinafter sometimes referred to as the "DPW") has obtained preliminary plans and cost estimates for the acquisition and construction of said Waterford Extensions, prepared by Johnson & Anderson, Inc., registered professional engineers (hereinafter sometimes referred to as the "consulting engineers") which preliminary plans and cost estimates anticipate the acquisition and the construction of said Waterford Extensions will be accomplished in three phases in accordance with the hereinafter stated provisions of this contract; NOW, THEREFORE, in consideration of the premises and the covenants of each other, the parties hereto agree as follows: 1. The county and the municipality hereby approve the extension, improvement and enlargement of the Clinton-Oakland Sewage Disposal System by the acquisition and construction of sewage disposal faciiities to serve the Charter Township of Waterford, under and pursuant to the provisions of Act No. 185 of the Michigan Public Acts of 1957, as amended. The sewage disposal facilities to be acquired and constructed are hereby designated the "Clinton-Oakland Sewage Disposal System - Waterford Extensions" and are hereinafter sometimes referred to as the "Waterford Extensions". 2. The facilities constituting the Waterford Extensions and their general location within the municipality are shown on Exhibit A which is attached hereto and by this reference is made a part hereof. The said facilities will be acquired in three phases by the county and the general location of each phase is also indicated on said Exhibit A. The three phases of the Clinton-Oakland Sewage Disposal System - Waterford Extensions are hereinafter sometimes referred to collectively as the "project". 3. The county and the municipality hereby approve and adopt the estimate of the total cost of the project in the amount set forth on Exhibit B attached hereto, and the estimate of 50 years and upwards as the period of usefulness of the project, all as prepared by the consulting engineers, 4. Misc. 5101 By Mr. Crba IN RE: OBSERVANCE OF CERTAIN HOLIDAYS ON MONDAY To the Oakland County Board of Supervisors Mr, Chairman, Ladies and Gentlemen: WHEREAS the State has enacted into law a bill to provide for the observance of certain holidays on Monday, and WHEREAS the observance of these holidays on Monday will create more three-day weekends thus increasing the opportunity of our citizens to enjoy mini-vacations, and WHEREAS this meaure and its observance by the County of Oakland will increase the morale and well-being of its employees, NOW THEREFORE BE IT RESOLVED that the Board of Supervisors commends the Legislature of the State of Michigan and the Governor for enacting this law, and BE IT FURTHER RESOLVED that the Board of Supervisors directs compliance with its provisions by all County departments when possible and consistent with the efficient and effective operation of County government. Misc, 5102 By Mr. Grba IN RE: APPEAL OF ALLOCATION BOARD'S RULING To the Oakland County Board of Supervisors Mr. Chairman, Ladies and Gentlemen: The Tax Allocation Board has set the County's share of the ad valorem Lax of 15 mills at 5,16 mills and this is the second time we have suffered a set-back from the Allocation Board in a time of rising cost and additional responsibilities. WHEREAS this will cost the County a great deal of money and effect an austerity program; and WHEREAS the Tax Allocation Board is a non-elected group and is proposing to place on the ballot an increase in the 15 mill limitation to 18 mills and the Allocation Board would be discontinued and the allocations would be fixed by law; WHEREAS to prevent the public from misunderstanding this issue, that the Board of Supervisors and the Tax Allocation Board are distinct entities; NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Supervisors go on record to appeal the Tax Allocation Board's ruling to the State government to reconsider this matter and increase the County's share to its previous amount (5.28 mills) for 1969.
