CORRECTIONS — FISCAL YEAR 2008 BYRNE JUSTICE ASSISTANCE GRANT (JAG)
INTERGOVERNMENTAL AGREEMENT AND GRANT APPLICATION
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the Sheriff's Office, Prosecutor's Office, Circuit Court, Community Corrections Division, the
City of Southfield and City of Pontiac wish to apply to the U.S. Department of Justice, Office of Justice
Programs for funding under the Byrne Justice Assistance Grant Program for the period October 1, 2007
through September 30, 2011; and
WHEREAS the grant application requires the adoption of an intergovernmental agreement between the
local units of government; and
WHEREAS an agreement has been drafted (as attached) by the County's Corporation Counsel; and
WHEREAS State statute (MCL 45.556P) states that the Board of Commissioners has the authority to
enter into agreements with other governmental or quasi-governmental entities.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the
attached intergovernmental agreements with the City of Pontiac and the City of Southfield and that the
Board Chairperson, on behalf of the County of Oakland, is authorized to execute said agreement.
BE IT FURTHER RESOLVED that one original intergovernmental agreement be filed with the Michigan
Department of State, Office of the Great Seal.

This intergovernmental Agreement (Agreement) is made between the County of Oakland, a
Constitutional and Municipal Corporation, 1200 N. Telegraph Road, Pontiac, Michigan, 48341
(the County), the City of Pontiac, a Municipal Corporation, 47450 Woodward Avenue, Pontiac,
Michigan 48342 (Pontiac) and the City of Southfield, a Municipal Corporation, 26000 Evergreen
Road, Southfield, MI 48076 (Southfield). In this Agreement, the County, Pontiac and Southfield
may be referred to individually as."Party" or jointly as "Parties."
In consideration of the mutual promises, obligations, representations and assurances in this
Agreement, the Parties agree as follows:
I. Purpose of Agreement
The Parties to this Agreement are jurisdictions that have been, are, or may be
certified as disparate by the Bureau of Justice Assistance (BJA) Edward Byrne
Justice Assistance Grant (JAG) Program. By entering into this Agreement, the
Parties acknowledge their intention to submit a joint application for the aggregate
JAG Program funds that may be available to them in FY 2008, or, at the Parties'
discretion, to submit a joint 'application in any year through 2012 in which the
JAG Program requires a joint grant application. In any grant application required
by the JAG Program, the Parties will specify the amount of funds that are to be
distributed to each of them and the purposes for which the funds. will be used.
2. Definitions
2.1. "Oakland County (County)," "City of Pontiac (Pontiac)" and "City of
Southfield (Southfield)" each shall be defined to include any and all
departments, divisions, commissioners, elected and appointed officials, directors,
board members, council members, commissioners, authorities, committees,
employees, agents, subcontractors, volunteers and/or any such persons successors
of the referenced governmental entity or unit ("Agents").
2.2. "Bureau of Justice Assistance (BJA) Edward Byrne Justice Assistance Grant
(JAG) Program" means the grant program of the U.S. Department of Justice,
Office of Justice Programs, Bureau of Justice Assistance, by which Federal funds
are made available to support all components of the criminal justice system, from
multi-jurisdictional drug and 'gang task forces to crime prevention and domestic

violence programs, courts, corrections, treatment, and justice information sharing
initiatives, as further and more fully defined in the grant application and other
grant information.
3. Terms
3.1. The Parties agree that any and all funds granted pursuant to their joint grant
application will be used only for equipment or in a manner that will serve the
purposes defined in the grant.
32. The County agrees to act as fiduciary for any funds granted to the Parties pursuant
to their joint grant application.

3.3. The County agrees that it will complete reports and provide other information
required in order to fulfill grant requirements.
3.4. Southfield and Pontiac agree to comply with the County's repotting and fiscal
management policies to the extent necessary to provide required information to-
the Department of Justice regarding use of any funds granted to them and to
provide any other information required pursuant to the grant application and/or
grant agreement.
3.5. If grant funds are provided to purchase equipment, the County agrees to procure
and pay for the agreed-upon equipment, in an amount not to exceed the grant
funds allocated to each Party, according to the County's purchasing and financial
management policies and procedures.
3.6. All equipment purchased with grant funds will be delivered to the individual
requesting Party. Title to each ordered item, unless otherwise required by the
conditions of the grant, will transfer to and vest in the requesting Party upon
delivery. The requesting Party assumes all responsibility and liability for
• inspecting and accepting ordered equipment and for the future management,
maintenance, and care of the equipment, including obtaining and -maintaining any
insurance that is required by the -Party's own policies and/or the terms and
conditions of the grant agreement If the grant agreement requires an accounting
of any sort or the return of equipment acquired with grant funds, each Party
• assumes full responsibility for meeting those requirements for equipment acquired
with grant funds that were allocated to it.
3.7. Southfield and Pontiac will notify the County's Grant Manager upon acceptance
of equipment. The County's Grant Manager will authorize payment according to
the Counts policies an .
3.8. If problems with equipment arise, the Parties will coordinate their
communication, strategies and other actions to correct the problems.

