MISCELLANEOUS RESOLUTION #08252

IN RE: SHERIFF'S OFFICE — ADDITION OF K-9 DOG AND DONATION OF
S5,00 FROM MILK BONE CORPORATION
WHERFAS Deputy I.ocher 7 s current canine, Rocko, is ready to retire after
faithfully serving the citizens of Oakland County in his role as a police canine for nearly
9 years; and
WHEREAS Deputy Locher has agreed to continue in her capacity as a k-9
handier; and
Whereas the Sheriff has agreed to continue Deputy Locher in her capacity as a k-9
handler; and
WHEREAS the Sheriff would like to use forfeiture funds to purchase a
replacement dog; and
WHERFAS-the Sheriff has agreed to purchase "Yeager" a fully trained k-9 dog
from our current vendor; and
WHEREAS Deputy Locher has agreed to.accept Yeager as her k-.9 partner; and
WHEREAS the cost to purchase Yeager is $6,500, but the Milk Bone Corporation
has donated $5,000 for this purchase, therefore only $1,500 will be necessary from the
forfeiture account; and
WHEREAS this matter has been reviewed by Corporation Counsel and a Canine
Program and Agreement is attached.
NOW THEREFORE HE IT RESOLVED that the Oakland County Board of
Commissioners approves using $ ,500 n forfeiture fonds to purchase Yeager.
Chairperson, on behalf of the Public Services Committee, 1 move adoption of the
foregoing resolution.

CANINE PROGRAM AND AGREEMENT
The County of Oakland ("County") and the Oakland County Sheriffs Department
("Department") have established a Canine Program and, after negotiations with the
Oakland County Deputy Sheriff's Association ("Union"), have agreed upon the work
hours, reimbursement and other conditions for the Canine Program.
Canine Program and Policy:
Canine duty is voluntary and participation in the Canine Program is considered to
be a privilege. Deputies seeking assignment to the Canine Program should have a love of
animals and be dedicated to the care, training and well-being of the canine assigned to
them. The home environment for the canine should be one where the canine will be
treated well by family members who want the canine to be part of the home environment.
The County reserves the right to inspect any non-residential structure used exclusively for
canine housing to ensure proper care and maintenance.
Participation in the Oakland County Sheriff's Department Canine Program must
be carefully considered by the individual seeking the assignment. It requires
commitment by the employee and an investment by the County and the Department in
terms of cost and training time. In addition, once a canine is bonded to a Deputy,
changes are difficult to make and costly in terms of training time and reacclamation for
the canine. Once voluntarily applied for and assigned to the Canine Unit, employees
cannot be reassigned without the express permission of the Sheriff. Except as provided
herein, the County andior the Department may change the Canine Program from time-to-
time as they believe necessary. Assignment to the Canine Unit will be excluded from the
provisions of the Collective Bargaining Agreement with reference to shift/location
preference. However, seniority within the Canine Unit will apply the same as the
Collective Bargaining Agreement for shift/location preference within the Canine Unit.
Canine Unit Assignment:
Assignment to and removal from the Canine Unit is at the sole discretion of the
Sheriff The Sheriff shall select among M.C.O.L.E.S. certified Deputy II for this
assignment. The Deputy who accepts assignment into the Canine , Program will, in
addition to departmental duties and 'raining, maintain their canine at their home during
non-duty hours and will transport the canine to and from work as required in a marked
patrol unit provided by the Department. They will also care for the canine including
feeding, grooming, veterinary care and all related matters for the nourishment, care and
well-being of the canine.
Work Hours for Deputies Partieipatin(4 in the Canine Program
The County, tile Department, and the Union have met and have negotiated
concerning earline duty and the amount of off-duty time required per week for the care,
feeding, maintenance and veterinary ogre. of the canine, After reviewing the pertinent
facts, the County, the Department. and the Union acknowledge that in some weeks. more
or less time will be required for canine care than other weeks and that due to the varying
time requirements fov canine care and the fact that the Deputy will cure and maintain the
canine at his/her home (which is considered to be a privi:eve and a benefit for the Deputy
and her family), that two and one-half (2 l/.2) hours pe7 . week is a fair and reasonable
allotment of the required time and fair compensation for the feeding, care, veterinary care
and other related maintenance for the canine. Deputies shall not receive additional
compensation, daily overtime,. or weekly overtime for the feeding, care„ veterinary cure,
or maintenance of the canine. The Union hereby waives any daily overtime provision in
the Labor Contract and/or the Merit System Rules in regard to the feeding, care,
veterinary care, and maintenance of the canine.
Accordingly, the normal work week for Deputies assigned to canine duty shall be
37 'A hours of Departmental work per week and 2 4.1 hour::: pet week designated for the
feeding, care, teterinary care ano other maintenance of the canine during off-duty hours,
The Deputy's daily and wee l,:,1 , overtime payments shall be based on a 7 hour
Departmental worl. day and 37 hoc: Departmental work week. Overtime shall be paid
only for Departmental work (eparatc . and apart from the transportation, feeding, care,
veterinary care and other maintenance related to the canine). During vacation weeks or at
other times when the canne is boarded. the Deputy's waves shall not be reduced below
40 hours per week because the canine is being boarded at a kennel during that time.
The I*Duty understands that since this o:-dun work is done at home, the
Department has no means of dctermininv how much time is spent for the canine. The
Deputy further understands and ati.rees that he/she is to limit the off-duty time he/she
expends for the canine to two and one-half (2 V:2) hours per week. The Deputy Oiall oot
expend additional time without the wrinen permission of the Sheriff
Cost of Boarittirpr. Food.. Eouipment and Other Related Canine Care:
The cost of food. veterinary care. groominv._ boarding where necessaty,
equipment, and other related items for the canine. shall be paid by the County. Food,
veterinary care, grooniint:„ boarding_ equipment and other necessities for the canine shali
be obtained from vendors desi!mateci by the County. In the event the Deputy expends
his/her funds for the canine, the Penury shall be reimbursed upon presentation of
documentation satisfactory to the County.
Ap @roved Leave:
Deputies who are on annual leave or other approved leave., but who continue to
care for the canine, will only be charged seven and one-half (7 IA) hours from their
appropriate leave bank each day. this time To be paid by the County to the deputy per the
Merit System.
Non-County Related 'Use of Canine Prohibited:
The canine is the property of Oakland Co:July. The canine may only be used for
County or Departmental purposes and during non-daty hours may be a pet at the
Deputy's home. The canine shall not appear in or be used in any show, event.
performance, advertisement or sitniar activity withom the written consent of the Sheriff.

understand thal I will not be compensated for any additional off-duty time and that I may
spend with my assigned caninc ar home, traveling and from work, feeding, care,
veterinary care, maintenance, and all tune:: related rnaucrs without the prior written
authorization and approval froni the Sheriff.

CORPORATION
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced
resolution and finds:
1. Due to the retirement of "Rocke, the Sheriff's Departments Canine unit is in need of an
additional trained K-9.
2. The Sheriff has agreed to purchase a fully trained K-9 dog "Yeager" from our current
vendor at a cost of $6,500
3. The Milk Bone Corporation has donated $5,000 for this purchase and the balance of the
funding of $1,500 is available in the Sheriffs forfeiture account 10100-4030101-112580-
222430 Law Enforcement Enhancement Funds.
4. The County agrees to accept this donation, and funding for the Canine unit is included in
the FY 2009 and FY 2010 Adapted Budget.
5. A budget amendment is recommended to the FY 2009 budget as follows:
