HomeMy WebLinkAboutResolutions - 2008.05.22 - 9548• MISCELLANEOUS RESOLUTION 108092 May 22, 2008 BY: FINANCE COMMITTEE, MIKE ROGERS, CHAIRPERSON IN RE: BOARD OF COMMISSIONERS - SUPPORT FOR CONGRESSIONAL HOUSE BILL RR-1023 AND U. S. SENATE BILL 5-777 REPEALING AN UNFUNDED MANDATE TO THE OAKLAND COUNTY LICART. OF COMMISSIONERS Chairperson, Ladies and Cent:men: WHEREAS Section '311 of P,MliC Law 109-222 (HR-429) requires that the "Government of the '...7nited States, every tate, every political subdivision thereof, and every instrumentality of the foregoing making any payment to any person providing any property or services shall deduct and withhold from. 6',1Ch payment a tax in an amount equal to 3 percent of such payment;" and WHEREAS a significant proportion of the more than 40,000 vouchers a year that Oakland County processes for "property or services" are to such "persons" (vendors); and WHEREAS for the County's financial / procurement system to accommodate the "3 Percent" tax, and to upuste the vendor master files, an initial cost of between $100,C00 and $]';-0,'C, is anticipated; and WHEREAS the annual costs to administer and remit the "3 percent" tax would range from $1A),•00 to $25,000 in personnel time; and WHEREAS the "3 porceht" tax is likely to impact the prices for goods and services from vendors, annual parchase cost increases may range from $400,303 to !_?C 'OCCI; and WHEREAS thousands of local governments across the country would be incurring simile:: costs to accommodate this unfunded mandate at a time when revenues are declining and other cos7s are escalating; and WHEREAS Public Law 19-222 HR-4231 provides no corresponding compensation to said governments for processin and remitting such tax, and thus is an unfunded mandate; and WHEREAS Section 511 of Public Law 109-222 :1 -R-4297) will become effective on January I, 2012, and would apply to governments making payments to such "persons" Ovendors) of million or more, which includes Oakland County; and WHEREAS the 110" Congress has introduted two bills (HR-1323 and S-777) to repeal Section lii of Public Law 109-222; NOW THEREFORE EL IT RESOLVED that the Oakland County Board of Commissioners supports such a repeal and encourages its Congressional members and United State Senators to vote in favor of HR-1023 and S-717. BE IT FURTHER RESOLVED that the Oakland :2cunty Clerk is directed to send a copy of this resolution to :11 T.S. Senators and Representatives represent:int; Michigan.
