HomeMy WebLinkAboutResolutions - 2007.09.20 - 9382September 20, 2007 MISCELLANEOUS RESOLUTION 107226 BY: PUBLIC SERVICES COMMITTEE, JEFF P'OT.7ER CHAIRPERSON IN RE: CRIMINAL JUSTICE COORDINATING COUNCIL - PILOT TETHERING PROGRAM FOR OAKLAND COUNTY JAIL INMATES TO THE OAKLAND COUNTY BOARD OF COMYISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS Oakland County has experienced jail overcrowding problems for the last several years most recently resulting In several Court ordered early releases, and WHEREAS in 2006 the Oakland County Board of Commissioners created the Criminal Justice Coordinating Council (C5CC to plan, develop and imple ment innovative programs to alleviate jail overcrowding, and WHEREAS in spite of the continued co-operation between the Courts, Sheriff's Office, Prosecuting Attorney and Community Corrections, jail overcrowd i ng is an on-going problem, and WHEREAS technology advances in a'S tethers and b:,ometric identification have resulted in reliable tools for monitoring :,he mcvements of defendants fitted with these devices, and WHEREAS tethering defendants prior to release from jail has proven to be an effective tool for monitoring their whereabo—s and enforcing the conditions of release, and WHEREAS the cost per day to house an inmate at Oakland County Jail is in excess of $96 per day, and WHEREAS it may be cost effective to subsidize defendants participation in tethering or other monitoring programs in liuoof jail, and WHEREAS the Criminal Justice Coordinating Council supports a six month pilot program to study the impact that subsidized or reduced cost monitoring would have on jail overcrowding. NOW THEREFORE BE IT RESOLVED that the Oakland County Hoard of Commissioners authorize a six month pilot program in the 6'' Circuit Court, 51'' District Court, the 52 1 District Court First Division, and any other District Court interested in participating in subsidized or reduced cost custody monitoring in lieu of all time, utilizing tethers or biometric identification technology for inmates who meet eligibility requirements. BE IT FURTHER RESOLVED that :he Oakland County Board of Commissioners adopts the attached eligibility criteria (subec'J to revisions approved by the Chief Circuit Court Judge) developed by the Oakland Co u nty SnerLff's Office targeting existing sentenced PA 511 eligible and trusty inmate populations (trusty status for at least ;1 of their sentence) who have served at least 50; of their sentence. BE IT FURTHER RESOLVED that nretrial inmates with a cumulative bond of $1,000 or less, subject to the same charge re:i--irements, are eligible for participation in the p5 Lot tether or other monitoring program. BE IT FURTHER RESOLVED the rllot program is intendod to serve an average of thirty inmates per month and the cost is not to exceed $15C,00C. BE IT FURTHER RESOLVED that the Sheriff's Office report the results of the pilot program to the Public Services and Finance Committees at the end of this pilot program. BOUCHARD PILOT TETHERING PROGRAM 8-31-07 Eligibility Criteria - Sentenced inmates on current Trusty status and served at least 1/4 of their sentence as Trusty. - Sentenced PA 511 eligible inmates. - Inmates on pre -trial status with cumulative bonds $1,000 or less. - All Court-ordered jail programs must be completed before eligible for tether release. - Current offense(s) conviction must be non-assaultive felony. {use Offense List per County Jail Emergency Overcrowding Statute} - OUIL III not eligible. - Current offense(s) conviction must be non-assaultive misdemeanor. {Not eligible are: Stalking, Domestic Assault, CSC/Att CSC IV, Sex Offender Registry Violation, Child Abuse, Solicitation of Children for Immoral Purpose} - Served 50% of their jail sentence. - No outstanding warrants or holds. - No pattern of misconducts or institutional behavior problems. 1201 N TELEGRAPH RD H PONTIAC MI 48341-1044 H 2481858-5008 FISCAL NOTE (MISC. 1072.26) September 20, 2007 BY: Finance Committee, Mike Rogers, Chairperson IN RE: CRIMINAL JUSTICE COORDINATING COUNCIL — PILOT TETHERING PROGRAM FOR INDIGENT OAKLAND COUNTY JAIL INMATES. To the Oakland County Board Of Commissioners Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced resolution and finds; 1. The Criminal Justice Coordinating Council (CJCC) proposed a six month pilot program for tethering. 2. Proposed costs for the six month program is $150.000. 3. Funds are available in the General Fund, (GL Account 10100-9010101-196030-371461) Designated Fund Balance to cover the cost. 4. A budget amendment to the Fiscal Year 2007 budget is recommended as follows: GENERAL FUND 10100 FY 2007 Revenue 9010101-196030-665882 Planned Use of Fund Balance $150,000 Expenditure 4030401-113035-730373 Sheriff/Corr/Elect Monitoring/Contr.
