Middleton, Chairperson RE: Sheriff's Office — Fiscal Year 2009 Secondary Road Patrol and Traffic Accident Prevention Program Grant Acceptance TO: Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: The Personnel Committee having reviewed the above referenced Resolution on October 15, 2008 Reports with the recommendation the resolution be adopted. Chairperson, on behalf of the Personnel Committee, I move the acceptance of the foregoing report. Chairperson IN RE: SHERIFF'S OFFICE — FISCAL YEAR 2009 SECONDARY ROAD PATROL AND TRAFFIC ACCIDENT PREVENTION PROGRAM GRANT ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Sheriffs Office applied to the Michigan Department of State Police - Office of Highway Safety Planning for $1,031.998 in grant funding from Public Act 416 to conduct secondary road patrol activities for the period October 1, 2008 through September 30, 2009; and WHEREAS the Michigan Department of State Police - Office of Highway Safety Planning has awarded Oakland County with a grant in the amount of $1,031,998, whicn is a decrease the Fiscal Year 2008 award; and WHEREAS the grant provides funding for six (6) Deputy II positions (#01539, #02572, #02957. #03114, #07501 and #09191) and two (2) Sergeant positions (#07790 and #09982) located in the Patrol Services Division; and WHEREAS due to lack of funding, one (1) Deputy II position (#03324,) is requested to be deleted; and WHEREAS no county match or additional positions are reouired; and WHEREAS the acceptance of this grant does not obligate the County to any future commitment; and WHEREAS the continuation of the program is contingent upon future levels of grant program funding. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the Fiscal Year 2009 Secondary Road Patrol Grant award from the Michigan Department of State Police - Office of Highway Safety Planning in the amount of $1,031,998 and that the Board Chairperson, on behalf of the County of Oakland, is authorized to execute said agreeinent as dttaolied. BE IT FURTHER RESOLVED that one (1) Deputy II position (#03324) be deleted effective October 1, 2008, Chairperson, on behalf of the Public Services Committee,,I move adoption of the foregoing resolution. BOUCHARD August 27, 2008 The following Law Enforcement Plan between the Oakland County Sheriff's Office and the Michigan State Police has been mutually developed for law enforcement in the unincorporated arms of Oakland County pursuant to the requirements of Act 416 of the Public Acts of 1978. TRAFFIC LAW ENFORCEMENT: The Michigan State Police will assume ptitnary responsibility for traffic law enforcement on all U.S. highways, interstate highways, and Michigan highways, which are defined as trunkline highways. The Oakland County Sheriff's Office will assume primary responsibility for traffic law enforcement on all county roads within this county. County roads are all roads not designated as tnmkline highways. Officers of both agencies will take appropriate law enforcement action at any time they observe a traffic violation regardless of which kind of highway they may be on at a given time. ACCIDENT INVESTIGATION: The Michigan State Police and Oakland County Sheriff's Office will share responsibility in traffic accident investigations. Agencies will normally respond to accident investigations that are reported to that particular agency. The Michigan• State Police will first request the Oakland County Sheriff s Office to respond to a situation which would be considered "life and death" and secondly would refer to a local agency if Michigan State Police personnel were not in close proximity to the situation The Oakland County Sheriff's Office would request the Michigan State Police to respond to an emergency situation if its patrol units were closer and the local agencies) again, would be the third agency requested to respond. CRIMINAL INVESTIGATIONS! The Oakland County Sheriffs Office and Michigan State Police will continue to conduct, in the unincorporated areas of Oakland County, any investigation that is requested by a citizen. In order to better serve the people of Oakland County, both agencies will shat -e information on criminal investigations being conducted by one another for the express purpose of aiding one another in the solution of any given crime. It is agreed that on all major crimes investigated by either agency, the other agency will be informed of the fact that the investigation is being conducted and provided with some details of the investigation. The purpose of this, again, is to make both agencies aware of crimes occurring within their area of jurisclictian and to share any information that may lead to the solution of the crimes. For a major investigation occurring within Oakland County, the Michigan State Police will provide whatever resources are available to assist the Oakland County Sheriff's Office or other departments conducting the investigation. Fat investigations being conducted in Oakland County by the Michigan Stet Police, the resources of the Oakland County Sheriffs Office will be made available to the Miehigan State Police. The residents of Oakland County are the benefactors of a close and totally supportive relationship between the Michigan State Police and the Oakland County Sheriffs Office, This law enforcement plan serves only to formalize the desired interdepartmentli practices and procedures for the hen4t of the citizens of Oakland County.