recessions, waivers, or releases to this Agreement must be in writing and agreed
to by the Parties.
3.18. Entire Agreement. This Agreement.represents the entire Agreement between the
Parties and supercedes all other Agreements between the Parties governing the
matters described here. The language of this Agreement shall be construed as a
whole according to its fair meaning, and not construed strictly for or against any
Party.
3.19. The Parties have taken all actiOns and secured all approvals necessary to authorize
and complete this Agreement. The persons signing this.Agreement on behalf of
each Party have legal authority to sign this Agreement and bind the Parties to the
teams and conditions contained here.

Agreement, pursuant to the requirements of the Edward Byrne Justice Assistance Grant (JAG)

CORRECTIONS - FY 2008 BYRNE JUSTICE ASSISTANCE GRANT (JAG) INTERGOVERNMENTAL
AGREEMENT AND GRANT APPLICATION
The Fiscal Services Division has reviewed the above referenced grant
application and finds:
1) This is the 4th year of grant application with the U.S.
Department of Justice, Office of Justice Programs. The grant
provides funding to purchase equipment and supplies for law
enforcement purposes.
2) The grant period is October 1, 2007 through September 30, 2011,
3) The funding requested equals $98,869. Oakland County will
receive $17,623 and the City of Pontiac will receive $44,058 and
the City of Southfield $36,988. No local match is required.
4) The grant application requires the adoption of an
intergovernmental agreement between the County and City of
Pontiac and between the County and the City of Southfield.
5) Application and acceptance of this grant program does not
obligate the county to any future commitment and continuation of
the grant program is contingent upon continued future levels of
grant program funding.

Archeological and Historical Preservation Act of 1.974 (16 U.S.C. § 469 a-1 et seq.), and the National Environmental
Policy Act of 1969 (42 U.S.C-. § 4321).
6. It will comply (and will require any subgrantees or contractors to comply) with any applicable statutorily-imposed
nondiscrimination requirements, which may include the Omnibus Crime Control and Safe Streets Act of 1968(42
U.S.C. § 3789d); the Victims of Crime Act (42 U.S.C. § 10604(e)); The Juvenile Justice and Delinquency Prevention -
Act of 2002 (42 U.S.C. § 5672(b)); the Civil Rights Act of 1964 (42 U.S.C. § 2000d); the Rehabilitation Act of 1973 (29
U.S.C. § 7 94); the Americans with Disabilities Act of 1990 (42 U.S.C. § 12131-34); the Education Amendments of 1972

of the Rehabilitation Act of 1973, as amended; or

Project: City of Pontiac — Taser Acquisition
The Pontiac Police Department is seeking to acquire Tasers for our sworn personnel. The
tasers have been shown to be a reliable non-lethal compliance/control measure.
Acquiring the tasers will supplement previously purchased tasers, and allow us to provide
all of our officers with an additional safety tool.
Project: City of Pontiac — Dispatch Center Upgrade
The Pontiac Police Department is seeking to upgrade our dispatching center. This will
include replacing chairs, lighting, and flooring that is outdated/non-functional. The
upgrades will provide a more professional and safe working area for our personnel to
ensure that quality service will be provided to our citizens as well as police and fire field
personnel.
Project: City of Southfield — Police Records Management
Capital equipment for this project involves the purchase of a mechanical assist movable
shelving system for the systematic filing of police arrest and complaint records located in
the police records bureau. The current filing shelves are beyond maximum capacity and
do not provide any security features to protect personal information contained within the
records. The proposed system allows for a 31% growth capacity and can be locked to
secure and control the documents and their related personal information.
Project: City of Southfield — Employee and Visitor Identification System
Capital equipment for this project involves the purchase of employee identification
systems for City of Southfield (MI) public safety, municipal workers, contractors and
visitors. The present systems are out of warranty and have been in need of costly repairs.
A service contract is not cost effective given the age of the system. The proposed
solutions include a secure software management program which integrates with the
controlled access system located within the police building and select municipal
departments. The identification badges clearly identify the employee or individual and
contain security features to prevent and/or identify fraudulent handling or use.
Project: County of Oakland — Prosecutor's Office Equipment Acquisition
Capital equipment for this project will purchase portable projectors for court room use to
display power point presentations during jury trials. These projectors will enable trial
prosecutors to convey and highlight for juries significant portions of testimony, elements
of a crime and scene diagrams.
Project: County of Oakland — Circuit Court Equipment Acquisition
Capital equipment for this project to create a courtroom environment to allow users to
improve the manner in which they can play back court testimony and present evidence.
Project: County of Oakland — Community Corrections Equipment Acquisition
Capital equipment for this project is to purchase a Multi Media LCD Projector to be used
for training and educational purposes for our staff. Currently, there are nearly 60 full
time and approximately 20 part time employees at Community Corrections. Ongoing
training re: changing laws, methods, policies and procedures,iwitical_to maintain a
professional work staff. Additionally, training is offeif tilaS Ore'red to court personnel
and other partners in our efforts to reduce jail overcrowding. The Multi Media LCD
Projector is necessary in order to access and use the most modern training materials
available to reach our target audiences. Additional funds are necessary to purchase four
(3) AlcoSensor 3 PBT machines. These units are used in our RESULTS drug testing
unit, our Step Forward day reporting unit and our WWAM unit to test individuals for
alcohol use.
Project: County of Oakland — Sheriffs Office Digital Recording Systems
The Oakland County Sheriffs Office is in the process of renovating the Main Jail.
During this process we are constructing three new interview rooms, a line up room, and a
polygraph room. The JAG funds will pay for a digital recording system for each room.
These rooms will be used by the Oakland County Sheriffs Office, the Oakland County
Prosecutors Office, and any Law enforcement agency who may wish to interview an
inmate.

Governing Body Review and Public Opportunity to Comment
On June 6, 2008 — Notification was sent to eligible County Departments, the City of
Pontiac and the City of Southfield of an internal meeting held June 11, 2008 to discuss
internal allocations.
On June 6, 2008 — Electronic mail was sent as part of an "Available Grants" notification
to County Department heads and County Commissioners.
On June 20, 2008 — The application was sent to the Oakland County internal executive
review committee. Comments/approvals were returned by June 27, 2008.
On July 2, 2008 — the completed application was forwarded to the State Administrative
Agency for regional planning agency review under Executive Order 12372.
On July 17, 2008 — The Oakland County Board of Commissioners, as part of their
regularly scheduled meeting, will conduct a public hearing for the purpose of soliciting
comments and input from the public regarding use of the grant funds. A copy of the
complete application will be made available to the full Board.

INTERGOVERNMENTAL AGREEMENT AND GRANT APPLICATION
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
Pursuant to Rule Xll-C of this Board, the Finance Committee has reviewed the above referenced
resolution and finds:
1. The grant application requires the adoption of an intergovernmental agreement between the
local units of government applying for this grant.
2. The State statute (MCL) 45.556P) states that the Board of Commissioners has the authority
to enter into agreements with other governmental or quasi-governmental entities.
3. An intergovernmental agreement will be between Oakland County and the City of Pontiac as
part of the application requirements for the Byrne Justice Assistance Grant Program for the
period October 1, 2007, through September 30, 2011.
4. This intergovernmental agreement will be between Oakland County and the City of Southfield
as part of the application requirements for the Byrne Justice Assistance Grant Program for
the period October 1, 2007, through September 30, 2011.
5. The grant application is for $98,869 of which Oakland County is expected to receive $17,823,
the City of Pontiac is expected to receive $44,058 and the City of Southfield is expected to
receive $36,988. No local match is required.
6. Total funding of $98,869 will be given to Oakland County to acquire equipment for the City of
Pontiac Police Department, for the City of Southfield Police Department, the Oakland County
Sheriff's Office, Prosecutor's Office, Circuit Court, and Community Corrections. All
equipment purchased with the grant funds will then be delivered to the individual requesting
party.
7. Title to the equipment, unless otherwise required by the conditions of the grant, will transfer
to the requesting party upon delivery.
